A creative streak by IPS officer

taught artist to follow his childhood passion of painting. However,
this should come as no surprises, one the foremost Indian artist, the
late MF Hussain has branded Choudhary's work as a ' living art form'.

creative journey at Vadodara, where a retrospective art show, displaying
15 years of Choudhary's creativity will be unveiled. A solo exhibition
of abstract works, it includes a vast range of works from small drawings

Importance to caste
In India we give too much importance to caste. Elections are fought
on castes. Even bureaucracy suffers from caste and language bias. If
the top head of an office belongs to a particular caste or speaks a
particular language he or she would like to surround himself/herself
by his own ilk. Brahmins, Kaysths, Tamil, Malayali, Kannada, Telgu.
Even at top level such biases abound at the cost of officers from different
castes and language speaking. Of course some are more notorious in this
respect. To my mind this is subverting the nationality of bureaucracy
and should therefore be criticised and those who indulge in this not
be spared. Why should the officer indulging in this game of replacing
good serving officers with his or her 'own people' without any rationale
be tolerated?

How secretaries are selected ?
The unsavoury controversy in these columns about former DGCA's unceremonious
exit must be put to rest. There is a need to carry out systemic changes
rather than indulge in blame game. Selection of officers above Joint
Secretary level are considered by an Officials committee of Secretaries
headed by the Cabinet Secretary. The panel is supposed to choose officers
with ability and integrity. The panel lists out 3 names for each post.
These are forwarded to the Appointments committee of Cabinet (ACC) comprising
of Ministers concerned and headed by the de jure PM. The list is arranged
merit wise but ACC, as the political committee is not obliged to go
by merit list. Names of meritorious officers get leaked in the process
leading to lobbying and mudslinging. When finally an officer is chosen
on the basis of his/her Specific Suitability , he/ she is made to feel
obliged for the favour done to him by the political Executive. The mischievous
Specific suitability clause is an euphemism for political manipulation
to plant spineless and pliable officers at key positions. The directions
of ACC are invariably 'non-speaking'. The morale of civil servants is
undermined by ignoring the ability and merit clause.

RIT
Should the PIO transfer the RTI applications to concerned public
authority in all cases?
The appellant filed an application under Right to Information (RTI)
Act with the President's Secretariat seeking information related to
the news of IPS Officer's murder. In response to the application, the
Public Information Officer (PIO) gave the name of the department from
where the desired information could be obtained. The appellant requested
the First Appellate Authority (FAA) to direct the PIO to transfer his
petition to the concerned Public Authorities. The FAA also advised the
appellant to seek the information directly from the concerned department.
During the hearing before the Central Information Commission (CIC),
the appellant submitted that instead of advising him to approach the
respective ministries for getting further information the PIO should
have transferred his RTI application to the concerned PIO in the respective
ministries. The respondent submitted that the appellant knew about where
the desired information could be found and he should directly apply
to those public authorities and not seek the information from the President
Secretariat or expect them to transfer his RTI application to other
public authorities. The Central Information Commission (CIC) observed
that wherever the PIO knows clearly where the desired information could
be found he should invariably transfer the RTI application to the PIO
of that public authority and should not expect the information seeker
to make separate RTI applications. Since the PIO of the President secretariat
knew that the grievance of the appellant had been transferred to the
Ministry of Home Affairs (MHA), he should have transferred the
application also.
Comments
The view of the different benches of the CIC has varied on the interpretation
of this issue as to whether the applicant is expected to file an application
to the PIO of the concerned public authority. The disposal of the RTI
application by the PIO has been as per the DoPT circulars (http://www.rtifoundationofindia.com/dopt-814)
and (http://www.rtifoundationofindia.com/dopt-742). Perhaps, the higher
judiciary should step in to set aside the confusion and decide the issue.
