Samajwadi Party jolted in Mant(Mathura) by poll
Ruling Samajwadi Party(SP) in Uttar Pradesh has suffered a major setback
as it lost the assembly by poll for Mant segment in Mathura district
results of which were declared on June 15, 2012. Trinamool candidate
Shyam Sundar Sharma had won the seat by defeating his nearest Rashtriya
Lok Dal (RLD) rival Yogesh Nuahwar by 6,604 votes, SP candidate finished
at the 3rd position. The seat was vacated by Jayant Chaudhary son of
RLD chief Chaudhary Ajit Singh. Uttar Pradesh Chief Minister Akhilesh
Yadav's close associate Sanjay Lathar was the party candidate from the
constituency, and despite a busy budget session the Chief Minister had
specially flown down to Mant for campaigning in favour of Lathar.

Cabinet Secretary to chair meeting on new DG,

Cabinet Secretary, Ajit Kumar Seth is going to chair a meeting on appointment
of new Director General (DG) of the Indira Gandhi National Forest Academy
(IGNFA), Dehradun. The meeting is scheduled to be held on June 19, 2012.
Two Indian Forest Service (IFS) officers are in the fray. They are:
R K Goyal (1977 batch) and A K Wahal (1978 batch). Though the search
committee headed by Cabinet Secretary, Ajit Kumar Seth had met once,

A S Bhattacharya quits as Member in CVC's advisory
Board
A S Bhattacharya, ex Chairman & Managing Director, Bank of Maharashtra,
was a Member of Advisory Board of Chief Vigilance Commission (CVC) on
banks for a tenure of two years, has quit. The Board's job is to assist
the CBI in probing cases related to bank, commercial and financial frauds.
The advisory board is being headed by Ms. Shyamala Gopinath, ex Deputy
Governor (DG) of the Reserve Bank of India (RBI).

R P Sharma, who is presently IG in National Security Guard (NSG) Headquarters,
will soon be joining the UN Office on Drugs and Crime (ODC) in Delhi,

CAT instructs to DOPT not to debar the whistleblower
Officer of Haryana
Whispers in the power corridors are that the Central Administrative
Tribunal (CAT) has issued a notice to Haryana Government to come up
with its reply on a petition within 15 days. The CAT has also issued
instructions to DoPT to not to debar the 2002 batch Haryana cadre officer
Indian Forest Services (IFS) Sanjiv Chaturvedi. He has been waiting
since May 5, 2012 to be relieved by Haryana Government to proceed on
central deputation. He is supposed to join the AIIMS -Delhi, as Deputy
Secretary.

COMMENT FROM WHISPERS IN THE CORRIDORS.IN: Appointing R P Singh as

Warning of misuse of the RTI Act From the LIC (Mumbai), the appellant
sought the details of Probationary Development Officers and Development
officers, whose resignation was accepted/ terminated by public authority
during a certain period. He also requested that the information sought
should be provided as per the format given by him. The Public Information
Officer (PIO) denied the information by quoting the provisions of section
7(9) of the RTI Act that it would divert the resources of the Public
Authority disproportionately. During the hearing before CIC, the respondent
submitted that the information sought by the appellant pertained to
about 3000 - 4000 Development Officers and that this information held
at the divisional offices and was not available in the format provided
by the appellant but were available in individual files of each Development
officer. The appellant stated that he was the advocate of a Development
officer posted at Jaipur - I office of the Corporation who has not received
his arrears and that this information sought from the public authority
will be used to enable his client to recover his dues. The Central Information
Commission (CIC) stated that the RTI Act confers a cherished right to
the citizen and this case was a classic example of misuse of the RTI
Act. The Commission further observed that the appellant despite being
a responsible citizen (he was a lawyer) has chosen to use the RTI route
to harass the public authority with a view to getting an edge in the
legal case of his client which was undoubtedly a very unprofessional
approach to the issue. The appellant was advised to approach the Senior
Divisional Manager, Jaipur - I to obtain the calculation sheet for release
of arrears to his client. The Commission also warned the appellant to
be more careful in future while using the right given to him under the
transparency act.
Comments
There are many cases where applicants seek information in a particular
format. If it leads to wasting of the scarce resources and time of the
the public authority, the PIO is not bound to provide the information
in a particular format. He may offer inspection of the documents to
the applicant.
