If BJP comes into power in 2014 general elections Joshi would continue with his second highest rank in RSS.


Suresh Soni

The native of Chhattisgarh holds the post of Joint General Secretary (Sahasarakaryavah) of RSS. He has been the first choice of RSS leadership to act as the Sangh's liaison person for the BJP.

Rahul planning 'big' surprises

Rahul Gandhi is understood to be planning some big surprises for the Lok Sabha elections which includes forming a Rahul brigade at the Centre and a few from the group might get ticket to contest in the Lok Sabha elections. An exercise to find out the most talented young leaders has already been started. His idea is to introduce fresh faces in the ensuing Lok Sabha elections at least in a few seats.

Waste of time in CGHS

Senior citizens are facing lot of difficulty in obtaining medicines from Welfare Centres. After the medicines are prescribed by a Doctor of the recognised hospital, the pensioner has to go to a Govt. Hospital and have the same prescribed by him and then get the same indented or issued by the CMO of the Welfare Centre. To avoid this, the CMO may be authorised to issue the medicines.

CBDT has failed in increasing the number of tax payers significantly whose taxable income is more than 1 crore. This number was 42800 during last budget speech. The exact figure will only be known again during budget presentation. There is wastage of time, energy and man power who are busy in chasing tax payers having income less than 10 lakhs. Income tax are issuing notices even to those whose income is less than 2 lakhs and peon and vendors have got notices. What is the use of sending notices who buy MF more than 2 lakhs, investing in company with more than 1 lakh etc. CBDT is not able to see how big whole in tax collection thru stock options is being created. Neither there is TDS while giving to employees nor they pay tax on income from stock options. See the case of ex. iGate CEO whose shares getting thru option is worth Rs. 17 Million without any tax liability to the company or himself. Most of IT companies giving benefits to employees thru stock options without any TDS or tax liability.

Disillusionment of Central govt. employees

Disillusionment of the Central govt. employees from the present system has been amply visible in the 4 States. CSS & CSSS who has been the backbone of the central Government are being made to stagnate in a post for 20-25 years and AIS services are getting time bound promotions and the same officers are guiding the present government on not providing cadre restructuring/ time bound promotions to CSS & CSSS. Present Government had to pay the price for the follies of their officers. In both cadres posts are vacant but JS/Secy is not in mood to relent or relax and misguiding the Minister. MOS(PP) is requested to call representatives of these services otherwise Present establishment is losing the credibility due to follies of their officers who shift to greener pastures. May good sense prevail for providing legitimate due to employees even at this stage.

UPA govt should not think about increasing retirement age

UPA government should not even think about increasing the retirement age from 60 to 62. In terms of vote also it will not help them at all. Increasing retirement age will prevent the young minds to become part of the work force in Govt. and PSU. Hence, UPA govt. will lose on the vote of younger generation. If still they decide about increasing the retirement age, it would be another perilous decision taken by UPA government.

DATE WITH RTI

Who is the holder of information?

Copy of report submitted by Dr. Gulshan Rai to CVO, Shipping Corporation of India (SCI) and copy of reply given by ED (IT) was sought. The Public Information Officer (PIO) replied that the information has been forwarded by the Central Vigilance Commission (CVC) to the CVO; therefore the CVC has been requested to provide a "no objection" for sharing the information. The first appellate authority (FAA) noted that no reply was received from CVC and directed the PIO to provide the information sought to the appellant within (10) days after payment of requisite fees. Subsequently, the PIO informed the appellant that a reply has now been received from CVC which states that the matter has not yet been finalized, therefore, the copy of report was denied under section 8(1)(h) of the RTI Act. The Central Information Commission (CIC) observed that there has been a considerable delay by CVC in replying to notice issued by PIO under section (11) of the RTI Act and preferred to hear PIO (CVC) before passing an order in this regard. The PIO (CVC) informed the CIC that the matter related to said report has not yet attained the finality and it is still under enquiry/investigation at the level of the CVC. He requested not to allow the disclosure of information to the Appellant at this stage as it would impede the process of enquiry/investigation being conducted by the CVC at present. The Appellant argued that the information sought by him has already been allowed to be disclosed by the FAA and therefore, the same cannot be denied to him. The CIC held that the PIO (SCI) should have transferred the RTI application to the PIO (CVC) u/s 6(3) of the RTI Act instead of making reference u/s 11(1) of the RTI. Further, the PIO (CVC) should have also responded to the notice issued u/s 11(1) of the RTI Act to him by the PIO (SCI) within the stipulated time period. The CIC ruled that the disclosure of the information sought by the Appellant to him cannot be permitted at this stage u/s 8(1)(h) of the RTI Act.

Comments

There is considerable confusion whether the application should be transferred to another public authority or a third party notice should be issued under section 11 in cases of inter departmental correspondence. It would be proper to hold the originating source as the one who is holding the information and take a decision.
