Will the sanctioned strength of CIC continue
to face the crunch?
With the fast approaching date of retirement of Satyanand Mishra and
M L Sharma on September 4 apprehension is getting stronger about the
strength of CIC in terms of sitting members. The sanctioned strength
of CIC is 11, including CIC, out of which four seats have been lying
vacant since months. Even after the successors of Mishra and Sharma
are appointed in days to come the numbers would remain the same. Sharma,
reportedly, has chosen to join hands with the CIC Satyanand Mishra to
make an exit on Sept. 04.

I see no hopes for India, it is incorrigible country. Let some outsider
take contract to repair the system with strong hand.

Factors to be rectified to stop steep fall of rupee
There are several factors which must be rectified to stop the steep
fall of rupee. Our growth rates have gone down substantially . Why?
I find certain factors responsible for this.
1. Halting of many infrastructure projects due to environmental green
raj.
2 .Be it highways, mining etc, all are at grinding halt.
3. Certain scams and CBI investigations have further disturbed various
sectors including telecom and mining due to 2 g and coalgate scams.
4. Besides, the policy paralysis, as many government servants are scared
to take out of box pro development decisions which was rightly pointed
out by Chief Minister of Maharashtra.
5. What Vedanta has suffered in Odisha etc has adversely eroded the
opinion of foreign investors.
6. Lot of campaigns against Swiss bank dollars have also scared genuine
foreign investors.
When growth rate declines, the capital also moves out giving further
adverse impact. The oversupply in the real estate and distrust of middle
class in the share market because of its inherent dirty tricks etc.
Now people find gold as good destination to invest. So a Gold rush upsetting
the entire foreign reserves. Thanks to good Monsoon otherwise excess
pressure of oil import could be further devastative.
I find the gold tax policies further upsetting the situation. Restriction
in import of gold and imposing heavy duties and taxes on import of gold,
have created a Smuggler class who indulge in the gold trade, sending
rupee through hawala creating further pressure on rupee and demand of
dollars abroad. We must change our Gold policy. All banks should be
allowed to sell Gold in open market at par with international rates
in cash also, discouraging Smugglers market. This will reduce the Gold
smuggling and dollar demand abroad.

same not yet fixed or the concerned has not yet received the said amount
to release the orders for the post ?

May good sense prevail
In the Uttarakhand tragedy it was only the ITBP & NDRF under the
present DG that came at the rescue of the Government to save the large
scale human tragedy which struck the State and the credit for visiting
the inhospitable terrain first time in the history of ITBP led to reality
at the China border manned by ITBP. Hardly 4 working days are left no
successor has been selected for the post of DG, ITBP. What message we
are giving to the world or some vested interest in the department stalling
the process. May good sense prevail and a leader of suitable seniority
is appointed.

Misuse of vehicles
Vehicles at the cost of PSUs is not only being misused in the Ministry
of Coal rather in all the Ministry/Departments having PSUs under their
control. The Ministry of officials are taking transport allowance on
one side along with their salary and at the same time availing the vehicle
facility of the PSUs for commuting from office to residence. This is
criminal, the CVC needs to refer the matter to CBI as they have done
in the case of LTC. One more malpractices also needs to be inquired
i.e. claim of transfer allowance on retirement. This practice is also
rampant. People are settling in the place of retirement and at the same
time claiming transfer grant by showing falsely that they are going
to settle at places like Bangalore, Hyderabad etc.

Provide vehicles with GPS system
All Government/PSU vehicles, including vehicles taken on hire should
have GPS system and log books should be GPS system based. The misuse
of official vehicles should go down and consumption of Petrol/Diesel
will go down immediately. Secondly, DPCs are held by UPSC in places
outside Delhi, when all DPC members are Delhi based and the files are
in Delhi. Like DPCs of Group A officers of CBDT and CBEC. Companion
free foreign travel- when spouse or children of bureaucrats travel free.
Why can't they call quotations as is being done by CBDT and CBEC. In
the cases of CBDT and CBEC, the FAs who are IAS apply different yardsticks
and same IAS chaps, who are FAs in other Ministries. Avoid wasteful
expenditure and spend on welfare of people.

