TN cadre IAS officer of 1983 batch wins battle
in apex court (UPDATED)
Justice has been done in the case of IAS officer of 1983 batch, K Ashok
Vardhan Shetty with the Supreme Court giving the judgment in his favour
and dismissing the appeal of Tamil Nadu Government, which denied voluntary
retirement from service (VRS). Shetty alleges that a senior IAS officer
had suppressed facts from the Chief Minister, Tamil Nadu while rejecting
Shetty's VRS and then going on appeal after appeal when the Government's
stand was patently wrong. The State Government had filed an appeal with
Supreme Court after Madras High Court rejected disallowing Shetty's
VRS. He has neither been getting his salary nor pension since December
2011 due to the mischief of this one senior IAS officer. It is another
matter that the misdeeds of this senior IAS officer got exposed by CM
herself and he was summarily dismissed by her.

First quarter review of monetary and credit
policy (UPDATED)
The First Quarter review has buttressed exchange rate as a deterministic
variable influencing the stance of monetary policy. The policy acknowledges
Rupee depreciation to pose systemic risks to macro economic stability
and policy formulation. Though Wholesale Price Index (WPI) inflation
is on a downward trajectory and is largely within the comfort zone,
there are upside risks. Moreover, retail inflation is potentially close
to entering the double digit territory. While asserting the inevitability
of structural reforms, the policy rightly identifies Current Account
Deficit a challenge to grapple with. A reform momentum has started but
the key is to sustain the same not only in form but also in substance.
Limits to growth has also been acknowledged and GDP growth forecast
for FY 14 has been cut to 5.5% from 5.7% earlier. The status quo in
policy was widely anticipated and has to be seen in tune with the recent
measures announced over the past fortnight. The forward guidance from
the policy that the recent liquidity tightening measures are aimed at
checking undue volatility in the foreign exchange market and will be
rolled back in a calibrated manner augurs well for stability in the
financial market. RBI has also asserted that it is ready to use all
tools at its disposal for quick response to adverse events.

CGHS reimbursement!
I am in agreement with the cited views about CGHS re-imbursement. Last
year I submitted MRC for some 1500 rupees for having undergone some
diagnostic tests at a CGHS empanelled Centre in Chennai which charged
me as per the CGHS-approved rates. Still when the MRC was submitted
the CGHS Delhi deducted some 300 rupees from the claim and the rest
was sanctioned. As you know, there is no cashless system prevailing
in CGHS Chennai in spite of clear-cut instructions from the CGHS for
providing cashless facilities in all CGHS-approved treatment and diagnostic
tests centres. So there is nothing surprising in emergency cases too.

Headstrong and unjust!
Repeated instances of harassment of officers by the official occupying
the top post in a small southern state presently are coming out. First
he blocked the engagement of a secretary-level officer as election observer
as required by Nirvachan Sadan on the ostensible ground that his services
cannot be spared, while the irony is that he is posted as secretary
for ex-servicemen welfare which has no work! Again the chief bureaucrat
obstructed the central deputation of the officer now working as secretary
to chief minister citing the untenable ground that he has not completed
the three-year cooling off, whereas the prescribed cooling off period
is only one year ! The Chief Minister overruled the chief bureaucrat
and ticked him off for his unjust stance.WIC should not protect this
chief babu by suppressing such news exposing his bullying methods.

Wake Up Call for Delhites:
Many of the existing political luminaries has started efforts to ensure
that their son(s)/spouse(s) get tickets for ensuing elections along
with them or in their places. This trend needs to be reversed to usher
in good change which the politics honestly needs. New face will have
new enthusiasm and a zeal to achieve and to do quality work. New faces
should therefore be tried by the voters.

Prime Minister of India ?
Your article on Prime Ministerial candidate from 1990-2005 is disinteresting
and biased. During the period referred by you, there had been news on
Mayawati, Meira Kumar, Mulayam, Lalu and other Dalit leaders projecting
them as Prime Ministerial candidates. Seems, it is kind of customary
of media houses to avoid Dalit leaders on crucial juncture. Mayawati
was inches close to become Prime Minister during nuclear deal crisis
when the government was in crisis, but, according to media reports,
suddenly BJP particularly Advani backtracked and stood by Congress (ref.
statements of Mayawati... 'Advaniji ek dalit ki beti ko pradhan mantri
nahin dekh sakte hain'). If dailies are to be believed, the BJSP and
BSP had some understanding. Whispers is unfair in excluding the Dalit
Prime Ministerial candidates which remained in news during 1990-2005.
We have been watching games of predictions of Media for the last three
decades. Media's elections results predictions are generally wrong,
the main reason being most of them are dedicated to certain political
parties' ideologies rather than being dedicated to the will of people.
So, the new Prime Minister might be, in all probability, someone not
in your shown list.

