Whispers in the corridors of power have it that L C Goyal is poised to be appointed as OSD, Ministry of Rural Development, GoI, before given as full fledged Secretary, Department of Rural Development. The 1979 batch IAS officer of Kerala cadre, recently empanelled as Secretary, GoI has been serving as Special Secretary (Cabinet Secretariat), Personnel & General Administration, Cabinet Affairs.

As many as nine Indian Police Service (IPS) officers are retiring in August, 2013. Cadre review of CBEC cleared
The COS has finally cleared the Cadre Review of CBEC with minor changes i.e. 14 posts of Apex scale instead of 16 and 100 posts in HAG against 110. The cadre review of CBDT having already been implemented, officers are now awaiting speedy Cabinet approval. There is great celebration amongst the officers since promotions, especially at the lower levels in Central Excise, have always been an issue.

Will Jayesh move to LBSNAA as Professor?
Amid the ongoing speculations about Andhra CM's unwillingness to relieve Jayesh Ranjan for central deputation, the fresh buzz is that Jayesh may soon move to LBSNAA as Professor. The 1992 batch IAS officer of Andhra cadre, empanelled as JS, GoI, is serving as MD, Andhra Pradesh Industrial Infrastructure Corporation. If all goes well Jayesh would be the one to explore the freshness in the new probationers scheduled to join LBSNAA from September 8 ?

Narlikar poised to be appointed as PS to Ghatowar
As the grapevine has it Jayant Narlikar is all set to be appointed as the new PS to Paban Singh Ghatowar, Minister of State for Department of North Eastern Region. Narlikar would succeed Niraj Verma who would further succeed Abha Shukla as Joint Secretary, NHAI by the first week of September. Narlikar, a 2003 batch IAS officer of Assam-Meghalaya cadre, is currently serving as Deputy Commissioner, Kokrajhar district, Assam.

Is appointment process of new CRB taking elimination route?
If recent developments are believed and their compliance to the appointment of new CRB is figured out one may well see a scenario where the appointment seems to have taken an elimination route. Purportedly, CVC report has put R S Virdi's name, who supposedly commanded the brightest prospect for CRB, under a negative category leaving only four contenders in the race namely; Arunendra Kumar, A K Mittal, V K Gupta and Kul Bhushan. Virdi is GM, North Frontier Railway. Presently Arunendra Kumar is running the affairs as CRB.

NBCC contributes to build 200 bedded hospital at New Delhi (UPDATED)
200 bedded Hospital at Ambedkar Nagar, New Delhi to be executed by NBCC at an approximate cost of Rs. 126 Crore, a Memorandum of Agreement (MoA) for the project was signed between NBCC and Govt. of NCT, Delhi, on July 23, 2013. NBCC has huge stake in Govt.'s initiative towards providing state-of-the-art Healthcare facilities in the country. Wisdom of the Judiciary needs to be respected

The Judiciary as an organ of the State and the judges are held in high esteem in any political order. In India, Judiciary is the guardian of our Constitution. Whenever the constitutional rights are breached, the Judiciary is the only means where remedy for restoration of the constitutional rights can be sought. Our Judiciary gives decisions and pronounce judgments as per Codified Law of the country and on the basis of the best evidence rule. Judicial decisions are guided by Law texts and not by emotions. Depending upon the nature of the court's ruling, the judicial policy may have a very narrow or a very broad impact. That is why it is of utmost importance that judicial decisions and pronouncements of judges which have far reaching consequences are properly implemented with due diligence, in the interest of the polity and the society.

As a constitutional authority, Judiciary (Supreme Court) has also been vested with the authority as well as duty to advice the Head of the State on matters pertaining to Constitution, law, etc. Article 143 of the Constitution confers upon the Supreme Court advisory jurisdiction. The President may seek the opinion of the Supreme Court on any question of law or fact of public importance on which he thinks it expedient to obtain such an opinion. However, the opinion is only advisory, which the President is free to follow or not to follow.

The role of the judiciary to ensure equality, justice and liberty to the citizens has also been constitutionally defined. Article 32 of the Constitution empowers the Supreme Court to issue directions or orders or writs for enforcement of any right conferred under the Constitution for securing social justice.
The Supreme Court has granted great relief in cases of social injustice to the affected groups of the society under this provision. Article 32 is an important instrument of judicial process to enforce social ordering. Article 32 of the Constitution of India itself is a fundamental right, which accorded free hand to the Judicial Process enable the Supreme Court to take suitable action for the enforcement of social order. Deprivation of the fundamental rights often results in to social disorder.
The Supreme Court is a sentinel of all fundamental rights, and we are satisfied to see that the Apex Court has taken recourse of judicial process effectively in every area of social disorder to set it right and granted relief for each type of evil prevailing in the society. The Supreme Court has played positive role in implementing social order. Judiciary has not shied away from its responsibility of enforcing social order. Looking to the need of hour and demands of the changing society, the Supreme Court has innovated various tools and techniques, for securing social order. One can see how the Supreme Court of India has innovated, case after case, various juristic principles and doctrines, for upgrading social order. Needless to say that , Articles14, 15, 16, 17, 38,39A and 42 to 47 of the Constitution of India deal with facets of social justice. Courts have played very wide role in interpreting the Connection for achievements of social justice. Bedsides this, the judges, both individually as well as collectively, have also made many important observations and opinions.

