1. While forming the panels for DRMs, GMs, HODs and PHODs, Boards role
for review of grey line cases where an successively outstanding graded
officer is suddenly given lower grading or found unfit due to prejudice,

with ego and face saving by the Railway Board thus not entertained generally,
and denying justice.

chosen ones by Members, specially Member Mechanical in Mechanical and
lucrative Stores deptt and in RDSO where all approvals for vendors and
specifications are done.
4. Investigation and further examination of the officers whose names
are figuring in the tapes, including the beneficiary officers own conversations
with accused in jail and under scanner. Also of the
companies who have benefited in tenders.
5. It is almost established that favors were done and culprits identified.
CBI needs to strengthen its revelations to book other culprits and beneficiary
officers and companies.

"Communicate ACRs within a reasonable period"
Supreme Court (a three Judges bench) vide judgment dated April 23, 2013
in Civil Appeal No. 5892 of 2006: Sukhdev Singh Vs Union of India has
upheld the judgment of two Judges bench of Supreme Court in the matter
of "Dev Dutt Vs Union of India" that every entry in ACR- poor,
fair, average, good or very good should be communicated within a reasonable
period. The Hon'ble Supreme Court held that-"In our opinion, the
view taken in Dev Dutt that every entry in ACR of a public servant must
be communicated to him/her within a reasonable period is legally sound
and helps in achieving threefold objectives. First, the communication
of every entry in the ACR to a public servant helps him/her to work
harder and achieve more that helps him in improving his work and give
better results. Second and equally important, on being made aware of
the entry in the ACR, the public servant may feel dissatisfied with
the same. Communication of the entry enables him/her to make representation
for upgradation of the remarks entered in the ACR. Third, communication
of every entry in the ACR brings transparency in recording the remarks
relating to a public servant and the system becomes more conforming
to the principles of natural justice. We, accordingly, hold that every
entry in ACR- poor, fair, average, good or very good-must be communicated
to him/her within a reasonable period." So the reasonable period
for the purpose of communication of ACR may be three months or at the
max six months. DoPT may issue suitable guidelines to the Ministries/
Departments to promote such officers on the date when they became eligible
for promotion but could not be promoted due to non-communication of
their ACRs within a reasonable period. In the matter of Swadeshi Cotton
Mills Vs. Union of India, reported as (1981) 1 SCC 664, Justice R S
Sarkaria lucidly explained the meaning and scope of the concept of 'Natural
Justice' and concluded that..."the person affected must have reasonable
opportunity of being heard and the hearing must be a genuine hearing
and not an empty public relations exercise."

CBDT playing games with own officers
It is frustrating that CBDT is playing games with its own officers.
How does the FM expect his officers to deliver revenue targets with
the growth rate at an all time low with such a disgruntled work force
? Probably the task of making fair and transparent transfer orders should
be given to the Joint Secretary Administration rather than the Board.

Will someone in North Block listen?
In these pages everyday some person is writing about the unhappiness
in CBDT by the dictatorial, arbitrary ways of functioning of the ex-Chairperson.
The orders brought out so far have tainted the good name of the FM who
is not being given full facts and data. The entire orders brought out
should be scrapped. The morale of the entire service is very low, no
policy has been followed and sheer pick and choose has been done.

CBDT misdirection
CBDT is concentrating man power and energy in mid income group salaried
people. There is no data mining about the number of people who have
Mercedes, BMW, Audi, Porsche, Bentley and many other luxurious cars,
people buying real state more than 50 lakhs, people charging One crore
for one night show, buying jewellery more than two lakhs, stayed in
five stars hotels etc. but concentrating who have bought MF more than
2 lakhs, shares of a company more than 1 lakh. It will not serve the
basic purpose of increasing the numbers from 42,800 to 42 lakhs having
taxable income more than One crore. Think and issue direction in concentrating
energy in innovating the new methods utilizing modern technology.

A revolutionary idea
Suggestion to have creamy layer, both in reserved and unreserved categories,
for exclusion from reservation/concessions in studies, jobs or in any
other field is a revolutionary idea. It may go a long way in upliftment
of deprived in both of these categories. Debate on any subject is never

I disagree as two wrongs do not make one correct. If something is going
on wrong in USA why we should follow the same in India. We should rather
improve our system as whole so far as reservation is

Panacea for upward social mobility
Reservation is not a panacea for upward social mobility. Rather it gives
a social stigma to the beneficiary. As long as the present day reservation
policy continues, the social stigma will prevail. It cannot be washed
away by laws. That is why 60 years of reservation has not made a dent
among the majority of the depressed classes. The protagonists of the
reservation wants to continue with the policy so that a few like them
can corner all the benefits at the cost of their poor cousins. The reserved
classes should fight for financial benefits and incentives and compete
with others on equal grounds. Gayatry has proved how erroneous the present
day reservation policy is.

Poverty has no caste
It is the Dalits and OBCs who now wish to perpetuate casteism to continue
to avail of the benefits of reservation. Poverty has no caste and there
are poor people in every caste who deserve state support. It is the
poverty criteria rather than caste which should determine the level
of state support.

Our Upper Castes more criminal in nature
Someone on this forum has proudly drawn comparisons between Dalits and
Blacks of America in term of inequality. He is wrong in concluding that
upper castes were less cruel. White men were racist because of colour
and because blacks were of African origin. But our Upper Castes hated
their own same colour fellow Indians so they were more criminal in nature.
History is full of examples apartheid towards Blacks by Whites, and
apartheid towards Dalits by upper castes. Your quote on Blacks and Dalits
reminds me that any upper caste or white race who observed apartheid
at any point of time in history, will never enjoy
respect in history books, like any other criminal.

Promotional avenues for PAs/Stenos ?
One of the writer suggested that the posts of PS/PPS/Sr.PPS/PSO have
to be abolished. If the posts of of PS/PPS/Sr.PPS/PSO are removed from
the hierarchy what are the promotional avenues for PAs/Stenos. He also
forgets that it is the PAs/Stenos who wanted to be posted with senior
officers so that they get the prestige of working with senior officers
and get greater benefits like OTA/conveyance/ honorarium etc..

The fact is that Mrs. Ravi Kumar is the most senior officer having two
years balance service, but she is not holding GMs post. Moreover she
will supersede four senior person if so promoted. Out of these two
have more than 1 years balance and one of these is working as AM equivalent
to GMs post. Incidentally, GM post requirement is not mandatory for
FC's post.

Rajeev Bhargava is honest and one of the rarest breed of officers having
been awarded PM award for his excellence in track laying , he is the
one who has to his credit rewriting RAIL MANUAL, Further he was adjudged
as best DRM at Jhansi Division. He has to his credit almost 33 to 34
outstanding CRS which is rare in the history of Indian Railways. What
he lacks is Godfather ?
