CWC pays record dividend for 2012-13 (UPDATED)
Central Warehousing Corporation (CWC) achieved yet another record turnover
of Rs.1407 crore during 2012-13 as against Rs.1219 crore achieved during
the preceding year, registering a growth of 15.42%. This could be possible
due to addition of constructed storage capacity by 2.35 lakh MT in 14
States with a CAPEX of Rs.76.86 crore and increase in overall capacity
utilization (occupancy) to 93% as against 91% achieved during previous
year. Keeping in view the national priority for safe preservation of
foodgrains, utilization of capacity for storage of foodgrains was given
due attention. CWC handled 10.96 lakh TEUs during 2012-13. The Profit
Before Tax (PBT) of CWC increased by 31.5% from Rs.159.12 crore to Rs.209.23
crore while the Profit After Tax (PAT) increased by 39.5% from Rs.100.46
crore to Rs.139.55 crore during 2012-13. Keeping in view the excellent
financial results, CWC has declared dividend for the year 2012-13 @
41%. B B Pattanaik, Managing Director, CWC presented a cheque of Rs.15.34
crore to Prof. K V Thomas, Minister of State (IC) for Consumer Affairs,
Food & Public Distribution on 21st November, 2013, being the dividend
due to the Government of India in the august presence of Sudhir Kumar,
Secretary(F&PD) and Dr C V Ananda Bose, Chairman, CWC. Other senior
officers of the Ministry and CWC were also present on the occasion.
Congratulating CWC for its commendable performance, Minister urged CWC
to undertake creation of storage capacity on a large scale more particularly
in the deficit States like Bihar, West Bengal, Jharkhand, etc.

Inventiveness: Selection-elimination
The mandarins who mistook themselves for rulers emeritus established
their inventiveness while rigging preparing or delaying preparing of
panels for regular promotions e.g. delaying the panels by several years
or bunching 5 or more batches to show favours or disfavours or even
ensuring retirement of the person(s) they wanted to harm before drawing
up the panel. Even after the panels were drawn late, postings (appointments)
were delayed, rigged or denied. The inventive geniuses never answered
why it was happening or why discrimination was being practiced or how
5 year junior guy got promoted and his seniors ignored. In fact, the
nasty ones went to the extent of putting the junior as boss of the senior
and representations were dismissed making the representationist to quote
the rule that prohibited placing a senior under a junior on promotion.
In private it started transpiring slowly that empanelment and promotion
were two different issues. Wonderful, isn't that? Then came the new
invention that even Indian scientist have failed (my sincere apologies
to the scientists who have been beaten in inventions of the administrative
kind): "compulsory waiting". I was amused to read about the
post on the WIC a few days back about a Secretary to the Government
of India getting a posting after remaining on compulsory wait for some
time. How pathetic? The rules devised by the ingenious inventiveness
of the mandarins has caught the highest levels in the civil services.
Shall we hear one day that the Cabinet Secretary has been put on compulsory
wait? Has anybody calculated the financial loss to the discriminated
officers, their agony and the adverse effect on the morale of the civil
services? Is there any Rule for compulsory wait? If so the number and
date of the order needs to be quoted. Unless civil servants put in to
practice highest standards of ethics, evil practices like selection
sometime and elimination at another shall continue.

Use of derogatory language
Those of us who wish some decency in public life are really frustrated
by the language used by the leaders of the main political outfits against
each other While one throws up umpteen barbs at one family and the prime
minister himself, the other party uses choicest expressions for him
and his party calling them thieves, liars, fascists, history distoters
and what not. These personalised attacks are all in bad taste and one
does not expect the leaders who aspire to occupy highest seats of power
to indulge in that. Lok Sabha elections are six months away and one
shudders at the thought of seeing these worthies in competing with one
another in throwing mud on each other. All this will make us veer around
to press the button against NOTA at the time of voting. Is it not so?

Facts:
1. Applicant submitted RTI application dated 16 November 2011 before
the CPIO, The Oriental Insurance Company Limited, Jaipur to obtain information
pertaining to stagnation increment as sanctioned on the basis of performance
and recommendations of DM/BM which was due to the appellant in 2006.
2. Vide CPIO reply dated 20 December 2011, part information was furnished
to the appellant.
3. Appellant preferred appeal dated 16 January 2012 before the first
appellate authority.
4. Matter was disposed of vide FAA order dated 21 March 2012 in which
appellant was informed that information as provided under point 5, 6,
7 and 8 was satisfactory. In respect of
points 1, 4 and 9, CPIO was directed to collect information from the
concerned departments and provide the same to the appellant. In respect
of points 2, 3 and 10 appellant was informed that information had been
requested for from the Head Office where it was held and the same will
be provided as
soon as it is received.
5. Appellant preferred second appeal before the Commission.
6. Matter was heard today via videoconferencing from Jaipur where respondent
CPIO as above were present. Appellant was heard from Kota.

Decision notice
7. After hearing both parties Commission directs the CPIO to provide
a copy of the onepage format in which the performance of the appellant
was recorded and recommendations of the Divisional Manager/ Branch Manager
was given before sanctioning/not recommending the stagnation increment
of the appellant in 2006. Information to be provided within one week
of receipt of order. 8. Commission places on record the reluctance of
the CPIO to provide specific and correct information to the Commission
during the hearing pertaining to the records held by them regarding
the stagnation increment of the appellant. It is after constant coaxing
and prodding by the Commission that the CPIO finally relented to provide
the full and complete information. We cannot agree with the argument
of the CPIO that the request for information has to be seen within the
narrow confines of the words used by the appellant and his complete
refusal to enlarge the words to cover the natural meaning of the words
through which information is sought by the appellant. Undoubtedly this
approach has caused delay in disclosure of information to the appellant
thereby resulting in mental anguish and harassment to him. Accordingly
under the provisions of section 19 (8)(b) of the Act, Commission directs
that the appellant be compensated by the public authority for the detriment
caused to him by paying him and amount of Rs. 3000 within 30 days of
receipt of the order. Head of the public authority is further directed
that within one week of the payment of the compensation amount, he shall
intimate this fact to the Commission.

Should the copy of the marriage certificate be provided under
RTI?
Copy of marriage certificate of a certain employee was sought
from NABARD by the appellant. The Public Information Officer (PIO)
denied the information claiming that in the nature of personal
information and is exempt under section 8(1)(j) of the RTI Act.
The appellant filed a first appeal on with the first appellate
authority (FAA) which upheld the decision of PIO. The CIC disposed
the appeal observing that the approach of the respondent is in
conformity with the RTI Act.
Comment
Under section 8(1)(j), there is no obligation to disclose personal
information the disclosure of which has no relationship to any
public activity or interest, or which would cause unwarranted
invasion of the privacy of the individual unless the PIO or the
FAA is satisfied that the larger public interest justifies the
disclosure of such information.
