Pakistan: Rawalpindi court to transfer 26/11 record to CMM Mumbai
Rawalpindi's anti terrorism court (ATC) has approved transfer of its record of the trial of seven Pakistan based Pakistani nationals for the 26/11 terrorist attack on Mumbai to the Chief Metropolitan Magistrate Mumbai who will be the Presiding officer for the proceedings of the judicial commission from Pakistan visiting Mumbai. ATC has also transferred its own judicial powers to Mumbai's CMM for the duration of the commission's visit to Mumbai. Court Clerk Hameed Afzal of ATC Rawalpindi shall be responsible to look after the record during the Mumbai proceedings and bring the same back to Rawalpindi. The ten member commission shall comprise of five defence counsels, two special public prosecutors, a deputy director from Pakistan's federal investigating agency, an officer from their external affairs ministry and the court clerk. The four Indian witnesses whose statements are to be recorded by the commission are Mumbai's Magistrate Ms RV Sawant Waghule who recorded Kasab's confessional statement, Inspector Ramesh Mahale IO of the case and two doctors who conducted autopsy on the terrorists who were killed during operations by security forces. Defence counsels will be able to cross examine the four who have been cited as prosecution witnesses in the Pakistani court.

Pakistan's federal cabinet has decided to amend the 1964 promotion and service rules so as to make publication of details of assets of civil servants, military officers and judges mandatory. At present public servants in these categories notify their property details to their respective organisations annually but the proposed amendment seeks to make the same public as is the case with law makers.

Orissa Chief Minister Navin Patnaik has asked Cabinet Ministers to maintain dignity of the office. Patnaik conveyed his mind when a Minister addressed "Sir" to an IAS officer in his presence. "You are Cabinet Minister and should maintain your dignity" the Chief Minister said. How far it is appropriate or inappropriate for an elected representative to address a bureaucrat as "Sir".

Unholy nexus between babu and neta

Recently there was a disturbing self-promotional item planted in this column that a section of the Congress Party wants a certain IAS officer to be posted as chief secretary of Kerala, though he was far junior and stood no chance of being posted. Disturbing because official appointments are to be decided not by political parties but by the government. This shows the abject servility shown by some babus to the netas in and out of power, for their private gains at the cost of public interest and in return for their boot-licking and law-breaking get plum assignments, multiple posts and foreign jaunts. It would be revealing that the officer in question holds three FA posts plus a DG post and boasts about his Harvard training and was holding half a dozen posts all at the same time while serving in his home state also. This new trend points to a severe deterioration in the values and culture of the steel frame which had served this
country well.

No harm in increasing retirement age

There is no harm in increasing the retirement age. But at the same time appointment should be made open without rerstriction on age on the basis of merit. As open economy, open govt. job opportunities must be there. Employee can get retirement benefit on the basis of years of service rendered.

Nothing wrong in exemption to Judges

I am in full agreement with the comments passed on the subject why such provision in the IT Act? There is nothing wrong in giving exemption to the High Court and Supreme Court Judges. What I feel is that the country is run by a few, viz. politicians & bureaucrats. Why I am saying so a few years back the Government of India issued circulars on Air Travel in which it was clearly stated that frequent fliers points which was being earned by the officers will no more be earned by the officer who is flighing at the cost of Government, but it will be earned by the Government itself. But after a few days that
circular was reversed saying that the frequent fliers point will be earned by the officer concerned who travelled by Air though at government expense. So, it is quite clear that in this country everything is possible since it is run by a few.

Certified copies of the photocopies

Background

The appellant sought certain attested documents and information regarding the rule of the RTI Act, under which the attested copies of documents should be given. The PIO denied the attested copies of documents claiming that the Public Authority does not possess original documents. The Commission directed the PIO to provide the relevant provision of law to the appellant regarding attestation and to supply attested copies of the photocopies of documents available in the records to the Appellant along with a note on each page clarifying that the same are only copies of photocopies and not copies of the original documents.

Comments

The RTI Act empowers the citizens of India to obtain certified copies of the documents from the Government Organisations and the PIO should not refuse to certify the documents even if the Public Authority does not possess the original documents. In such cases, a note should be given that they are only copies of photocopies and not copies of the original documents. It should be remembered that certified copies of the original may be used as an evidence in a court of law.
