Kerala High Court rules in favour of Dr B Ashok
In an unprecedented order the Kerala High Court on July 30, 2012 restored Dr B Ashok (IAS KL 1998) as Vice Chancellor of the newly organized Kerala Veterinary and Animal Sciences University. It removed the present Chief Secretary K. Jayakumar (IAS KL 1978) as acting VC.Jayakumar was made acting VC after the government ousted the VC Dr Ashok over an article in which the latter had criticised the practice of officers holding many charges simultaneously and doing justice to none. The High court observed that the action of the government was illegal, arbitrary and against public interest. It criticised the Chief Secretary holding charge of a University where he had no expertise.

Secretary Food reviews CWC's performance & awards 2 CWC officers

As a part of the performance review and target setting exercise, the Central Warehousing Corporation (CWC) organized a one day Regional Managers' Conclave at Corporate Office, New Delhi on July 28, 2012. The Conclave was attended by 18 Regional Managers, four Construction Cell Incharges, Functional Directors and Senior Executives of Corporate Office. Sudhir Kumar, IAS, Secretary, Department of Food and Public Distribution, Government of India also reviewed the performance of CWC, addressed participants of the Conclave and gave away performance awards for the year 2011-12 to the best performing Regions and the Construction Cells. B.B. Pattanaik, MD, CWC made a presentation on the activities of the Corporation and highlighted the performance during 2011-12. Addressing the Executives, the Secretary (Food & P.D.) stressed upon the need for diversification into new areas of business so as to reduce dependence on FCI, innovation in warehousing and logistic areas and mechanisation of handling operations. The Secretary (Food & P.D.) lauded for CWC's consistent growth and achieving highest ever capacity utilisation of 91% and record turn-over of Rs.1218.66 crore during 2011-12.

Indian bureaucracy has lost its sense of humour

It is a fact that Indian bureaucracy has lost its sense of humour after the British left. I remember having read about a District Collector in the North East who on his visit to a PWD guest house saw the remarks by a Sub-Collector in the guest book that the toilet is far away from the main building. "He should have started earler" wrote the Collector underneath.

Equal pay for equal work

I fully agree that the anomaly of the Stenographer Cadre in non-secretariat organizations should be addressed by the concerned officials of the GoI. Even the recommendations of the 6th CPC duly approved by the Government have been changed later. At least equal pay for equal work.

Save EPFO

The Employees provident fund organisation is the largest social security organisation of the world. It has 25000 employees all over India except J & K. The total officer cadre is 800 mostly recruited by the UPSC. They are facing acute stagnation in career progression. No cadre restructuring has taken place since 1952.Only one cadre restructuring proposal cleared by the Labour Minister is pending with the Ministry of Finance. Officers rendering 14-15 years of service have got just one promotion in spite of their sincerity and hard work by the virtue of which the obsolete organisation has been brought to the forefront in rendering social security to the poor workers and successfully running three schemes - Employees Provident Fund Scheme, Employees Pension Scheme and Employees Deposit Linked Insurance Scheme. The department has been computerised and for two years the staff and the officers worked even on Saturdays and Sundays to make the computerisation project successful but the dues of the officers like timely promotions and cadre restructuring etc are also not being done. The Government wants this organisation to die and vanish so that this area can also be privatised and sold on premiums but with their hard work the officers and staff have improved the services of the organization to be in tune with times. It is sincerely requested to raise this issue through your platform so that the officers and staff of the EPFO can get their due. Facts can be verified by contacting any officer of the EPFO.

Don't comment on legality of CAT's order

The matter relating to Select List 2003 is pending adjudication before High Court. The Government has taken a wise decision to go ahead with promotion by implementing the CAT's order as many of our promotee colleagues are retiring every month. In any case the promotion order is subject to the outcome of the court case, so there is no need to worry at this stage. When the matter is subjudice before the High Court, it is advisable not to comment on the legality of CAT's order.

Information regarding the Cabinet meetings for a period of seven years

The request for information in respect of the Cabinet meetings held over a period of seven years was refused claiming that providing the information about all the items/ subjects considered in the meetings held during this entire period would disproportionately divert the resources of the public authority and therefore, could not be disclosed as per section 7(9) of the RTI Act. The Public Information Officer (PIO) denied the decisions taken in the meetings under section 8(1)(i) stating that they are a part of the Cabinet papers and it was for the sponsoring ministry to decide finally if the Cabinet papers could be disclosed having implemented the Cabinet decision. Regarding the minutes of the meetings he invited the appellant to inspect the minutes register maintained in the Cabinet Secretariat. During the hearing, the respondent explained that every year, about 400 to 450 items came up for discussion in the Cabinet from various ministries and departments of the government and over a period of seven years, this number would be close to 3000 items. He submitted that collecting and providing this information to the appellant would be an extremely time consuming task and would disproportionately divert the resources of the Cabinet Secretariat. However, he offered that specific information in this regard would be provided if the appellant would identify any particular item or a few of those items. The Central Information Commission (CIC) agreed with the contentions of the respondent and advised the appellant to be more specific and ask for details of a few of these items so that the PIO can provide such information without putting strain on the resources of the Cabinet Secretariat. The Commission also observed that it is only the sponsoring Ministry or Department which can take a decision as to whether a particular Cabinet decision has been fully implemented or not; the Cabinet Secretariat cannot take such a call and decide about disclosing any Cabinet decision except those which arise out of any proposal of the Cabinet Secretariat itself.


Comments

The discussions in the matter point out that there is no mechanism at the level of the cabinet to be regularly updated about what action has been taken regarding a particular decision taken by it. It raises a question whether there should be a monitoring mechanism with the Cabinet to know of the fate of the decision taken by it?
