?
Official orders of the transfer of Chief Justice of the Himachal Pradesh
High Court Justice Ajay Manikrao Khanwilkar to the Madhya Pradesh High
Court as its Chief Justice are likely to be issued in a day or two.
He is likely to be sworn in either on October 18 or 19.
Orders of Justice Chandrachud in a day or
two ?
Bombay High Court D Y Chandrachud is being elevated as Chief Justice
of the Allahabad High Court to succeed Justice Shiva Kirti Singh. Orders
to this effect are expected to be issued in a day or two. Earlier his
name was in circulation for the post of Chief Justice Madhya Pradesh
High Court.
Will Justice Mir succeed Justice Khanwilkar in HP ?
Senior-most Judge of the Jammu and Kashmir High Court Mansoor Ahmad
Mir is being transferred to the Himachal Pradesh High Court. Will he
succeed Justice Khanwilkar as CJ in Himachal Pradesh High Court.
Patro to succeed Srivastava as Director, ECL
on Nov 1
K S Patro, GM, CCL, will be joining as Director (Personnel), Eastern
Coalfields Limited (ECL) on November 1, 2013. He will succeed S K Srivastava
retiring on October 31, 2013.

CVC queers the pitch of SS Joshi for being
Director, BEML Ltd!
It is being whispered that the selection of S S Joshi, ED, DMRC made
by Public Enterprises Selection Board (PESB) on February 21, 2013, for
the post of Director (Metro & Rail Business), BEML Limited, has
turned sour with the Central Vigilance Commission (CVC) refusing to
give its clearance to him for the slot and, thus, the way for the appointment
of another candidate.
Aditya Joshi goes on central deputation
Services of Aditya Joshi presently in Northern Railway have been placed
to the central deputation as Director, Department of Administrative
Reforms & Public Grievances in Government of India for a period
of five years. He is an IRAS officer.
A V V Krishnan joins as Director (Fin), EPIL
A V V Krishnan, GGM, TCIL, has taken over as Director (Finance), Engineering
Projects India Limited (EPIL). The post had been lying vacant since
February 28, 2013.

Amit Lodha to be relieved by Govt of Bihar

Amid the approved central deputation Amit Lodha is expected to be relieved
in a day or two by the Government of Bihar. BSF served the reminder
to the Govt of Bihar on 01st October to relieve Lodha to move as DIG,
BSF.
NWDC may soon be formalised after the approval
of ACC
In the very outset of 2014 Lok Sabha General Elections followed by Assembly
General Elections in five states the National Waqf Development Corporation
(NWDC) may soon be institutionalised after ACC approval. The Department
of Expenditure has already given its approval.

GAIL CMD Tripathi gets 5 year extension
Navratan PSU Gail India's CMD B C Tripathi has been extended a consecutive
second term as CMD. The Government of India has recognized the services
of GAIL India CMD. Tripathi's current term was to expire on July 31,
2014. Now in second term Tripathi will continue the office of CMD Gail
till July 31, 2019.
Balachandran takes over as Non-Executive Chairman
Balachandran M, ex-CMD of Bank of India has taken over as Non -Executive
Chairman of National Payments Corporation of India. He succeeds N R
Narayana Murthy after the lateer decided to take over as Executive Chairman
of Infosys. Dilip Asbe has taken over as COO and Dr Rajendran N as CTO.
Prasad to be Director, RINL
G B S Prasad, ED, RINL, has been selected for the post of Director (Personnel),
Rashtriya Ispat Nigam Limited (RINL) at a Public Enterprises Selection
Board (PESB) meeting held on October 11, 2013. As many as 12 persons
were interviewed for the same.

MACP w.e.f. 1.6.2006 on promotional hierarchy basis
Since Supreme Court has dismissed the SLP No.CC/7467/2013 filed by
Govt. of India against the decision of Punjab. & Haryana High Court
CWP No.19387 of 2011 on the grant of MACP on promotional hierarchy,
Govt. of India, in all fairness of the Govt. being a model employer,
should grant MACP on promotional hierarchy basis and not on next Grade
Pay basis WITH EFFECT FROM 1ST JANUARY, 2006, coinciding with implementation
of the recommendations of the 6th Pay Commission.

Model code of Conduct for pensioners
The suggestion to frame" Model Conduct Rules for Retired officers"
deserves consideration. The views posted on Oct 12-13,are expressed
under misleading impression that pension cannot be touched . In terms
of Rule 9(2) (a) of the C.C.S. (Pension) Rules, 1972 and Rule 6 of the
AIS (Death-cum- Retirement Benefit) Rules, 1958 for officers of All
India Services, the Central Government ,in case of grave misconduct
like "having disproportionate assets", "pecuniary loss
to public funds" etc has the power to withhold or withdraw pension
even as a result of major/minor penalty proceedings instituted against
the Government servant, while in service, and continued after his retirement.

Different yardsticks for different RTI applications
The appellant sought copy of own ACR from the period 2005 to
2011 and also the copy of Performance and Integrity Certificate
which was used in promotion process. The Public Information Officer
(PIO) denied the information claiming exemption u/s 8(1)(j). During
the hearing before the CIC, the appellant claimed that he has
not been treated impartially since information has been given
to others concerning similar request. The CIC observed that even
if the PIO erred in interpreting law, he cannot discriminate between
the applicants. The CIC directed the IG Police (HQ) to get the
matter enquired into by a Senior Police Official and take necessary
action under intimation to the appellant.The PIO was directed
to provide copy of appellant's ACRs for the period from 2005 to
2011 free of cost within ten days of receipt of the order.
Comments
A PIO is expected to know the RTI Act, 2005 thoroughly and apply
it objectively in a neutral manner. Discrimination between similar
requests is likely to lead to imposition of penalty on the offender.
