Historic development in favour of IRS - 26 CCITs to get Apex Scale soon

If all goes well, this would be for the first time in the history of Indian Revenue Services (IRS) when such a large number of senior officers would get the Secretary Rank within the cadre. NALCO registers net profit of Rs. 160 cr in first quarter (UPDATED)
National Aluminium Company Limited (NALCO), a Navratna PSU of Ministry of Mines, being led by CMD Anshuman Das, has announced the results for the 1st quarter ended June 2013. According to the reviewed financial results for the 1st quarter of the financial year 2013-14, taken on record in the meeting held in New Delhi today, Nalco has registered a net profit of Rs.160 crore, which is in line with the target set for the quarter. However, there has been some decline in profit as compared to the corresponding period of last fiscal due to lower international price. On production front, while bauxite production during this quarter increased to 14.63 lakh tonnes against 11.42 lakh tonnes in the corresponding quarter of last year, alumina production has gone up to 4.82 lakh tonnes against 4.76 lakh tonnes during the comparable quarter of previous fiscal. During the quarter, power generation was at 1,327 million units, against 1,614 million units and aluminium production was 0.85 lakh tonnes as against 1.03 lakh tonnes achieved in the 1st quarter of the previous fiscal. The total alumina sale during the quarter was at 2.83 lakh tonnes as against 2.53 lakh tonnes in the 1st quarter of the previous fiscal. As regards metal sales, NALCO sold 0.85 lakh tonnes in the 1st quarter as against 1.02 lakh tonnes in the corresponding period of previous year.

Praful Patel behind move to change logo!

It appears that Praful Patel Minister for Heavy Industries is behind the move to change the logo of NTPC & BHEL. When he was the Civil Aviation Minister he was behind changing the name and logo of Indian Airlines as Indian and later made it as Air India. People were aware of Indian Airlines for more than 50 years and all of a sudden he created confusion. What purpose did the name change achieved. Now he moved into Ministry of Heavy Industries and doing the same confusion. He was responsible for developing un viable Airports in Jalgaon & Gondia where there is not even a single movement till date. Some one should file PIL and highlight such vested policy decisions of the Government.

Rotational transfer policy be followed strictly

I think the rotational transfer policy should be strictly followed in Central Govt. Ministries/Departments irrespective of age etc. to avoid vested interest in a particular department. People who retain in a particular department in a particular seat develop vested interest as they have no fear of being transferred and get protection from seniors. Their transfer is certainly a deterrent to developing such vested interests. This policy should be strictly followed at all levels in govt. and the maximum duration in one cadre should not be more than 5 years at all levels. After all, all government departments are the same.

Quite unfortunate changes

It is quite unfortunate that change in people at the Under Secretary and above in a particular Ministry heavily affects the routine work. On the one hand, the new incumbent tries to understand the intricacies of the new Section, suddenly his Section Officer and Assistants get transfer Orders. This leads to wrong decisions due to lack of proper feedback about a subordinate office. In one Ministry, an Officer of US level facing vigilance enquiry has been posted as a Head of Office in a Regional Office, particularly when the office is entitled to have a DS level Office. When such an officer heads a Regional Office, what would be image of the Regional Office. So, something serious thoughts to be given to carefully maintain all relevant records about a particular office/officer for making right decisions. Some Ministries repeatedly ask for ACRS for particular periods despite the field offices did send them several times.

Disclosure of police case diary

Inspection and certified copy of the complete case diary in relation to a FIR was sought by an accused. The Delhi police informed that as the case same is pending trial, the requisite information would be asked from concerned court. Referring to section 172 of the Criminal Procedure Code, the CIC held that the case diary maintained by the police is a privileged document and all the details especially relating to the identity of the witness needs to be protected. There is a well-established procedure in law to ensure natural justice and that the disclosure of the copies of the case diary at this stage may impede the process of prosecution.

Comments

In Mukund Lal v. Union of India and Anr. (AIR1989SC144) the Hon'ble Supreme Court held that "accused can peruse that particular part of the case diary in the context of Sections 145 or 161 of the Evidence Act - (a) if it is used by the police officer concerned to refresh his memory or (b) if the Court uses, it for contradicting the official concerned. Further, the Hon'ble Delhi High Court in the matter of Deputy Commissioner of Police Vs. D.K Sharma allowed disclosure of case diary wherein the trial proceedings had concluded and the accused was convicted.