In view of their experience and wisdom, the observations/suggestions/opinion of the judges assumes significance and deserves utmost respect. In the present time where corruption is at its peak, where people are losing faith on the political class, judiciary appears to be the only silver line for the people to hope for a better future.

Another important matter is that judicial decisions of foreign courts have also their implications in India. This is more relevant in cases of corporate matters involving multinational corporations.

But, the most important aspect of such orders / observations / opinions is how they are treated by the executive in respect of their implementation. After a court's decision is reached/such an order is passed/observation or opinion is made, how they are examined is very important in this context. Who are the agencies responsible for examination, interpretation and implementations of these words of wisdom? In India, it has been the practice to get these orders examined and interpreted by the officials in the Law Ministry and other respective Ministries. Files are initiated by officers not above the rank of Under Secretary. But it is a sorry state of affairs that these officers are neither skilled nor competent and experienced to examine the words of senior judges of our judiciary. As a matter of fact, the letters of order are examined and not the spirit of the order. This not only amounts to miscarriage of justice in the bureaucratic process but also disrespect to the legal luminaries who want a degree of order in our society, economy and polity. For an example, the Health Ministry of India which was examining the US Court order related to violation of USFDA drug safety norms by Ranbaxy at its manufacturing units in India could not order a probe into the matter even after lapse of a significant period of time.

Legal work is a specialists' job. It must be understand and accepted that the Judges give their decision without any pride and prejudice and the Judges are neutral to everyone. All the decisions are made according to the written law of the country. So, the judicial decisions must be respected. In this context, outsourcing of legal activities of government to experienced and competent lawyers and law firms needs special mention. The field of legal outsourcing was largely untapped. At present the number of jobs in legal outsourcing in India stood less than 12,000. The most important challenges to legal outsourcing included concerns about data security, conflict of interest rules, and the need for Indian lawyers to pass US bar examinations. Government, if it wants that judicial orders and words of wisdom from the judges are valued, respected and put into implementation models, it should seriously think about outsourcing of its legal activities.

Apropos Dev\s Speech at Mussorie, his suggestions are apt, timely and practicable. All the IAS officers must rise to the occasion. The country is heading towards darkness , IAS is the only visible light at the end of the tunnel. None of them has a reason to choose to become corrupt. All of them possess capability to earn much bigger money in the corporate sector. Officers, you must not surrender to the wrong doings of any. You joined this Service with a purpose. Let it not get defeated.

Stagnation of Steno D and C

UDC & Asst of 1993 have become SOs. In our cadre the increase in PPS & Sr.PPS/PSO post has been done by reducing the created PA/PS posts after cadre restructure in 2006. As match saving these posts were not filled but only PPS and Sr.PPS/PSO posts have been increased. Even the benefit of pay fixation has not been given to us. As far as our problem regarding stagnation of steno C is concerned even after 22-25 years, this DoPT is only a dummy department. They are even not capable of fixing responsibilities in performance of duties for PPS/Sr.PPS/PSOs as they only do the appointment work and simply sit late for other benefit and not for taking dictation or any other responsible work. Hope DoPT corrects itself

CBI's request document regarding permission for registration of a criminal case

Shri O.P. Nahar, requested the Commission for a copy of CBI's request document regarding permission for registration of a criminal case against him. He also wanted a copy of note sheet in which the said proposal was examined by the CVO and Law Secretary. The CIC observed that the CBI has been exempted under the provisions of the RTI Act vide Notification dated 9.6.2011 whereas the appellant's RTI application is dated 5.5.2011, which is prior to the said Notification. Therefore, the CBI was not an exempted organization at the time of filing of the RTI application. The CIC directed for disclosure holding that it has not been explained how the disclosure of information can impede the process of investigation or apprehension or prosecution of offenders, which is admittedly over.

Comments

Whenever a PIO denies information under any of the exemption sections of RTI Act, the explanation as to how the said section is applicable in the case should be given. Further, a process which is complete and over cannot be impeded by disclosure of information.
