Defence Minister hands-over HAL-DO-228 Aircraft
to Seychelles (UPDATED)
Defence Minister A K Antony has handed over HAL's DO-228 to the Minister
of Foreign Affairs of Seychelles, Jean-Paul Adam, at a function in New
Delhi on January 31, 2013. The maritime surveillance aircraft will be
used to guard the extensive coast line of island nation. "It is
yet another milestone of our close friendship between our two countries",
said Antony. He congratulated HAL for delivering the aircraft much ahead
of schedule. The Seychelles Foreign Minister appreciated the gesture
and said the DO 228 will enable his country to fight piracy and strengthen
the overall security in the Indian Ocean."The aircraft to be provided
to Seychelles will be supported by HAL team for maintenance on site
to enable the new user get the requisite expertise", said Dr R
K Tyagi, Chairman, HAL. The aircraft is equipped with the latest state-of-the-art
facilities and is excellent platform of maritime applications, he added.
Waven Williams, High Commissioner for Seychelles to India, Major Micheal
Pouponneau, Commanding Officer, Seychelles Air Force, Chief of Naval
Staff, Admiral D K Joshi, R K Mathur, Secretary Defence Production,
Sanjay Singh, Secretary (East), Ministry of External Affairs were among
the invitees on the occasion. Fuelled by the growth prospects of this
aircraft, HAL has also set eyes on export market. While the full aircraft
structures are already being exported to Germany for assembly and supply
to world-wide market, efforts are underway to achieve direct exports.
The company is making efforts to exploit conducive military markets
in Mauritius, Nepal, Vietnam, South Africa, Afghanistan and Columbia.
Efforts are also to penetrate civil export markets that are suited for
HAL-DO-228s. HAL manufactures this aircraft under licence agreement
with the erstwhile Dornier GmbH of Germany at its Transport Aircraft
Division, Kanpur, and has world-wide unfettered sales and marketing
rights. Along with the airframe, engines and several of the systems
and avionics are also produced in house at various Divisions of HAL
ensuring single window life-time support to the customers. The cockpit
is designed to accommodate two crew members and is fitted with duplicate
controls. The cabin can accommodate 19 passengers in commuter configuration.

Bureaucracy steadily losing power
From a power dynamics point of view, the one constant through recent
Indian history has been that the bureaucracy has been steadily losing
power and the lawyers steadily gaining it. Post independence, the All
India Services barely survived, largely through the intervention of
Patel (that they managed to get an article inserted in the Constitution
in this regard is testimony to their skills). Thereafter though, the
Services grew in importance and the judiciary was behind. This was quite
the same as during pre-independence days, when those members of the
ICS who were not taken into the Executive branch were relegated to the
Judicial branch (the ICS manned the positions of District Judges as
well as Collectors, the branches being Judicial and Executive respectively).However,
post 1973, the amendment in the CrPC to effect separation of Executive
and Judiciary saw a weakening in the position of the Services. In the
'90s, the judiciary started gaining an upper hand. This was possible
largely because some high ranking members of the political executive
were proceeded against in Courts of law and the creative interpretation
of the role of the judiciary by the judiciary itself which reduced its
accountability but enhanced its powers and stature. In the result, today,
the lawyers have become powerful as never before (except during the
freedom struggle and at independence, when top political executive posts
became the almost exclusive preserve of the lawyers) and so have the
Courts. This situation is a happy one for democracy since the Courts
are by nature, insulated from and independent of political pressures.
However, to ensure that the promise these developments have shown is
not lost due to systemic flaws, perhaps a few corrections could be contemplated.
First the issue of accountability for all levels of the judiciary and
mechanism to ensure the same has to be addressed. Second, the delays
in dispensing justice could cripple the legal system and belief in Rule
of Law could be a casualty if not addressed adequately and soon. Thirdly,
the separation of powers defined by the Constitution has to be respected
if all institutions are to be allowed to flower adequately as per the
Constitutional scheme. After all, if the founding fathers of the Republic
had felt otherwise, they would have created only the Courts in the Constitution
and left everything to them. Even otherwise, one creature of the Constitution
cannot be taken to be superior to any other such creature, by dktat
of the first creature, even though interpretation of the Constitution
is the role of the said first creature. The intended balance of the
Constitution has to be maintained if the promise held out by the blossoming
of the Courts is to be fulfilled and India achieve its destiny. The
Constitution was drafted to eliminate the concentration of power and
that must be the aim of all sections of the Indian democratic polity.

CBDT be more friendly
Let Income Tax department be more friendly with tax payers and resolve
the problems through mail or communications. IRS is one of the prestigious
service and talent could be used for increasing tax nets not for small
matters like finding faults with ITRs and issuing notices. There should
not be any check for small tax payers and sr. citizens fulfilling both
conditions and returns can easily be accepted but problem rises as soon
as there is mismatch in 26AS and return filed. Mismatch may be due to
deductors faults or bank faults. These need to be resolved amicably
by IT department. There may be good solutions to the problems.

DoPT moving against 'Rule of law'
The Department of Personnel and Training (DoPT) is purporting something
which is against the 'Rule of law' and 'illegal'. Since, July 27, 2012
they have been promoting Under Secretaries of CSS to the level of Deputy
Secretary based on the Senior list of Section Officers brought out in
the year 1997. As a result of which a number of Direct Recruit Section
Officers, whose name figured in the Select List of Under Secretaries
of the year 2004 and 2005 were promoted over and above the promotee
Under Secretaries of the Select List of the year 2003. In order to please
SC/ST category people they have now relied on the Select List of USs
of the year 2003 and promoted them as Deputy Secretaries. This is gross
injustice. DOP&T is going to pay for this. DoPT as an ideal employer
in the country should set just examples and not frustrate people.

I did not find the reason, whenever sometimes/ once upon a time an
incident took place (for example, fire take place, election duty, one
major crime in so many years, terror attack, etc.), there is only one
voice from the corridors of Fire Brigade, Police, Judiciary, Election
commissioner office, etc. that they are short of staff. Whether shortage
of staff has became a legend or it is a reality. For Police department
there is one Judgment on Police Reform which was delivered by the Supreme
Court in the year 2006, which is till date not implemented. I think
if the Police reform judgment is executed, this will bring all Indian
Police in better way/ comparison to all the countries Police. "
