be settled!
Amid the trail of troubles for Durga Shakti Nagpal and the ongoing internal
tussles between the IAS Associations and the political masters of U
P Govt; the emerging new scenario seems to bring the normalcy back on
the track soon. Durga Shakti submits her reply to the chargesheet served
by the UP Govt, four days prior to the deadline of 15 days would expire.
If some top sources inside the UP Govt & administration are to be
believed the chief minister Akhilesh Yadav has made his mind to revoke
Durga's suspension albeit in a different manner. Reportedly, the orders
and chargesheet etc would be put under non-recordable category so that
their implications do not blunt her ACR and career prospects. Secondly,
the minor punishments may be imposed so as to save the face of the Govt
and preserve the political mileage. The political spectators make it
a point that by doing so Akhilesh would be able to avert the possible
damage of his young progressive image.

The facility of RTI online web portal has been extended to 37 Ministries/Departments
of Government of India. This facility would be extended to all the remaining

Tewari gets addl charge of Member (Revenue),
CBDT
R K Tewari, Member (IT), CBDT, has been assigned an additional charge
of Member (Revenue), CBDT along with zonal charge of Eastern Zone (West
Bengal and North East), Orissa, Bihar and Jharkhand till September 4,
2013.
Four IRS-IT officers transferred
As many as four officers of Indian Revenue Service of Income Tax cadre
working at the level of Additional CIT/Joint CIT have been transferred
and posted at different palces. Accordingly, Dr S Shakir Hussain has
been appointed to Directorate of IT & TP, Bangalore while Budala
Koteswara Rao was posted to CCA Delhi and Priya Sahu is being moved
to CCA Kanpur. Besides, Jivandeep singh Kahlon has been appointed to

DoPT sponsoring post-graduate diploma programme
2014-15
The Department of Personnel and Training (DoPT) is sponsoring a fifteen
months' Post Graduate Diploma Programme in Public Policy and Management
during 2014-15 at the Management Development Institute, Gurgaon. This
9th programme is scheduled to commence from April 8, 2014. It includes
an international module of six weeks' duration at a foreign university.
Nomination of suitable officers can be sent to this department through
before November 4, 2013.

Positive fall out of Khemka and Durga Shakti episode
One very much good fall out of Khemka and Durga Shakti episode can be
seen in Department of Posts. Mrs. Padmini Gopinath ,Secretary, Postal
Department was speaking in felicitation ceremony on successful completion
of world touring of her colleague Mr Alok Saxena, Secretary. Mrs Gopinath
saying some tough words, corruption of any kind not to be tolerated.
She say one HAG level officer already placed under suspension. All officers
catch by CBI will be punished. She emphasize saying till now only class-3
and 4 employees punished but now fixing of responsibility on corrupt
Indian postal service officer also. A list of tough measures submitted
to Kapil Sibal. Alok Saxena, Secretary is made in- charge of anti corruption
squad. There is all round fear in department. Perhaps corruption can
at last be ending in department of posts.

Control needed
Retiring government officers are not allowed to take up employment immediately
after retirement, and certainly not with Corporates etc with whom they
had official dealings. This principle needs to be extended to such officers
joining political parties immediately on retirement, as all of them,
without fail, have dealings with political parties during their career.
In fact, administration suffers greatly because of such officers, who
have been seen to be openly playing immoral party politics in violation
all conduct rules while in service to gain quicker promotions, creamy
postings, foreign assignments, post retirement sinecures like the umpteen
Regulatory Authorities and Tribunals. If nothing, they get one man committee
created for them, or some post called Advisor or Consultant. they only
twist the existing policy, tweak the rules to serve the political masters
of their choice, oblige the businesses for personal gains, float NGOs
and channelise funds in to them. Nobody dare cross them or throw the
rule book at them. They rule as officers and continue to rule their
after as elected or nominated MPs/MLAs and even ministers. When they
wangle a minister's most lucrative job, they act as real Babus, the
bureaucrat, interfering in the working of the administration by the
lawful authority. They enjoy humiliating, hurting and harassing the
highest bureaucrats under them for no rhyme or reason excepting their
highly inflated egos, which exceed their domestic and foreign travel
bills and hospitality expenditure at government cost. The politicization
of bureaucracy has to be stopped forthwith. It will be our sincere celebration
of the 67th Independence Day ! A ban on the retiring officers joining
political parties immediately on retirement should become effective
from this I Day.

Difficult to mend mind-set of CSS Officers
While it is true that computer based typing should be made compulsory
for all senior officers, my experience has been that those who have
passed out from foreign universities and officers in the age group of
30-40 years do possess good knowledge and speed of English typing as
one has to type their own thesis and programs in computer. It is very
difficult to mend and change the mind-set of CSS Officers as they are
accustomed to the luxury of Stenos for even writing a casual leave application.

Disclosure of police case diary
Inspection and certified copy of the complete case diary in relation
to a FIR was sought by an accused. The Delhi police informed that
as the case same is pending trial, the requisite information would
be asked from concerned court. Referring to section 172 of the
Criminal Procedure Code, the CIC held that the case diary maintained
by the police is a privileged document and all the details especially
relating to the identity of the witness needs to be protected.
There is a well-established procedure in law to ensure natural
justice and that the disclosure of the copies of the case diary
at this stage may impede the process of prosecution.
Comments
In Mukund Lal v. Union of India and Anr. (AIR1989SC144) the Hon'ble
Supreme Court held that "accused can peruse that particular
part of the case diary in the context of Sections 145 or 161 of
the Evidence Act - (a) if it is used by the police officer concerned
to refresh his memory or (b) if the Court uses, it for contradicting
the official concerned. Further, the Hon'ble Delhi High Court
in the matter of Deputy Commissioner of Police Vs. D.K Sharma
allowed disclosure of case diary wherein the trial proceedings
had concluded and the accused was convicted.
