Corrupt & feudal railways
Since Railgate, the saga of corruption is going strong in Indian Railways.
Verbal instructions to favor specific contractors and suppliers being
made by the Board to zonal railways and PU's has become a regular feature
especially in the mechanical department. With apex level officials openly
demanding favors and protocol from their subordinates, it is time that
the CVC & CBI look at transfer orders being issued in respect of
senior officers in crucial posts. Violation of the two year rule is
being done with impunity. Officers are saying that in the backdrop of
the controversial appointment of the CRB, such incidents are bound to
increase and railways will soon witness a revolt from its officers.
The Prime Minister and DOPT need to intervene.

Upbraiding the CBI publicly !
Rajiv Gandhi had announced in the same Vigyan Bhavan of Delhi that a
new Foreign Secretary will take over from tomorrow. His conduct was
considered impish by the media and people largely, just like his earlier
remark "naani yaad dila denge". The remarks of the PM, followed
by the Finance Minister (who as minister of state in Rajiv's council
of ministers had called the CBI as the Sword Arm of The Government)
in the same Vigyan Bhavan, and then in the crudest manner by the minister
of state for Personnel, to whom the CBI reports administratively, upbraiding
the CBI speaks volumes for the modus operandi of the corrupt and powerful.
This is how they show respect for the Rule of Law. They publicly ridicule,
criticize, threaten, intimidate, upbraid, downgrade and denigrate institutions
and personnel for unlawful interests. The respectable way of conveying
government orders to functionaries is written communication in the form
of an OM or Order. Why are all these people shy of issuing written orders
to the CBI and others they are afraid to take on directly, and get what
they want from them legitimately? They are afraid: afraid of the press
and media; afraid of the civil society; afraid of the Judiciary declaring
such orders ultra vires, for they are patently illegal.That brings the
value of one. One officer, doing his/her duty honestly, can drive the
corrupt/corruptible/patron saints of the corrupt mad to such an extent
that they give public performance of their phobia, nervousness and nightmare
that an honest C&AG or CVC or Secretary or CBI can cause them. If
the corrupt fear anybody on earth, it is the honest public servant,
who is prepared to die on duty rather than hundred deaths of a corrupt
officer. I am more than confident that the honest police officers and
other public servants will perform their duties now with more devotion,
dedication and honesty to serve public interest rather than political
or party interests of some who live under the illusion of their invincibility
and above the law status. Public servants commit the sin when they rig
the elections for any party or person. These threats to the CBI and
other investigating agencies are fragile attempts to make them fall
in line to ensure victory for the ruling establishment in the next general
election. If India lives, we live! Save and serve India, so that we
can live honourably!

Should the copy of the marriage certificate be provided under
RTI?
Copy of marriage certificate of a certain employee was sought
from NABARD by the appellant. The Public Information Officer (PIO)
denied the information claiming that in the nature of personal
information and is exempt under section 8(1)(j) of the RTI Act.
The appellant filed a first appeal on with the first appellate
authority (FAA) which upheld the decision of PIO. The CIC disposed
the appeal observing that the approach of the respondent is in
conformity with the RTI Act.
Comment
Under section 8(1)(j), there is no obligation to disclose personal
information the disclosure of which has no relationship to any
public activity or interest, or which would cause unwarranted
invasion of the privacy of the individual unless the PIO or the
FAA is satisfied that the larger public interest justifies the
disclosure of such information.