Case of missing Coalgate files is quite serious
The curious case of missing Coalgate files is quite serious. It is
obvious the guilty in this massive scam have made the files disappear.
Who knows these would have been destroyed. 'na rahega baans na bajegi
bansuri'. When the evidence of wrong doing is not available how can
CBI prove their guilt ? But have the accused not compounding their guilt
by destroying the evidence? They need to be hauled up for this crime.
If they go scot free it will send a very wrong message to all the evil
doers in bureaucracy. Take wrong decisions, indulge in financial irregularities,
cause loss to the exchequer and let the files disappear. No one can
catch you. I hope it doesn't happen and Apex court orders severe action
against all those who play both 'chor and chatur'.

COALGATE SCAM
Reconstruction of Coalgate Scam files is the only solution. The files
have been dumped in the sea of corruption. Comparison with Anaarkali
is ludicrous.

'Beware ; Reconstructed Scam Files may not have Evidentiary Value?'
The re-constructed coal gate scam files may not stand scrutiny in the
court of law. The ruse seems to have been floated by the political class
to hoodwink the public. Vested interests are active. The Media failed
to see through the game. This column is a wake-up call in a super sensitive
case like the Coalgate Scam. There is a reference to GoI Compendium
on re-construction of missing files. Fair enough. But, the suggestion
may not work in court matters. Complete reconstruction of missing files
is impossible. Worse, the re-constructed files will always be scanty
or incomplete with little or no evidentiary value.
While the 'Correspondence' portion of files could be recreated to some
extent with photocopies collected from different sources. It is common
practice in the PMO not to retain photocopies of communications received.
These are merely forwarded to ministries concerned for action. The PMO,
more often than not, works by receiving and giving oral directions .The
position turns bizarre when the PM doubles as Coal minister. Another
point. The most important part of a file is the 'Notes' portion carrying
signed directions of competent authorities and observations of lower
bureaucracy. Once lost, how these could be retrieved. One wonders whether
the office of C&AG (as suggested in these columns)would be able
to supply authenticated copies of 'Notings' from all Coalgate scam related
missing files. In the absence of 'unethical orders' in file notings,
how could charge sheets be framed against the offenders by CBI for court's
approval ? Even if filed, it will be weak, liable to be rejected due
to legal infirmity. Consider the legal aspects. Jurisprudentially, an
accused is presumed to be innocent till found guilty by a competent
court. In giving its verdict the court will give 'benefit of doubt'
to the Coalgate scamsters due to absence of material evidence. Will
India's tax payers allow the Coalgate scam suspects to get acquitted
and go scot free? This will be a travesty of Justice. Let us not get
trapped.

causing high scale inflation. Thus, why don't the Economist at helm
of affairs work to make fuel price - whether petrol, diesel or even
cooking gas both domestic and commercial - affordable. All subsidies
can be diverted to it and thus make food grains, nutrients, vegetables,
commodities all affordable and will not require further subsidy that
is drain to exchequer and pain to citizens.

Using RTI as a tool against business rivals
Through four separate RTI applications, the appellant had sought
a large number of information regarding the operation and maintenance
contracts granted from time to time for the CFTRI. The PIO had
provided some information and the same was endorsed by First Appellate
Authority. The CIC directed the PIO to allow inspection all the
relevant files relating to the operation and maintenance contracts
for the period specified by the appellant so that he can find
out whatever
information he wants. The CIC cautioned the appellant that RTI
should be exercised responsibly and, as far as possible, for larger
public interest. It should not be used as a tool against business
rivals as it appears in this case.
Comments
Collating information takes both time and involves cost to the
public authority and takes away valuable time which could otherwise
be used for discharging other duties in public interest.
