Pakistan's former defence secretary Khalid Naeem Lodhi has challenged his sacking in the Islamabad High Court alleging that the patently illegal action was taken by the federal government to clear the way for removal of the army chief and the DG ISI for 'personal and political gains'. The petition has been filed by advocate Munir Paracha. President, PM, cabinet secretary, secretary establishment division and the acting defence secretary Nargis Sethi are respondents in the petition.

Islamabad's sessions court has dismissed a petition urging registration of a criminal case against US business man of Pakistani
origin Mansoor Ijaaz on the ground that he is a "secret agent of an anti Pakistan lobby trying to defame patriotic forces and destabilize the democratic government by publishing fake baseless 'memo-related' documents". The petition filed by a PPP worker Khalid Javed had urged a criminal case to be registered against Ijaaz under various sections of the PPC relating to false declarations, presenting fake documents and inciting people against the government.

Pakistan : College teachers to miss out promotion due to missing ACRs
At least 35 college lecturers in Pakistan's Federal Department of Education (FDE) are likely to miss out on their promotion as Readers for no fault of theirs. According to DG FDE Atif Mehmood Keyani these lecturers can't be promoted to the next grade as their ACRs are not available. Federal government college teachers association is agitated over the issue as timely submission of the ACRs is the responsibility of the concerned Principals and the lecturers can't be penalised for the Principals' fault.

Pakistan : Bill for States Reorganisation tabled
The MQM party has tabled a bill in the national assembly for reorganisation of existing provinces in Pakistan. The bill seeks to
carve out a new HAZARA province out of six districts of the Khyber Pakhtunkhwaha which are dominated by ethnic Hazaras. It further seeks to create a new Seraiki province comprising 21 districts of south Punjab. Dera Ismail Khan and Tank districts of the Khyber Pakhtunkhwaha province are sought to be merged after a referendum in the new south Punjab province.

"You are Cabinet Minister and should maintain your dignity" the Chief Minister said. How far it is appropriate or inappropriate for an elected representative to address a bureaucrat as "Sir".

Make the job opportunities open to all

In view of the current situation and problem, in the interest of 'aam admi' and in the interest of nation as a whole, it is high time that Government takes a judicious decision at this juncture and make the job opportunities open to all irrespective of age limit which is different for various posts in different states in India and also different for different types of jobs. Like the initiative taken by this Government for open economy, this decision of open job opportunities should also be taken by the Government. It is need of the hour more so when pension schemes are more or less same in the country after implementation of NPS in Government sector. It is true that still Registration of Births & Deaths Act could not be fully implemented in the country due to various reasons. As can be observed from debate unscrupulous people may get the birth certificate of any person when needed. The birth certificate generally does not show the name of the child as in our tradition generally child is not given name immediately after birth.

Before enactment of Registration of Births and Death Act 1961, there was provision in Northern states of India during British Rule that it was duty of the chowkidar concerned of the village to report birth of children in the village to the Local Police Station. where the record was maintained. The birth was reported on his visit to police station and as I have seen record was duly serial numbered and closed fortnightly duly mentioning the date of reporting by chowkidar. In some areas the chowkidar also reported the name of the child, I can't say how it (name)was reported in each and every case even after the 3-4 days or a week after the birth of child despite the fact that name of child is not kept in our society immediately after the birth. I am sure in most of the cases the name will not be the same as is mentioned in the birth records maintained at that time and even at present registration of name is not getting implemented under Registration of Births & Deaths Act 1961 and the column remains blank. In many cases birth date reported at the time of admission ofchild in the school does not match the child's actual date of birth. People do not generally want to get the records corrected due to complications faced by them. Even if a person goes for correction even prior to appointment it depends on the person dealing with the correction. Even if an executive corrects, the other executive of another department may not accept the correction. In some cases person may be forced to move the court where he finds it difficult to prove. He can not bring the chowkidar for evidence because he may have died. Supreme Court in a case has said that the evidence of mother is best evidence in such cases. But lower judiciary does not follow. Now it depends on the person sitting as judge whether he accept your version for correction or relates it to service etc and reject the correction based on suspicion. This is the working of judiciary - No law.

Avoid misuse of your portal

A very humorous senior IAS officer once told me that the only thing people of my state, Kerala, seems to have achieved due to cent percent literacy is not education, but the ability to write anonymous letters with both the hands. Now it appears that it has percolated into civil services also. I was reminded of it when I see persistent and unfounded personal attacks on a good Kerala cadre officer, presently on central deputation by a certain person using various pseudonyms, in true Amar, Akbar, Antony style. It is to avoid such misuse of your portal that some one suggested earlier that free e-mails should not be accepted as other wise WIC will be inundated by anonymous letters from frustrated elements.

RTI

Copy of the legal opinion obtained from the Ministry of Legal Affairs.

There was some discussion held between the then Solicitor General of India (SGI), the then Union Minister for External Affairs and the then Union Telecom Minister regarding the aspect of various cases filed by Cellular Operators Association of India (COAI) before the TDSAT and the Delhi High Court and during the said discussion, various issues related to the Telecom Sector were also discussed. Through the RTI application, the appellant had sought the copy of the written note / advice tendered by the then SGI. The CPIO informed the appellant that the Department of Legal Affairs is the custodian of the opinion tendered by the SGI and that such opinion is a confidential and privileged document and that the matter is also covered under Section 8 (1) (d) of the RTI Act. The FAA upheld the CPIO's Order holding that the information was exempt from disclosure under Section 8 (1) (e) rather than Section 8 (1) (d) of the RTI Act. The Commission held that the stand taken by the Respondent Ministry is not only incorrect but is also untenable. The Commission held that the advice tendered by the Law Ministry to the Department of Telecom does not per se fall under Section 8 (1) (e) of the RTI Act and directed to provide a copy of the said note / opinion given by the then SGI to the Department of Telecom free of cost within 10 days of receipt of this Order.

While the transparency in the working is welcome, the disclosure of the legal opinion may sometimes weaken the case of the government.
