PCRA conducts Walkathon (UPDATED)
PCRA had recently organised a walkathon in Noida in collaboration with Noida Traffic Police, TRAX Sports Society & Indian Oil Corporation Ltd. It was done under the aegis of MoPNG, as a part of their ongoing Mega Campaign involving people connect activities in an endeavour to spread the message of Fuel conservation. CWC contributes Rs 25 lakh to CM’s relief fund (UPDATED)
In the wake of extensive devastation due to Cyclone Phailin to the Southern Districts of Odisha, responding to the appeal made by the Chief Minister of Odisha, the Central Warehousing Corporation (CWC) contributed Rs.25 lakh to the Chief Minister’s Relief Fund out of its Corporate Social Responsibility Scheme. The cheque was presented to Naveen Patnaik, Chief Minister of Odisha by B B Pattanaik, Managing Director, CWC. Samuel Praveen Kumar, RM, CWC was also present. CWC runs 465 warehouses with a storage capacity of 10.5 million tonnes accross the country. In the State of Odisha, CWC is operating 22 warehouses in 15 Districts with storage capacity of 3.32 lakh MT for storage of foodgrains, fertilizer, other notified commodities etc. During the last two years, CWC has constructed 1.40 lakh MT storage capacity at 9 locations in 8 Districts. While further storage capacity of 55,500 MT is presently under construction at 8 locations in 7 Districts. The Chief Minister of Odisha appreciated the efforts of CWC in augmenting the storage capacity in the State which is helping in undertaking procurement and distribution of foodgrains. The Chief Minister also louded the gesture of CWC in contributing the amount to the Chief Minister’s Relief Fund for relief and rehabilitation work in the cyclone affected areas.

Administrative lethargy of central govt. may cost Sheila Dixit dearly

Central government is, even at the time of election in the State of Delhi, still lethargic towards the lawful rights of central government employees by not implementing Supreme Court decisions and compelling government servants to go in for litigation in CAT. Most of the common issues in CAT relate to forfeiture of pension and gratuity, issue of charge sheet , bad entry in ACR etc. Thousands of government servants are in CAT in respect of such common issues. The Supreme Court has recently held on August 14, 2013 in the case of State of Jharkhand & ors Vs. Jitendra Kumar Srivastava and ANR that pension and gratuity are right to property and are therefore fundamental right and therefore the same cannot be forfeited in departmental proceedings. The SC has observed as under "Government cannot withhold Gratuity and Pension during the pendency of the departmental proceeding or criminal proceeding: It is an accepted position that gratuity and pension are not the bounties. An employee earns these benefits by dint of his long, continuous, faithful and un-blemished service." Still so many government servants are struggling to get their pension and gratuity. Delay on the part of govt. in settling such cases is incomprehensible. Similarly, Supreme Court has clearly settled the law that ACR entry of government servant cannot be spoiled without giving reasons. DoPT instructions of G.I., D.P.& AR O.M.No.51/3/74-Estt. (A) dated 22nd May 1975 are also on these lines. Still thousands of govt. servants are struggling to get their ACR entries corrected in consonance with DoPT instructions and SC decisions." The views of Anil on government lethargy and apathy to the cause of Government servants are quite appropriate in point of time as well as contents. The Govt./PSU employees-both serving and retired, with their families and friends constitute more than 2% of elite voting power. The govt does not care for this voting power primarily because the govt. is not short of money and time in pursuing fruitless litigation .Unfortunately the govt. seems not to be following even the SC decisions though the eminent lawyers like Hon. S/Shri Chidambaram and Sibal form part of the Central Cabinet. The SC recently on September 5 in the case of Gopinath held that the charge sheets issued without the approval of the President (concerned Cabinet Minister) are null and void. The Finance ministry has initiated hundreds of disciplinary proceedings through such charge sheets which can be dropped with one stroke of pen but the typical govt lethargy and apathy prevents them from doing so. In thousands of cases, the pension and gratuity so far withheld deserves to be released forthwith in view of settled law re stated in Jitendra Kumar's case. The vigorous campaign for the VCES makes one to think whether the govt. is meant for only collecting money? I, a retired (in 2004) Chief Commissioner (69002) is also a victim of such attitude. The most frivolous & unsustainable charges leveled against me maliciously through charge sheet issued in 1991 had to be dropped in 2002.When the ACC required of the Finance Ministry to take action against officers responsible for the inordinate delay in finalizing the proceedings, instead of doing this, they issued another illegal and ab initio void charge sheet soon after in 2002 which has not been withdrawn till date despite the court of competent jurisdiction having quashed & declared the same to be non est. What is more , the 'transparent 'govt. has not even acknowledged a single communication of mine out of nearly two dozens addressed to them on the subject through E-mail, speed post etc. If this is my plight, what about thousands of other employees/pensioners not being lucky enough to hold such high position in the govt? Is it not the right time to do justice to the sufferers so that not only the Shiela govt but the UPA govt (going to the polls within a short time) also is able to earn good wishes of those who have suffered at the whims of a few in the Govt? I hope you will give due treatment to the above in your esteemed Whispers.

Food in trains:

Even the Railway authorities are aware of the sub-standard food supplied in trains, Particularly in sought bound trains like Rajdhani, Duronto express, TN express etc. Many complaints have come and for obvious vested reasons they are not interested in setting things right. In fact in Rajdhani and Duronto Express, there is no menu and if at all a dummy menu which has no relating to the food supplied. For this they give some reason or other because they know once the passenger board the train and alight it they leave behind all these deficiencies.

I fully agree with the view that the food being served by the Railways in Rajdhani trains is indeed rotten and caterers are interested only in making money by hook or by crook and I am sure the officials of the Rail ministry are also equally responsible

PIO should personally attend the hearing before the information commission

A hearing of show cause notice issued for imposing penalty under section 20 was held by the CIC. The Public Information Officer (PIO) of South Delhi Municipal Corporation failed to appear before the CIC and instead deputed an officer below him in rank to appear on his behalf even though the Commission had specifically directed the PIO to appear for personal hearing before imposition of penalty. The CIC noted that information was furnished to the appellant after a delay of about a year that too, when the CIC had given directions during the second appeal. The CIC imposed the maximum penalty of Rs. 25,000/- to be recovered in five equal instalments @ Rs. 5,000/ p.m.

Comments

The opportunity of hearing provided by the commission should not be missed by a PIO. It is the chance available with the PIO to explain his conduct and show that there was no malafide denial of information.
