Durga Shakti-Real story
Because of smoke screen created by vested interests the real story
of suspension of Durga Nagpal the gutsy IAS SDM of Noida Sadar which
is very simple has been obfuscated. The simple story of this brave heart
is as follows. Illegal extraction of sand from the Yamuna and Hindon
riverbeds has an annual turnover of 300 - 400 crores according to some
reports. The illegal extraction is monopolised by gangs close to local
ruling party politicians who in all probability get their share of the
loot in lieu of their patronage because of which the concerned government
machinery gets signals not to proceed against the wrong doers. Durga
Nagpal's crackdown on the illegal extraction has thus hit the financial
interests of the gangs as well as their patrons because of which getting
rid of this thorn in the flesh became an operational imperative. To
give the devil its due, even criminals and their patrons have some sense
of shame because of which they simply can't proclaim that because of
this 'inexperienced' lady's intransigence they may soon be starving
unless the lady is thrown out in a manner that could serve as an effective
forewarning to her successors as well. Hence the suspension instead
of mere transfer along with a respectable alibi for the suspension.
As part of the strategy for a respectable alibi the local MLA gave fifty
thousand rupees to the local congregation 'so that they could extend
the area for Namaz & Taraabi' by constructing a wall and occupy
the adjoining public land. Simultaneously a complaint was sent (presumably
by the MLA's own team) to the DC about the wall coming up in violation
of Supreme Court's directive. As could be reasonably anticipated the
DC detailed his SDM for doing the needful. Soon after the wall was pulled
down a local source called up the MLA in Lucknow and informed 'deewar
girgayi hai' and the MLA as per his own bragging got the suspension
order issued in 41 minutes flat. The politicians are so sure of their
smartly worked out strategy that they want us all to believe that 'sand
mining has nothing to do with the suspension which was ordered to avert
the possibility of serious communal riots all over the country because
of demolition of the mosque wall during the holy month of Ramzan by
Durga Shakti.' It is up to each one of us now to go by the real story
or by the smoke screen. I for one would definitely reject the smoke
screen with the contempt it deserves.

Azam Khan's demand is ridiculous
1. The District Magistrate has not done any wrong. In the era of RTI
Act-2005, the wordings of Azam Khan that 'action of the DM to make the
inquiry report public demands that the DM should also be suspended'
is ridiculous.
2. The paragraph No.116 of the Central Secretariat Manual of Office
Procedure states as under:-
"116: Communication of official information-Every Government Servant
shall, in performance of his duties in good faith, communicate to a
'member of public or any organization full and accurate information,
which can be disclosed under the Right to Information Act, 2005. (Nothing
stated above shall be construed as permitting communication of classified
information in an unauthorized manner or for improper gains to a Government
Servant or others)"
3. The rule 11 of the Central Civil Services Conduct Rules states as
under:-
"Every Government servant shall, in performance of his duties in
good faith, communicate information to a person in accordance with the
Right to Information Act, 2005 (22 of 2005) and the rules made there
under :
Provided that no Government servant shall, except in accordance with
any general or special order of the Government or in performance in
good faith of the duties assigned to him, communicate, directly or indirectly,
any official document or any part thereof or classified information
to any Government servant or any other person to whom he is not authorised
to communicate such document or classified information." Azam Khan
please note that India does not belong to Taliban. In the era of accountability
and transparency you should not try to impose your will. I have already
sent an RTI application to the UP Agro Corporation inviting information
about the entitlement of salary, perks & facilities for which the
Chairman-UP Agro Corporation is entitled for and facilities being taken
by Narinder Bhatti against those entitlement. I have also asked for
details of the names of the parties to whom the UP Agro Corporation
have given orders during the last one year or so. I also propose to
send to the IT Department an application about the Income Tax amount
deposited by Shri Bhati during the last five years.

Ms Durga's is not an isolated case
Suspension of IAS officer Ms Durga by politicians is not an isolated
case. Another IAS officer Harish Chandra is also placed under suspension
by Uttarakhand Government and suspension has not been revoked inspite
of CAT Allahabad's order.

