Major loss for the Maharashtra state exchequer
The fire that has gutted three floors of the seat of Maharashtra government
is a major loss to national and state exchequer. Sources say that many
files were pending for clearance, some were being reviewed etc and now
all that has been consumed by fire. Whether sabotage or a short circuit
is the question still remains is that the loss to the government is
unrecoverable. Adding to the damage is the fact that the building was
not insured thereby giving a set back the state government exchequer
by a huge amount.

CCI Imposes penalty of more than six thousand crores on 11 Cement companies
The Competition Commission of India
has found cement manufacturers in violation of the provisions of the
Competition Act, 2002 which deals with anticompetitive agreements including
Cartels. The order was passed pursuant to investigation carried out
by the Director General upon information filed by Builders Association
of India. The Commission has imposed penalty on 11 Cement Manufacturers
named in the information @0.5 times of their profit for the year 2009-10
and 2010-11. The penalty amount so worked out amounts to more than Six
thousand Crores. The Commission has also imposed penalty on the Cement
Manufacturers Association. The Cement Manufacturers upon whom the penalty
has been imposed are ACC, Ambuja Cements Limited, Ultratech Cements,
Grasim Cements now merged with Ultratech Cements, JK Cements, India
Cements, Madras Cements, Century Cements, Binani Cements, Lafarge India
and Jaypee Cements. The CCI is headed by former Secretary Finance Ashok
Chawla.

None will pay IAS officers to become conduits
The reasons why IAS officers are leaving service are much misunderstood.
Nobody is leaving now when the recession is upon us, all those who have
left have done so pre-recession. Had it been a case of officers fearing
anti-graft action, the "exodus" should not have ended during
the recession. The reasons why IAS officers left service and joined
private sector lies in the hefty pay packets. Even in government, officers
are working hard enough. The honest work as hard as people of their
capacity and level in the private sector counterparts and are paid far
lesser. So, the honest were attracted to the private sector (pre-recession).
Now, this phenomenon has dried up due to the recession. Once, the recession
is over and the economy is on the growth path again, officers will again
leave, for the same reasons. And talking of officers using their contacts
and becoming conduits, nobody will pay IAS officers to become conduits.
There could anyway be plenty of corporate people who could be trying
to play that role, why should corporates pay good money to do what they
are already (if at all) doing ? The officers who have gone were all
efficient, educated and talented. They just wanted to do something else
with their lives. What is so wrong with that? Conspiracy theorists and
cynics can have their say but it simply is not true.

Warning of misuse of the RTI Act From the LIC (Mumbai), the appellant
sought the details of Probationary Development Officers and Development
officers, whose resignation was accepted/ terminated by public authority
during a certain period. He also requested that the information sought
should be provided as per the format given by him. The Public Information
Officer (PIO) denied the information by quoting the provisions of section
7(9) of the RTI Act that it would divert the resources of the Public
Authority disproportionately. During the hearing before CIC, the respondent
submitted that the information sought by the appellant pertained to
about 3000 - 4000 Development Officers and that this information held
at the divisional offices and was not available in the format provided
by the appellant but were available in individual files of each Development
officer. The appellant stated that he was the advocate of a Development
officer posted at Jaipur - I office of the Corporation who has not received
his arrears and that this information sought from the public authority
will be used to enable his client to recover his dues. The Central Information
Commission (CIC) stated that the RTI Act confers a cherished right to
the citizen and this case was a classic example of misuse of the RTI
Act. The Commission further observed that the appellant despite being
a responsible citizen (he was a lawyer) has chosen to use the RTI route
to harass the public authority with a view to getting an edge in the
legal case of his client which was undoubtedly a very unprofessional
approach to the issue. The appellant was advised to approach the Senior
Divisional Manager, Jaipur - I to obtain the calculation sheet for release
of arrears to his client. The Commission also warned the appellant to
be more careful in future while using the right given to him under the
transparency act.
Comments
There are many cases where applicants seek information in a particular
format. If it leads to wasting of the scarce resources and time of the
the public authority, the PIO is not bound to provide the information
in a particular format. He may offer inspection of the documents to
the applicant.
