Disband CGHS

Even most senior IAS officers mostly the retired ones are thrown out in the ring to face utmost humiliation of the "Cattle Government Health Scheme " known as CGHS. Better if disbanded right now. Beyond redemption

CGHS services have improved

CGHS services have improved considerably in the recent past especially for the Pensioners. We still need more reforms regarding simplification of referring the patients to Panel hospitals, arrangements with in the CGHS (sufficient scope), distribution of medicines after consultation with doctors, attitude of CGHS employees/doctors. Hope DGHS is listening, DGHS should views of beneficiaries and improve accordingly. Many thanks to the team which has brought to this level.

Apex court's orders timely and rational

Apex court's orders about MACP are timely and rational. Government shouldn't harass its employees. Orders in this regard be issued at the earliest. Similarly Transport allowance should also be made more realistic. Either staff be given subsidized petrol and diesel or they should be compensated fully. Thanks.

My bureaucratic experience demands from apex/top management everywhere that due to shortage/scarcity of resources focus should now shift from performance appraisal/audit to performance management ! Second, officers on ex cadre posts everywhere must be placed under constant watch/scrutiny!

Ministers go by Secretary's advise

The paragraph No.3 of the Central Secretariat Manual of Office Procedure (CSMOP) states as under:-
3. The Council of Ministers -
(1) In the exercise of his functions, the President is aided and advised by a Council of Ministers headed by the Prime Minister. In actual practice the executive power of the Union resides in the Council of Ministers.
(2) The Council of Ministers consists of three categories of Ministers, namely : (a) Cabinet Ministers; (b) Ministers of State; and (c) Deputy Ministers.
(3) The Cabinet, which consists of Ministers of the first category only, is responsible for shaping the overall policies of the Government in discharging its responsibilities. It sometimes functions
through its Committees.

The paragraph No.5 (3) of the CSMOP states as under:-
" A Department is normally headed by a Secretariat to the Government of India who acts as the administrative head of the department and principal adviser of the Minister on all matters of policy and administration within the Department".

The functions of Secretary in the paragraph No.5(9) (a) of the CSMOP has been stated as under:-
"Secretary- A Secretary to the Government of India is the administrative head of the Ministry or Department. He is principal adviser of the Minister on all matters of policy and the administration within his/her Ministry/Department, and his responsibility is complete and undivided."

From the above it is quite clear that thez. The whole sole responsibilities lies with the Secretary concerned. Why P.C. Parakh did not refer back the matter of allotment of Coal block to the Hindalco to the Screening Committee for reconsideration?

Why did he act on his own? Parakh was known to be a bully officer. Ministry of Coal is a very small Ministry and it is understood from certain sources that he used to call the Section Officers and tell them to write notes on files according to his wishes. It is also understood that the CMDs of PSUs under the Ministry of Coal, whenever,
in Delhi used to call Mr. Parakh in their Suites in the 5 Star Hotels and entertain him. It is quite possible that in spite of the aforesaid murmurs, Parakh was a honest and upright officer. It would also be worthwhile to speak to his contemporary officers both in the Ministry of Coal and PSUs under the Ministries control. His past
record should also be explored. Further, his role as Secretary needs to be probed not only with reference to the Hindalco's case rather with reference to all other cases in order to take a holistic view.

Parakh has no business to work as Director on the Board of organization with whom he has dealt as a Government official.
The All India Service Officers Association should not try to put up a blanket veil on one of the Members of their fraternity.

Ravinder Gupta was a former Secretary, Heavy Industry. During his tenure one of the sick PSU of the Ministry namely Jessop was disinvested. Seven years later when he was Chairman-BIFR, Jessop came out of the purview of BIFR. After his retirement from BIFR he became a Director on the Board of Jessop. Can one explain this phenomena?

One important thing to be noted is that in so far as the Prime Minister is concerned the Rule No.12 of the Transaction of Business Rules states as under:-

"Departure from Rules: - The Prime Minister may, in any case or classes of cases permit or condone a departure from these rules, to the extent he deems necessary".

DATE WITH RTI

The words of the RTI application should not be interpreted narrowly

Information pertaining to stagnation increment as sanctioned to the appellant on the basis of performance and recommendations of Divisional Manager/Branch Manager of the Oriental Insurance Company Ltd was sought by the appellant. The CIC directed the Public Information Officer (PIO) to provide a copy of the one page format in which the performance of the appellant was recorded and recommendations of the Divisional Manager/ Branch Manager was given before sanctioning/ not recommending the stagnation increment of the appellant. The CIC also placed on record the reluctance of the PIO to provide specific and correct information to the Commission during the hearing pertaining to the records held by them regarding the
stagnation increment of the appellant. It was after constant coaxing and prodding by the Commission that the PIO finally relented to provide the full and complete information. Holding that this approach has caused delay in disclosure of information to the appellant thereby resulting in mental anguish and harassment to him, the CIC granted a compensation of Rs 3000/- to the appellant for the detriment caused to him.

Comments

The request for information should not be confined to narrow interpretation of the words used by the appellant. The words should be construed to cover their meaning in the context in which information is sought and the PIO should work as per the spirit of the RTI Act.
