India in Global Talent Trade

One way to prevent exodus of talent is to recruit directly (only 5 toppers in the batch), those who pass out from IITs, IIMs and NIT etc, without any examination, interview etc. If higher pay cannot be given, atleast do away with the exams and interviews for top class appointments in the Government for them and give free hand to them. It will make a sea change in governance and achieving the dream of India to become super power by 2020.

DDA's unwelcome decision

The draconian decision of Delhi Development Authority (DDA) to increase the playing (green) fee Three to Four times at Qutab Golf Course, Lado Sarai has upset the Seniors. It will have an adverse effect on their physical, mental and financial capacities. The universal truth is ' irrationality does not bear good fruits'. It is very clear (I) either the decision to increase the green fee four folds is wrong or (2) the Fee structure going on till last week was wrong. Either way the Management must accept the responsibility. It is a Public Course funded from Public Exchequer and not a personal fiefdom.

Unnecessary provocative statement. Exaggerated news. It is not news at all. As per rule any employee whose Date of Birth falls on first of any month, he would retire in the previous month.

Irrational interpretation behind date of retirement

Secretary, Civil Aviation,Srivastava would have superannuated a month later; misses by a single day. Actually those born on Jan 1 complete their age on the date of their birth ie Jan 1, and not on the previous day, which is an irrational and artificial interpretation put forth by the Accountant General officials without any convincing basis. Our well-established traditional belief is that a person completes the age on the date of birth and not on the previous date as peculiarly interpreted by the Accountant General officials in their warped way of negative thinking so as to deprive some officials of the benefit of a month's service when the government magnanimously took a rational decision to give the benefits of service till the end of each month for every official whose date of birth falls on any date during that month from 1 to 31.The AG officials needlessly interpret completing the age of superannuation as on the previous date and therefore retiring on the "Afternoon of December 31" which is just a theory put out by them in their own totally negative way of thinking of how to deprive one of a benefit and not give a rational and correct interpretation. What is wrong if a rational interpretation is given that a person born on Jan
1, 1954 attains 60 years on Jan 1,2014 and hence retires on that date. For the purpose of qualifying date for attaining minimum age for applying for recruitment also, the same date of birth can be taken as the crucial date for reckoning the minimum and maximum age. For example, if the minimum age is given as 21 with the reference date indicated as on January 1,a person born on Jan 1,1993 will complete 21 years on Jan 1,2014 and will be eligible to apply, whereas a person born on Jan 2,1993 will not complete 21 years on Jan 1 and hence will be ineligible and can wait till next year. Government of India should now overrule the negative interpretation of the Accounts and adopt the above correct interpretation in working out age for service matters. Can we hope for decisive action on this at the highest levels in the executive and the judiciary.

Lesson for Cong: Raise retirement age

The Indian National Congress party lost Delhi Legislative Assembly election, in 2013 , by huge numbers and trailing to third spot behind BJP and AAP. The Congress party should have raised the retirement age of central government employees and officers from 60 years to 62 years which could have made mass scale of central government employees to vote for the Congress. I think the Congress should atleast learn now and increase the age of central government employees from 60 to 62 in the wake of the upcoming 2014 general election.

Who is the holder of information?

Copy of report submitted by Dr. Gulshan Rai to CVO, Shipping Corporation of India (SCI) and copy of reply given by ED (IT) was sought. The Public Information Officer (PIO) replied that the information has been forwarded by the Central Vigilance Commission (CVC) to the CVO; therefore the CVC has been requested to provide a "no objection" for sharing the information. The first appellate authority (FAA) noted that no reply was received from CVC and directed the PIO to provide the information sought to the appellant within (10) days after payment of requisite fees. Subsequently, the PIO informed the appellant that a reply has now been received from CVC which states that the matter has not yet been finalized, therefore, the copy of report was denied under section 8(1)(h) of the RTI Act. The Central Information Commission (CIC) observed that there has been a considerable delay by CVC in replying to notice issued by PIO under section (11) of the RTI Act and preferred to hear PIO (CVC) before passing an order in this regard. The PIO (CVC) informed the CIC that the matter related to said report has not yet attained the finality and it is still under enquiry/investigation at the level of the CVC. He requested not to allow the disclosure of information to the Appellant at this stage as it would impede the process of enquiry/investigation being conducted by the CVC at present. The Appellant argued that the information sought by him has already been allowed to be disclosed by the FAA and therefore, the same cannot be denied to him. The CIC held that the PIO (SCI) should have transferred the RTI application to the PIO (CVC) u/s 6(3) of the RTI Act instead of making reference u/s 11(1) of the RTI. Further, the PIO (CVC) should have also responded to the notice issued u/s 11(1) of the RTI Act to him by the PIO (SCI) within the stipulated time period. The CIC ruled that the disclosure of the information sought by the Appellant to him cannot be permitted at this stage u/s 8(1)(h) of the RTI Act.

Comments

There is considerable confusion whether the application should be transferred to another public authority or a third party notice should be issued under section 11 in cases of inter departmental correspondence. It would be proper to hold the originating source as the one who is holding the information and take a decision.
