Proven: Netas for, Janata against Corruption!
The Ordinance to save convicted netas has proved that the politicians
of this country are in favour of the corrupt and criminal elements whom
they patronize and promote. The advocates of the corrupt stand exposed
fully. They have trashed the Lokpal Bill, the Anna Hazare led anti-corruption
movement, the civil society opinion, the protesting political parties
and when the judiciary came to the rescue of the Aam Aadmi, they did
not hesitate to attack it. The language, gestures, words and contempt
on their faces for public opinion was worse than what they are attacking
Rahul Gandhi for. But for this young man, the Ordinance would have been
promulgated by now, making a deadly comedy of the rule of law in India
by the political buffoons of all times!. It is not important whose voice
compelled the government to rethink the ordinance; rather it is important
that the government supported by its allies has been forced to rethink.
The abrasiveness so far displayed by the advocates of corruption, whether
in 2G or Coalgate and the more unconstitutional attacks on constitutional
authorities like the C&AG or the Judiciary, deserved a reply exactly
in the language they understand. And Rahul Gandhi did exactly that-
he put his foot down in the language of the advocates of the corrupt
and the criminal. A nonsense is a nonsense, call it by any name. The
corrupt must note that the youth of this country has no stomach for
corruption of the kind and scale they have practiced so far and also
justified. The nation has been saved. There will be no other repercussions
of this effective intervention as any threat to the stability of the
government by the discredited leaders of the allies if they decide to
ditch the government, for they are viewed extremely poorly by the people
of the country. Whosoever assures transparent governance and good governance
wins the elections this time. The competition will be worth watching!

DATE WITH RTI

Can the filing of application under the RTI Act by citizens
be termed as an official act?
Responding to the appellant's complain that the PIO had violated
the official language policy by giving reply in English to an
application filed in Hindi, the Appellate Authority observed that
the Official Language Policy prescribes that all letters received
in Hindi, irrespective of the region from where received, should
invariably be replied to in Hindi. This extends to official letters
only and an RTI application cannot be said to be an official letter.
The RTI Act also does not prescribe the language in which an RTI
application should be disposed of. The CIC held that the Appellate
Authority has erred in observing that an RTI application cannot
be said to be an official letter. Every action under a statute
is an 'official act'. Therefore, filing of RTI application under
the RTI Act by citizens too is an official act and cannot be construed
as nonofficial act as observed by
the Appellate Authority.
Comments
A PIO should reply to the RTI application as per the provisions
of the official language policy. In case the documents being sought
are in English while the RTI application has been filed in Hindi,
the copies of the documents may be provided as available with
the forwarding letter is Hindi.
