Legal responsibility be cast on mobile phone companies


It is surprising that no legal responsibility is cast on mobile phone companies about the mass SMSs transmitted by them over their networks spreading rumors leading to the exodus of people from the NE from various parts of India. When treason and spreading hatred is a national crime, such a course of action would have prevented the trouble, SMS is person oriented message and is thus capable of causing instant harm rather than a website which will be required to be accessed by the receiver.

Declining Standard of Civil Services


It is good that one of the fellow officers has pointed out the standard of the civil servants, IFS in particular. In fact, it is not only some IFS officers, even some IAS, IPS, etc. sail in the same boat. Sub-standards in the civil services in policy making and policy implementation has caused the Aam Adami and finally the Nation a lot. The day-to-day affairs of mismanagement are the result of that. It will be a further mess of things if you mingle the All India Services. Every service should be result oriented. For that matter, IFS is less politicised than other All India Services.

CVC needs to be more transparent


A welcome decision.CVC has been functioning in an opaque manner ,need to be more transparent in giving its advice and vigilance clearance.Further posting of officers to the commision needs to be reviewed;only those who have the aptitude and willingness should be posted.

Can the disclosure of advice given by CVC impede the process of investigation?

Information regarding the vigilance advice given by the Central Vigilance Commission (CVC) in the matter of the appellant was denied by the Public Information Officer (PIO) citing the exemption provisions contained in section 8(1)(h) of the RTI Act stating that the disclosure of the information would impede the process of investigation. The Central Information Commission (CIC) observed that it is not clear how the disclosure of the advice given by the CVC in this case including the relevant file noting would impede the process of the disciplinary proceeding/ prosecution of the official concerned. The advice tendered by the CVC is an input based on which the competent authority decides about the nature of the disciplinary action to be taken in any particular case. The Commission further held that the affected person should have a natural right to know about the advice and the manner it is tendered. The CIC directed the PIO to provide the advice tendered by the CVC in this case including the file noting leading to the advice.

Comments

The manner in which the vigilance enquiries are being conducted require a drastic change in the post RTI era. New mechanism and procedure need to be devised to effectively conduct the investigations in a transparent manner.
