Navratan PSU Gail India's CMD B C Tripathi has been extended a consecutive second term as CMD. The Government of India has recognized the services of GAIL India CMD. Tripathi's current term was to expire on 31st July 2014. Now in second term Tripathi will continue the office of CMD Gail till July 31, 2019.

Ridiculous suggestion
It is ridiculous and a legal folly for "a retired civil servant" to suggest that retired officials' pension should be made dependent on the mercy of the ruling powers based on a "good conduct" certificate to be issued by them along with the annual life certificate. He should know that the supreme court has laid down the law of the land that pension is not a largesse doled out by the government to retired officials at their whim but a legal right for a dignified living post-retirement earned by their long years of service put in during their entire working age. It is ludicrous to club a life certificate and a so-called a good conduct certificate for a retired civil servant like for an adolescent school-leaving pupil to be issued by the headmaster ! Even while in service, all government employees including peons are assessed only in their performance appraisals and not for good conduct certificates. What an insult to the dignity and self-respect of retired senior citizens and what a cheap way to settle scores with those against whom you carry a chip on your shoulder, retired civil servant!!

Pension is not a Bounty
The assertion that "pension payment is subject to good conduct" is incorrect. The Supreme Court of India has clearly pointed out in the matter of UPR Acharya v. State of Karnataka, that Pension is not a bounty, but rather a sort of deferred salary. It is not some gift that the government bestows, but nothing less than the earned right of the pensioner. No doubt government retirees should adhere to norms of decent behaviour. But pension has little to do with them.

Nothing common
The Central Secretariat Manual of Office Procedure defines the duties of responsibilities of both Assistants and PAs. There is no commonality. Hence, the question of both of these posts having similar eligibility criteria for LDCE exams does not arise.

PAs shouldn't be allowed to compete
I disagree, minimum qualifications for LDCE examination should be a Graduate as one becomes Class II Gazetted Officer after he/she qualifies LDCE. I am of the view PAs should not be allowed to compete at all for SOs examination.

Different yardsticks for different RTI applications

The appellant sought copy of own ACR from the period 2005 to 2011 and also the copy of Performance and Integrity Certificate which was used in promotion process. The Public Information Officer (PIO) denied the information claiming exemption u/s 8(1)(j). During the hearing before the CIC, the appellant claimed that he has not been treated impartially since information has been given to others concerning similar request. The CIC observed that even if the PIO erred in interpreting law, he cannot discriminate between the applicants. The CIC directed the IG Police (HQ) to get the matter enquired into by a Senior Police Official and take necessary action under intimation to the appellant.The PIO was directed to provide copy of appellant's ACRs for the period from 2005 to 2011 free of cost within ten days of receipt of the order.

Comments

A PIO is expected to know the RTI Act, 2005 thoroughly and apply it objectively in a neutral manner. Discrimination between similar requests is likely to lead to imposition of penalty on the offender.
