Resentment among Railway
officers against attack on ADE, Sultanpur
Resentment is brewing among the Railway officers against attack on an
Assistant Divisional Engineer (ADE), Sultanpur, in Lucknow division
of Northern Railway. The youngest officer was reportedly beaten up by
a mob of around 35 persons and no action has been taken against the
accused. However, the matter has been taken up with the Railway Board.

SAIL production up by three percent
Steel Authority
of India Limited (SAIL) has registered three percent growth in production
of Saleable Steel, at 1.08 million tones, during July 2013 as compared
to the same month last year. Owing to SAIL's renewed focus on controlling
internal costs, techno-economics parameters of production continued
their upward trend with energy consumption and Blast Furnace productivity
showing improvement of one percent and two percent respectively. SAIL's
modernisation and expansion programme (MEP) continues to be implemented
on high priority. Cumulative orders worth Rs 58,579 crore were placed
and an expenditure of Rs 46,064 crore incurred until June 2013.

Britain continues with barbaric racism
In an act of blatant and barbaric racism, Britain has imposed a 3000
pound visa fee on what it considers racially inferior people of South
Asia , Ghana and Nigeria. This shameless racist rule does not apply
to the white people of Europe. What indeed do Romanians, Bulgarians
and Poles have in common with the English except their habit of using
toilet paper and bathing once a year? This kind of racial discrimination
is akin to the restrictions the Nazis imposed on German Jews in Germany
in the 1930s which the Britain of those days heartily approved of. We
are living in 2013 and such conduct by responsible governments is hardly
acceptable by the current international standards of human rights etc.
India should protest and protest loudly in world fora against such blatant
acts of racism, otherwise it will be another case of racist excess similar
to the virginity tests imposed on women of south asia by Britain.

Passport Service
I fully agree with the views expressed regarding Passport Service. Passport
is everyone's right. Government can stop your International Travel or
impound your passport at any given time, if circumstances warrant.

It's not democracy but mafiacracy in our country
It is indeed heartening to see the response to the suspension of Durga
Shakti by the media and fellow service officers. I hope they take it
to logical end and not let the politicians get away with their sins.
DM Noida also deserves all praise for giving a clean chit to her without
succumbing to the fear. This is what we need -fearless honest officers
who place their line of duty over other considerations. I hope Ravikant
the D M is not next in line for suspension. Azam Khan has already asked
for his suspension too. One is also amused by the reaction of political
parties. Congress looks sympathetic but what have they been doing. Can
I remind them of a blatant and unethical action way back in 2007 when
an innocent officer was suspended for an affidavit on Ramsethu project
which contained a line which the shouting brigade of BJP found offensive.
To get out of this political embarrassment an innocent officer was made
a scapegoat though he was neither the author nor the signatory to that
affidavit and the same was cleared at every level in the bureaucracy
and the level of the minister concerned. No one helped the officer .All
his representations including one to the Prime Minister went unheard
till CAT came to his
rescue. Take BJP now. A very upright Revenue service officer was suspended
during NDA rule as he dared to scrutinize the accounts of Vishwa Hindu
Parishad. When UPA came to power he thought they will do justice to
him. But no. An honest officer has no value for any party. Poor man
remained under suspension and has been fighting a legal battle for 15
years now and has retired without getting his pensionary benefits as
due to him. BSP supremo Mayawati was quick to criticise SP Government
on Durga's suspension but what she did during her rule. Transferred
and suspended IAS officers left and right to cow them down. They are
all chips of the same block these politicians, out to loot the country
and in this mission whosoever comes between their way to wrongdoing
is shown the door. It is not democracy but mafiacracy in our country.

Politicians beware
Politicians need to be reminded that they are holding their positions
as legislators, ministers etc. because the election law and procedure
are legally implemented by bureaucrats. Otherwise they are like any
other person on the street. The IA S. officers may not be elected but
they are selected on merit from amongst lakhs of educated and intelligent
candidates and are appointed by the President under the constitution
to act as per law and to work without fear or favour. They owe allegiance
to the constitution and not to the politicians who are distorting the
system for their personal gain .Officers like Durga Shakti should be
supported not only by the association if anarchy is not to overtake
this country.

Who is General, OBC, or Dalit leader is not the question
Reading between the lines? My point was about media's favouritism and
not who is Dalit or OBC. The point was as to why media houses avoid
SCs as Prime Ministerial candidates inspite of voter's will. General,
OBC, Dalits and others, are all our leaders and they should not be known
by their Castes. But, media speculate biased projections such as listing
of prime ministerial candidates by Whispers (otherwise a world class
website) make us believe that casteism in Indian media exists. All know
who was the most successful CM four times in India? In whose four tenures,
people all religions felt safe and sound? One can read, Mayawati holds
more educational degrees than Modi. She also governed the biggest state
four times without communal riots, though UP has largest number of people
from other religions. In people's view, Mayawati makes an interesting
case study when we compare her political and administrator acumen with
other CMs, particularly with Modi. Yet, she was not given one-inch space
in the column of lists of prime ministerial candidates by the whispers
---- unfair.

When a person perpetuating injustice becomes disciplinary authority
!
I am reminded of a case of Dalit LDC who was asked to deliver some goods
at senior officer's residence towards the close of office hours. The
poor LDC asks for a gate pass to be signed. S.O. concerned had called
a day by that time. Gate pass could not be signed. The officer was approached
for signing it, he gets rebuke and the goods do not reach his residence.
Next day, red-cross was marked over the attendance signed by the LDC.
He is agitated. This process goes on many days and LDC's oral agitation
is taken very seriously and he is placed under suspension. A vigilance
case is made out and fictitious charges framed. The officer responsible
for this nasty act gets promoted and becomes disciplinary authority
for the person. Enquiry is held and made against that poor fellow and
during emergency period, the poor one is served an order of dismissal
from service. He goes against it in a local Court where case drags on
for nearly 10-12 years. Fortunately, judgement comes in favour of the
poor. He gets his job back with attendant benefits/ promotions. Think
a person perpetuating injustice becomes disciplinary authority in that
very case and none notices this procedural irregularity, including the
court giving ruling in favour of the victimised.

As the case in the trial court then the information could
be disclosed
Referring to a trap case, the accused wanted the copy of the
FIR and the charge sheet filed from the CBI. The Public Information
Officer (PIO) refused to disclose information on the ground that
the CBI has been included in the second schedule to the RTI Act.
During the hearing before the Central Information Commission (CIC),
the respondent submitted that the prosecution in the case is pending
before the trial court and the same cannot be provided without
seeking the prior permission of the court. The CIC ruled that
the PIO cannot be directed to disclose any information in a case
of complaint under section 18 of the RTI Act.
Comments
In Chief Information Commissioner & another v. State of Manipur
& another in Civil Appeal Nos.10787-10788 of 2011, the Supreme
Court had held that Sections 18 and 19 of the RTI Act serve two
different purposes and lay down two different procedures and they
provide two different remedies. One cannot be a substitute for
the other. Under Section 18 of the RTI Act, the Information Commission
has no powers to direct the public authority to furnish the information
and such a power has already been conferred under Section 19(8)
of the Act on the basis of an exercise under Section 19 only.
