Credibility of CBI again established

CBI Chief Ranjit Sinha has once again established the credibility of the investigative agency. Nobody would believe that Lalu Yadav will go to jail with Ranjit Sinha at the helm of affairs of the CBI. Sinha had been Yadav's DGP in Bihar for several years and also investigating officer in the fodder case. When he landed in Delhi on central deputation, Sinha was always named as Lalu's man. When he became CBI Chief there was a talk in the corridors of power that now Lalu's fate is secured. Infact, two Congress Ministers in the UPA Government had to go because of CBI headed by Ranjit Sinha.

Unless we make Voting compulsory, for all and Rejection of all candidates implemented in letter and spirit, then only India will be democracy, non-voting should be an punishable offence Indian situation cannot be improved in India, the present one is not a democracy because the Government in power always won and ruled by getting only 21% votes out of 121 crores. We never had a democracy, it has always been minority Government with a weak PM installed.

Once a soldier always a soldier, this should be the motto of all members of the armed forces and most of our valiant men are maintaining this tradition. Unfortunately people like VK Singh has become a black sheep among them. I am deliberately not using his rank as I feel he no longer deserves the title. In one stroke he has compromised the security of the country which he had pledged to preserve. He should be tried for treason.

Unhealthy Trend

A very unhealthy trend is continuing in Government departments to employ retired officers as consultants and grant extensions to blue eyed officers. This stops the opportunity for younger generations to get the employment and feel frustrated after completing their education. One time relaxation becomes permanent and continues year to year. Govt. should provide equal opportunity to all employees working in all the departments. As one starts giving preference of one particular cadre then it spreads to others without check.

Truth behind appointment of consultants

When justice becomes costly and no one bothers about probity in public life, it is natural to see many undeserving officers being appointed as consultant. At times, the favours are obtained through illegal means too. It is too much to expect a fair deal through an empowered committee. A ban on appointment of retired persons for two years may be one correcting measures.

DATE WITH RTI

Can the filing of application under the RTI Act by citizens be termed as an official act?

Responding to the appellant's complain that the PIO had violated the official language policy by giving reply in English to an application filed in Hindi, the Appellate Authority observed that the Official Language Policy prescribes that all letters received in Hindi, irrespective of the region from where received, should invariably be replied to in Hindi. This extends to official letters only and an RTI application cannot be said to be an official letter. The RTI Act also does not prescribe the language in which an RTI application should be disposed of. The CIC held that the Appellate Authority has erred in observing that an RTI application cannot be said to be an official letter. Every action under a statute is an 'official act'. Therefore, filing of RTI application under the RTI Act by citizens too is an official act and cannot be construed as nonofficial act as observed by
the Appellate Authority.

Comments

A PIO should reply to the RTI application as per the provisions of the official language policy. In case the documents being sought are in English while the RTI application has been filed in Hindi, the copies of the documents may be provided as available with the forwarding letter is Hindi.
