Administrative lethargy of central govt. may cost Sheila Dixit dearly

Central government is, even at the time of election in the State of Delhi, still lethargic towards the lawful rights of central government employees by not implementing Supreme Court decisions and compelling government servants to go in for litigation in CAT. Most of the common issues in CAT relate to forfeiture of pension and gratuity, issue of charge sheet , bad entry in ACR etc. Thousands of government servants are in CAT in respect of such common issues. The Supreme Court has recently held on August 14, 2013 in the case of State of Jharkhand & ors Vs. Jitendra Kumar Srivastava and ANR that pension and gratuity are right to property and are therefore fundamental right and therefore the same cannot be forfeited in departmental proceedings. Hon'ble SC has observed as under "Government cannot withhold Gratuity and Pension during the pendency of the departmental proceeding or criminal proceeding: It is an accepted position that gratuity and pension are not the bounties. An employee earns these benefits by dint of his long, continuous, faithful and un-blemished service." Still so many government servants are struggling to get their pension and gratuity. Delay on the part of govt. in settling such cases is incomprehensible. Similarly, Supreme Court has clearly settled the law that ACR entry of government servant cannot be spoiled without giving reasons. DoPT instructions of G.I., D.P.& AR O.M.No.51/3/74-Estt. (A) dated 22nd May 1975 are also on this lines. Still thousands of govt. servants are struggling to get their ACR entries corrected in consonance with DoPT instructions and SC decisions.

At the mercy of concerned Ministries/Departments

In the matter of allocation of budget, especially for Office Expenses and Medical Treatment, the Attached & Subordinate Offices, Statutory Bodies and PSUs are at the mercy of their concerned Ministries/Departments. The Ministry of Finance also sees with opaque eyes. The Ministries/Departments, if they have any shortage of funds under the Office Expenses heads, they fall upon their PSUs for recuperation. There are a number of such cases and can be substantiated by the RTI information obtained. The Officials of the Ministries/Departments at times show themselves to the doctors of the PSUs at the latter cost. The increase in prices in the market has catapulted the Offices Expenses of all and there is hand to mouth situation everywhere. Money is not there to pay for the washing purposes, telephone purposes, canteen purposes. More and more government servants opting for treatment in the private CGHS empanelled hospitals and more & people falling sick, acquiring diseases on account of facing tensions of rising prices, on eating spurious products from the market & deteriorating environment conditions. There is scarcity of budget under the medical head everywhere. The hospitals are threatening the sick government employees. There is a need for the Finance Ministry to wake up and clean the slate of all in so far as the medical budget of the Government employee is concerned. Nobody on his volition likes to go to a doctor or a hospital. One can easily catch an employee who tried to pull a fast one on the Government in so far as the medical treatment is concerned.

DATE WITH RTI

Should the copy of the marriage certificate be provided under RTI?

Copy of marriage certificate of a certain employee was sought from NABARD by the appellant. The Public Information Officer (PIO) denied the information claiming that in the nature of personal information and is exempt under section 8(1)(j) of the RTI Act. The appellant filed a first appeal on with the first appellate authority (FAA) which upheld the decision of PIO. The CIC disposed the appeal observing that the approach of the respondent is in conformity with the RTI Act.

Comment

Under section 8(1)(j), there is no obligation to disclose personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the PIO or the FAA is satisfied that the larger public interest justifies the disclosure of such information.