Upright officer in UP suspended on false excuses
The reasons doled out for suspension of a lady IAS officer of UP cadre
of 2009 batch appear to be just excuses to justify her suspension. The
fact of the matter is, as gleaned from the newspaper reports, that she
was doing her work sincerely and enthusiastically. It seems that while
doing so she rubbed some powerful people on the wrong side. In these
days of mafia raj it is not easy to take on one mafia or the other (in
this case it was the sand mafia).If as claimed by the state Government
she was suspended because she demolished the wall of a mosque illegally
under construction in a village near Greater Noida, she should be given
credit for that. As it is, we close our eyes to illegal graves, temples,
mosques which overnight come up on our pavements, parks and roads. Once
these are there, we do not remove these encroachments for fear of communal
flare-up. It is a pity that an officer is punished for doing the right
thing. Durga Shakti (she personifies her name) is young and I only that
hope she does not get disillusioned by her suspension and mould herself
into run of the mill bureaucrat who blows with the wind and does not
do his/her job out of fear. We do need many Khemkas and Durga Shaktis
to stop the criminal wrong-doing all around us.

I had suspected Durga's suspension the day I read about her brave exploits
in a national daily. Since agitated consciences of public servants have
been regularly giving vent to their hurt feelings on the WIC, I am reacting.
The Administrative Culture of India stands compromised-make no mistakes.
So while josh(enthusiasm) is fine in the first few years in young green
horns without earlier family tradition of government service, don't
ignore hosh(awareness of the climate), before deciding on the path one
chooses to tread. Every government servant is mandated to maintain "absolute
integrity and devotion to duty all the time". fine. But it is as
fine as several other such sweet expressions. First check if the government
really wants one to do what is considered to be the "duty",
for duty for one may be threat to the kursi (power peg0 for the other.
One might think that a police inspector gets appointed to catch the
thief, but wait for a nano second and think if that really means thief
or someone to be painted as the thief. Durga went after the sand mafia
in NOIDA (at least that is the depiction by the press I recall). She
forgot how kindly another IPS officer was treated in another state for
same kind of a bravado or what kind of treatment awaits those helping/serving
the people, the much hyped aam aadmi, in disaster affected locations.
The system has already made the best public servants khamosh (silent)
already. While there is no sign of any improvement in the next few decades,
there will always be public servants on the side of the Durgas of the
public service. They are reducing in numbers by the day, but nothing
to worry as there always will be someone coming to lend precious support
silently, sometimes even without your knowledge. Be sensitive to those
magnetic signals and decode the message in time. However, the course
of honest public service is a dreadful one. Hence think, think again
and think once more to choose that, for there is neither any going back
during the career nor thereafter and life may be no more comfortable
than the Khemka, Chaturvedi & Co. All the best, young officers-you
serve India and "we the people". That in itself is a huge
privilege, which even MPs/MLAs/Minister crave to be. The reason for
our administrative downfall lies in the attempts of the Executive to
try & act bureaucratic!

Really unfortunate
Someone has said that the comment on Amartya Sen by Chandan Mitra is
unfortunate. I agree but a person like Amartya Sen should also avoid
commenting on politicians especially holding constitutional posts.

Undo the wrong done
Hope now the eyes of the Ministry of Railways should open on the clear
statement by Pawan Bansal that officer like Rajeev Bhargava are sidetracked
due to politics in the Railway Board to which he succumbed. Now it is
the high time when the wrong things should be undone. Do the present
minister has this courage. Yes by his clean image he and only he can.

As the case in the trial court then the information could
be disclosed
Referring to a trap case, the accused wanted the copy of the
FIR and the charge sheet filed from the CBI. The Public Information
Officer (PIO) refused to disclose information on the ground that
the CBI has been included in the second schedule to the RTI Act.
During the hearing before the Central Information Commission (CIC),
the respondent submitted that the prosecution in the case is pending
before the trial court and the same cannot be provided without
seeking the prior permission of the court. The CIC ruled that
the PIO cannot be directed to disclose any information in a case
of complaint under section 18 of the RTI Act.
Comments
In Chief Information Commissioner & another v. State of Manipur
& another in Civil Appeal Nos.10787-10788 of 2011, the Supreme
Court had held that Sections 18 and 19 of the RTI Act serve two
different purposes and lay down two different procedures and they
provide two different remedies. One cannot be a substitute for
the other. Under Section 18 of the RTI Act, the Information Commission
has no powers to direct the public authority to furnish the information
and such a power has already been conferred under Section 19(8)
of the Act on the basis of an exercise under Section 19 only.
