Supreme Court Judge Justice GS Singhvi retires
Supreme Court Judge Justice GS Singhvi has retired on Wednesday after delivering his last judgement upholding gay sex as a criminal offence. The 65-year-old Judge who kept government on tenterhooks on public issues had hit the spotlight on several occasions. Two days ago, he gave a body blow to politicians and bureaucrats with a path-breaking judgement against misuse of red beacon lights on vehicles used by them, saying it was reflective of the "Raj mentality". During a little over six-year tenure, he heard a number of sensitive cases and pronounced other landmark verdicts including scrapping of 2G spectrum licenses.

CGHS pensioners to run from pillar to post

I am a regular visitor of your valuable site and shall appreciate if the following is brought out:-


"It is pity that many diagnostic tests especially Vitamin D Deficiency Study which is a very common test prescribed by Consulting Orthopaedicians to Senior citizens suffering from bone-related problems, CGHS pensioners have to run from pillar to post to get the test done on credit basis. First one has to approach the approved Diagnostic Centre for an estimate, then the pensioner has to approach concerned CMO for appropriate prior approval. CMO in turn has no powers to issue the prior approval. The incharge is required to forward the request of pensioner to the CGHS Zonal Office. The Zonal Office then processes the request and issue the sanction which takes few days may be due to administrative problems (shortage of staff etc.) and by the time permission comes to pensioner through Dispensary or by his/her personal visit, the requisite time bar of 15 days lapses. The procedure needs to be simplified so that all diagnostic tests are done without prior approval at the approved diagnostic centre.

This issue was raised by me six months back also but there is no improvement. In fact it is more complicated as earlier CMO used to issue the prior approval, now it goes to Zonal Office.

I hope that CGHS authorities will take view of my point and improve the system as it is very difficult if not impossible to approach CGHS authorities/MOHFW individually."

Senior citizens don't get healthcare from CGHS

CGHS always make it impossible for senior citizens who retired from government to enjoy healthcare at their sunset years by making more procedures for availing the facilities. All CGHS life time healthcare card holders issued on the eve of retirement to avail of all healthcare facilities from private hospitals on production of the card without going through the so called wellness centers which makes only people more sick and tired of all the CGHS services.

There is a need for decentralization and delegation of powers in CGHS hierarchy. In case, it is not possible to post specialists in CGHS wellness centres due to overall shortage, why not empower the CMOs and reduce strain on pensioners and pressures on overcrowded government hospitals. Will the health ministry take the call ?

Wastage of time in CGHS

Senior citizens are facing lot of difficulty in obtaining medicines from Welfare Centers. After the medicines prescribed by the doctors of recognised hospitals, to which they go as the doctor was earlier in a Govt. Hospital and he was continuously getting medical help from him. After the medicines are prescribed by a Doctor of the recognised hospital, the pensioner has to go to a Govt. Hospital and have the same prescribed by him and then get the same indented or issued by the CMO of the Welfare Centre. To avoid this, the CMO may be authorized to issue the medicines. May kindly be considered.

Many Khemkas, Many Vadras

This has reference to the submissions in WIC on 10.12.2013 under the caption "Many Khemkas, Many Vadras". I do agree that once we start focusing on 'Failure Stories' rather than on 'Success Stories' we can find a solution to the existing problems. For example, we are so enamored by the 'Success Stories' of RTI System that we are unable to notice that the system is already half dead. If an authority is adamant on depriving you with some information, there is no way to get it before two years. In case of Corruption Cases, such delay defeats the basic purpose of RTI. Similarly, the system of Whistle Blower has no real protection for the Whistle Blower. Our system, by nature, is still feudal and therefore any complaint against a senior by a junior is taken as a challenge to the authority and therefore the corruption issue becomes secondary. A Whistle Blower is neither taken into confidence nor does he get a copy of the investigation report or closure report. This opens doors for cover-up. If CVC wants to be effective, it should do sample checks on cases referred to CVO under Vigilance Audit. Secondly, it should be mandatory for every CVO to provide a copy of the investigation report to the complainant for his rejoinder, if any, before taking a final decision in the case. Let CVC start the above exercises with the Whistle Blower Complaint of the Ministry of Statistics and Programme Implementation.

Think about increasing retirement age

Congress Government should think seriously about increasing the retirement age. They should not get misdirected about the vote bank of youth, as the present youth will not switch over the side from AAP or others to Congress in a very short time of 4-5 months left for election. In no way they get the confidence of the present Government led by Congress, instead Congress will hate to lose the confidence of the cg employees who are vehemently supporting the Congress for a long time. Congress Government should chose either to lose the vote bank of Government employees by not increasing the retirement which they deserve as the life expectancy of the Indians has increased and for productive old age of India.

Who is the holder of information?

Copy of report submitted by Dr. Gulshan Rai to CVO, Shipping Corporation of India (SCI) and copy of reply given by ED (IT) was sought. The Public Information Officer (PIO) replied that the information has been forwarded by the Central Vigilance Commission (CVC) to the CVO; therefore the CVC has been requested to provide a "no objection" for sharing the information. The first appellate authority (FAA) noted that no reply was received from CVC and directed the PIO to provide the information sought to the appellant within (10) days after payment of requisite fees. Subsequently, the PIO informed the appellant that a reply has now been received from CVC which states that the matter has not yet been finalized, therefore, the copy of report was denied under section 8(1)(h) of the RTI Act. The Central Information Commission (CIC) observed that there has been a considerable delay by CVC in replying to notice issued by PIO under section (11) of the RTI Act and preferred to hear PIO (CVC) before passing an order in this regard. The PIO (CVC) informed the CIC that the matter related to said report has not yet attained the finality and it is still under enquiry/investigation at the level of the CVC. He requested not to allow the disclosure of information to the Appellant at this stage as it would impede the process of enquiry/investigation being conducted by the CVC at present. The Appellant argued that the information sought by him has already been allowed to be disclosed by the FAA and therefore, the same cannot be denied to him. The CIC held that the PIO (SCI) should have transferred the RTI application to the PIO (CVC) u/s 6(3) of the RTI Act instead of making reference u/s 11(1) of the RTI. Further, the PIO (CVC) should have also responded to the notice issued u/s 11(1) of the RTI Act to him by the PIO (SCI) within the stipulated time period. The CIC ruled that the disclosure of the information sought by the Appellant to him cannot be permitted at this stage u/s 8(1)(h) of the RTI Act.

Comments

There is considerable confusion whether the application should be transferred to another public authority or a third party notice should be issued under section 11 in cases of inter departmental correspondence. It would be proper to hold the originating source as the one who is holding the information and take a decision.