GoI should bring in suitable rule amendments to avoid harassment
of officers
While there has been a justifiable furore over the suspension of Durga
Shakti, SDM by the Government of Uttar Pradesh, the case of denial of
pensionary benefits to a honest senior IAS officer of the 1983 batch,
K. Ashok Vardhan Shetty of Tamil Nadu seems to be equally bad if not
worse. Despite DoPT,Government of India, ruling that Government of Tamil
Nadu's rejection of the notice of voluntary retirement by the Government
of Tamil Nadu (in December 2011) was wrong and without jurisdiction
as early as January 2012, and despite C.A.T, Chennai and the High Court
of Madras ruling in the officer's favour, Government of Tamil Nadu filed
a SLP in the Supreme Court just to prolong the litigation so as to deny
him his retirement benefits as long as possible. While the Supreme Court
also ruled in Shetty's favour on July 30, 2013, the officer was left
without pension for 20 long months and had to fight the legal cases
at his own expense. If such a thing can happen to an officer of Shetty's
integrity and track record, IAS officers of Tamil Nadu say, then nobody
is safe. While the media is fixated only on frequent transfers and the
occasional suspension of IAS officers, other forms of victimisation
include: keeping an officer on compulsory wait for months together;
posting him in newly created non-cadre posts with zero or low functional
responsibilities; posting them out of State Headquarters in the later
stages of their careers which seriously dislocates the family; foisting
false vigilance cases on honest officers; etc. Government of India needs
to bring in suitable rule amendments to address all such issues. It
is not doing so either of lethargy/ inefficiency or because Congress
Party is in power in several States and doesn't want to handicap itself.
The Civil Society should launch a movement towards this end. There is
no point in carping about the deterioration in the bureaucracy if nothing
is done to protect honest officers from being victimised.

Why don't bureaucrats join hands to fight out politico-mafia nexus
?
When Politicians and mafias can join hands to scuttle any investigation
against their wrong doings, why can't IAS and IPS and PCS officers join
hands together to fight against them. If they do it, will send a clear
signal that bureaucrats cannot be ill-treated /harassed at the whims
of Politicians.

Dangerous trend
As per some reports, a very dangerous trend has started that leaders
have started criticizing constitutional bodies/institutions to suppress
or hide their failures. It is said that these bodies are much more responsible
and discharging their duties faithfully. Because they are bound by code
books hence cannot speak in public. Statements are made that economy
is in good condition. Slowdown is global phenomenon. As a normal lay
man, it is seen that prices are rising on some items daily basis, export
is declining, import is increasing, current account deficit is increasing,
inflation is increasing, GDP growth is down, growth is slow, industrial
production is down then what is right? How economy of country can be
right or good when nothing is in favour of growth. For example, India
is not able to manufacture main telecom equipment and in result a very
large amount has been spent in import of telecom equipment. It is estimated
that after oil, electronic items will be second in imports. What we
are exporting except software it is hardly any substantial percentage
of imports. Unless we produce goods for consumption as well as for exports,
the situation will remain the same. Laptops, tablets are being distributed
but there is no power in rural areas and cannot be charged or used due
to lack of internet connectivity. Create the jobs in the country so
after employment they can buy these items and lead respectable life.
How many jobs have been created in last three years? There is lack of
infrastructure in the country. Power is main source for growth but huge
power shortage is being felt in the country. Without power how the country
will move forward? We are unable to harmonize inflation, interest rates
and growth. All three parameters are going in their own ways. No one
is able to control or manage these three parameters. Fourth and fifth
parameters have also come in picture i.e. current account deficit and
foreign exchange rate. It is complex to understand how to tackle the
situation unless all the stakeholders work in harmony and find amicable
solution. The situation may become more worse when subsidies starts
rolling.

Referring to a trap case, the accused wanted the copy of the
FIR and the charge sheet filed from the CBI. The Public Information
Officer (PIO) refused to disclose information on the ground that
the CBI has been included in the second schedule to the RTI Act.
During the hearing before the Central Information Commission (CIC),
the respondent submitted that the prosecution in the case is pending
before the trial court and the same cannot be provided without
seeking the prior permission of the court. The CIC ruled that
the PIO cannot be directed to disclose any information in a case
of complaint under section 18 of the RTI Act.
Comments
In Chief Information Commissioner & another v. State of Manipur
& another in Civil Appeal Nos.10787-10788 of 2011, the Supreme
Court had held that Sections 18 and 19 of the RTI Act serve two
different purposes and lay down two different procedures and they
provide two different remedies. One cannot be a substitute for
the other. Under Section 18 of the RTI Act, the Information Commission
has no powers to direct the public authority to furnish the information
and such a power has already been conferred under Section 19(8)
of the Act on the basis of an exercise under Section 19 only.
