about paramilitary forces. They are capable but suffering because intellectuals
are not paying attention to them. There are a large number of followers

Grapevine has it that Additional Secretary, Urban Development in the
Government of India, D Diptivilasa may return to the parent Uttar Pradesh

Ranjit Sinha, Director General, ITBP, will be leading a high level delegation

in Congo for the UN Civil police duties. In addition to this, he will
also be meeting the UN Police Commissioner to discuss operational requirements

'Paste the summons at last known place of abode of Parvez Musharraf'
SC
A three judge bench of the Supreme Court headed by CJ Iftekhar Chowdhary
hearing a plea for registration of a second FIR citing the former military
dictator as an accused for plotting and executing a plan to assassinate
Benazir Bhutto ordered on Monday that summons to Musharraf be pasted
on the gate of his house in Islamabad. 'The move' the bench said, 'is
aimed at letting Musharraf know that the case is being taken up after
two weeks'. Petition for registration of a second FIR has been filed
by Mohammad Aslam Chowdhary who remained Protocol Officer of the late
Benazir for 21 years and was injured in the attack leading to her death
on 27 December 2007 in Rawalpindi.
Gwadar DCO murdered in Karachi
Abdur Rehman Dashti District Coordination Officer of Gwadar Baluchhistan
was found murdered in Karachi on Monday. Dashti who had come to attend
an official meeting in Karachi was murdered in a house in the upmarket
Defence Housing Authority (DHA) but his body was found in the nearby
Khyaban I Tanzeem area outside the bungalow of a prominent politician
of Turbat Imam Bizenzo. According to SSP Naim Sheikh it is not clear
why the officer was visiting the house in DHA and whether the murder
has any terrorist angle to it.
'Doctrine of necessity is buried for ever' SC
The supreme court of Pakistan has declared that the doctrine of necessity
which was evoked by the highest judiciary in past to justify repeated
military coups 'has been buried by the valiant struggle of the people
of Pakistan for democracy, rule of law and constitutional government'.
Ironically the declaration has come in the detailed judgement given
by a bench of the apex court rejecting the intra court appeal by Prime
Minister Syed Yusuf Raza Gilani against the contempt proceedings initiated
against him. PM's counsel Aitzaz Ahsan had submitted in the appeal that
the contempt proceedings should be dropped against the PM as 'stability
of the democratic system in Pakistan depends upon the outcome of this
case'. The bench likened this argument to the plea taken by military
chiefs in past to justify coups in the name of necessity for the stability
of Pakistan and rejected the same. 'Let the PM stand trial and let the
trial bench decide whether or not he has committed willful contempt
of the court', the bench observed.
Hindus in Pakistan discriminated & scared?
Reports in a section of print media in Pakistan indicate that incidents
of kidnapping and forcible conversions especially of young girls of
the Hindu community are on the increase. Most of such incidents are
reported from Sindh where Hindus form the bulk of the minority community.
According to Rubab Jaffri Head of Sindh's Human Rights Forum, 'lots
of violent incidents are happening against the community on daily basis
compelling the Hindus to migrate out of Pakistan. From 2008 on an average
10 Hindu families have been migrating every month but in the last 10
months 400 families have already left'. Hindus form 2.5% of Pakistan's
population of 174 million and over 90% of them (Hindus) live in Sindh
alone where because of their sound financial position vested interests
keep trying to drive them out of Pakistan.

Some doubts were expressed by browsers regarding dismissal of the entire
Cabinet or Empowered GOMs ,in case, the policy decisions taken by these
bodies, are contrary to rules or against public interest or on alleged
pecuniary considerations. In my view, the Cabinet's 'collective responsibility',
should not be misconstrued to attract 'collective punishment'. It does
not, however, exempt the individual ministers from receiving individual
punishment under the Prevention of Corruption Act for their wrong doings.
The question of sacking or resignation of Cabinet should arise only
when the political party/coalition in power loses majority in the Parliament.

help thinking if, much of what we see in our news channels, with an
anchor on TV holding forth from war-torn streets of Kabul, isn't part
of a media-made reality show our war correspondents put on, between
drinks at the Kabul expat bar.

One wonders why Pranabdada, with his long years in various Ministries,
still speaks English in Bengali accent. In fact, most of the Bengalis
who come on TV are very poor speakers. Bengalis must be a very intelligent
lot but they should develop the capacity to express themselves fluently
when they speak to media or in public.

Should the legal course of action against a party be disclosed to
them?
Information on the implementation or otherwise of Hon'ble Gauhati High
Court's order dated 6.1.2010 and 29.6.2010 in the matter of Writ Petition
No. 591 of 2008 (including Miscellaneous Case No. 479 of 2010), 1048
of 2008 and 2814 of 2008 preferred by M/s Dharampal Satyapal Limited
and others was sought. The PIO rejected the application by claiming
exemption u/s 8 (1) (h) of the RTI Act holding that the disclosure of
the same at this stage may dilute the process
and harm the revenue interest. On appeal, the FAA rejected the first
appeal upholding the decision of the PIO that information sought by
the appellant at this stage is in the private domain and is not eligible
to be disseminated. The CIC upheld the stand of the respondents.
Comments
As a third party, a Public Authority is entitled to protect an information
which relates to it and which it has considered confidential. A person
cannot have the right to access all information about how the Government
is seeking to defend its position in a legal proceeding without having
access to similar information of the opposite party. Hence, the disclosure
of the information which the department has internally processed through
consultation with the legal advisers and officers of the department
can cause serious harm to the Public Authority's ability to safeguard
public interest as well as the Department's interest in any litigation.
