Reservation in promotions

The Union Cabinet's decision to seek a constitutional amendment for its decision to enforce reservations quota in matters of promotions too for the employees of certain classes seems to be a retrograde step which benefit neither the supposed beneficiaries nor others. On the contrary it will add to the heartburning and estrangement between government servants belonging to different castes. Our founding fathers of the Constitution had envisaged reservations in matters of recruitment for a limited period and it was expected that during that period by giving facilities for proper education and coaching members belonging to those communities would also come up to the level of the members of others castes and will compete equally. Once a person is recruited and after receiving institutional and field training starts his work he is expected to learn the skills equally with others who had come in the general category.. After a govt. servant works in the field or in the office he should be treated as equal and at par in all matters with his colleagues. There can't be different norms or yardsticks for judging the performance of different categories and there is no question of reservations in matters of promotion. This measure would make the members of the so called reserved category complacent and at the same time will create avoidable tensions amongst govt. servants. The political parties try to get political mileage by such populist measures but they do not bother to even look at the damage that will be done to the system. All thinking men and all political parties should oppose this measure tooth and nail. Our Father of the Nations had seen the vision of a classless society in free India. Will this measure be a step in that direction or it will further balkanise the various castes and communities. In no developed country there are classes like this: they are all just citizens of the country and each citizen has equal rights and equal responsibilities. We in India keep on multiplying privileged classes at the cost of dividing the socieiy further. India should be one country and each Indian should be just an INDIAN and nothing else.

Who will take care of bureaucrats at the centre?

Apropos the comment in WIC (06.09.2012) on above subject, it is pertinent to mention that there exist differential yardsticks not only to measure and acknowledge honesty (and efficiency) among bureaucrats but also as regards terms governing their placement to the same post. While Dr Abraham is fortunate that he did not have to quit government prior to joining SEBI as a Member and had the option of reverting, Sahoo, another honest and meritorious (useless) officer belonging to the Indian Economic Service had to resign as a prerequisite to occupying the post of Member, SEBI, and if the account given in the WIC post is true, M S Sahoo also bore the brunt along with Dr. Abraham. However, Government has lost Sahoo forever.

Can an appellant demand inforamtion in Hindi under RTI?

The appellant sought information in Hindi regarding ICDS projects operating in Delhi including details of each project on a CD, number of Anganwadi centers operating along with details of Anganwadi centers, details of budget allocations for each Anganwadi and also the details of beneficiaries (women and children) of Anganwadi centers etc..

The appellant filed a complaint before the Central Information Commission (CIC) alleging non-disposal of his request by the Public Information Officer(PIO) and First Appellate Authority (FAA). The respondents stated that information has been furnished by all the 94 PIOs of different ICDS
projects to the appellant and that they had provided the information as available in the records and some on CDs in cases where the information was available as computer data. The appellant stated that only 71 PIOs had furnished him the information, that too in a delayed manner and it has not been translated into Hindi or provided on CD. Further, the FAA had not bothered to dispose off his appeal.

The CIC issued SCN to the PIOs as to why penalty u/s 20(1) should not be imposed upon them for not responding to the RTI Application within the prescribed time period. The CIC also directed the FAA to show cause as to why disciplinary action should not be recommended against him. The CIC ruled that there is no provision for translating documents and then providing them to the Applicant under RTI Act. The CIC also ruled that information may be provided on CD, free of cost if the information is already available as a computer record. Details of all ICDS projects including budgets allocated to them, details of personnel working for these projects etc. were directed to be put up on the website of the Department as per section 4(2) of the RTI Act.

Comments

Translation or reducing the documents to electronic form in order to transfer them on to a CD just because the Appellant wants the information on a CD, is not mandated as per the RTI Act.
