Decks cleared for setting up of six addl Benches
of CESTAT
The Ministry of Finance has at last cleared the deck for establishment
of six Additional Benches of the CESTAT. The matter is now being sent
to the Cabinet for final approval. These six new Benches shall be located
as under:-Chandigarh ,Allahabad ,Hyderabad, New Delhi (Additional Bench),
Mumbai (Additional. Bench) and Chennai (Additional. Bench). The Members
of Bar and the Trade Industry are disappointed as no Bench has been
given to the Central India either at Jaipur, Indore or Raipur. Similarly,
in the Western Zone, a Bench either at Pune or Nagpur would have cut
short the torturous travel to Mumbai from far off destinations. It seems
that Govt has missed the point that the new Benches at Chandigarh and
Allahabad will take out large chunk of pending cases from Delhi Benches,
thus it would have been prudent to have a Bench either at Jaipur, Indore
or Raipur.

National level shorthand competition
I wish to briefly write about an article by one visitor about National
Level Shorthand Competition. This is good idea, since competition generates
creativity and sustained workmanship. How about competition for clerks
who ascends during their tenure still barely able to scribble few lines,
but acts on receipt of papers as if some decision would be taken by
them, though they know very well what are their capabilities including
one of pointing sarcastic fingers. You know, it is clerks who are defaming
the GoI and induce people like Anna Hazare to go for Anshan. You all
are the fit case for Citizens' Charter implementation. Then people will
realize whether you need training before appearing for competition or
suggesting others to undergo some competition. You are a sick visitor
who needs to be taken to some dispensary......take care of your health
after reading this.

Contemptuous statement
The Deputy Chairman of Planning Commission, Montek Singh Ahluwalia says
that a bunch of CAs cannot decide policy. He was referring to CAG and
his department. This contemptuous statement coming from an important
functionary of Government is quite outrageous. The institution of CAG
is provided in the constitution. To belittle it by such remarks is an
insult to the constitution. But what can you expect from those who have
come to occupy such high positions not by virtue of their being elected
by the people or having special qualifications for that but by because
of their proximity to powers that be. CAG and the Audit and Accounts
department raise their ire because they bring out the irregularities
in case after case where public money is being siphoned off by decision
makers.

About computer literacy
The view in the Forum (WIC 14/08/2013) makes an interesting reading
as it talks of computer illiteracy of the bureaucracy from top to bottom.
There is indeed more than required computer literacy among the school
leavers these days. Children are already computer literate by the time
they complete their boards, which is the minimum qualification to land
up a government job. In fact, today's generation might need handwriting
practice workshops. The language this generation uses is Latin for those
instructed on Wren & Martin or A S Hornby etc. They don't use the
spelling we are used to. As is well known, the telegram has made a mournful
exit and people have simply stopped writing letters. The tradition of
writing letters to friends and family regularly was more precious an
activity than emails. May be the bureaucracy of the future might express
shock when informed about writing office notes or letters in hand by
their predecessors! Who will, then, make which illiterate literate?
It was different 13 years ago as it would be 13 years hence.

Officers transferred if they don't abide by politicians
While there may be instances where officers are transferred because
they do not do what they are told by their political masters as in case
of Khemka, is it not possible that in many cases, they may be transferred
frequently simply because they are incompetent or inefficient?

Disclosure of police case diary
Inspection and certified copy of the complete case diary in relation
to a FIR was sought by an accused. The Delhi police informed that
as the case same is pending trial, the requisite information would
be asked from concerned court. Referring to section 172 of the
Criminal Procedure Code, the CIC held that the case diary maintained
by the police is a privileged document and all the details especially
relating to the identity of the witness needs to be protected.
There is a well-established procedure in law to ensure natural
justice and that the disclosure of the copies of the case diary
at this stage may impede the process of prosecution.
Comments
In Mukund Lal v. Union of India and Anr. (AIR1989SC144) the Hon'ble
Supreme Court held that "accused can peruse that particular
part of the case diary in the context of Sections 145 or 161 of
the Evidence Act - (a) if it is used by the police officer concerned
to refresh his memory or (b) if the Court uses, it for contradicting
the official concerned. Further, the Hon'ble Delhi High Court
in the matter of Deputy Commissioner of Police Vs. D.K Sharma
allowed disclosure of case diary wherein the trial proceedings
had concluded and the accused was convicted.
