"RBI's decision will have operational difficulties for consumers".

As per RBI's circular effective from 1st Jan 2014, no bank will accept currency notes with anything written thereon. Fair enough. But, the decision is out of sync with ground reality. The following practical problems will be faced by Aam aadmi.

These need to be addressed first by the RBI:--

(a) Is the RBI not aware of missing link between its banks and private (outsourced) agencies responsible for maintaining, stuffing and operating ATMs?

(b) Are there any guidelines from the RBI to banks or from banks to ATM operating sub- contractors on precautions to be taken for currency notes dispensed from ATMs? Perhaps, none!

(c)What about the bank tellers who usually scribble something on bundle of notes?

(d)How to refuse scribbled currency notes from neighborhood kirana shops?

The customer has no option but to accept the currency notes which are either counterfeit or have something written on them.

What should aam aadmi do ?

Plight of senior officers

I fully agree that Government recently banned posts to be filled up. If we demand that retired officers should not be appointed as Consultants. Have seen the present plight of senior officers who are doing the work which Assistants used to do in yester years? Then, you expect efficiency and quality to improve. This situation has arisen as the standards of Government of India of the so-called steel frame have gone down the drain. A job which an Assistant was doing is being done by a Joint Secretary level and on the top of that there is no accountability too. God save India from this un-civil civil service. Improvement is only possible by fixing responsibility for each job, job security must go, if you do not deliver, you have no right to be in the job.

Exploitation of officers attached to PSUs

Maladies everywhere in the Government day by day is being rooted out. People are being punished. But nobody is taking care of one of the malady i.e. exploitation of the PSUs, Attached/Subordinate officers by the officials/ministers of various Ministries/ Departments. In spite of the fact that a blatant case of exploitation of NTPC by the Power Ministry Officials was exposed in the year 2006, the exploitation of PSUs, Attached/Subordinate offices continue unabated in Ministry of Power. Through RTI Information has been obtained that SVJN had provided a vehicle on daily basis to the Ministry of Power. This is being used by officials for commuting from residence to office & back and at the same time the employees are availing transport allowance with their salaries. BBMB has booked a room in their guest house in New Delhi for one of the official of the Ministry of Power on permanent basis. NHPC has supplied 20 employees to the Ministry. May be some of them would be performing domestic chores of the officials. Information is being elicited from other PSUs and organizations also from all Ministries /Departments. Very soon a PIL will be lodged in the Court. In this era of acute fiscal deficit and financial constraints, the Government also need to issue strict instructions to the PSUs that they should not distribute Sweets and Dry Fruits during the forthcoming Diwali. At least somebody should make a beginning.

DATE WITH RTI

Can the filing of application under the RTI Act by citizens be termed as an official act?

Responding to the appellant's complain that the PIO had violated the official language policy by giving reply in English to an application filed in Hindi, the Appellate Authority observed that the Official Language Policy prescribes that all letters received in Hindi, irrespective of the region from where received, should invariably be replied to in Hindi. This extends to official letters only and an RTI application cannot be said to be an official letter. The RTI Act also does not prescribe the language in which an RTI application should be disposed of. The CIC held that the Appellate Authority has erred in observing that an RTI application cannot be said to be an official letter. Every action under a statute is an 'official act'. Therefore, filing of RTI application under the RTI Act by citizens too is an official act and cannot be construed as nonofficial act as observed by
the Appellate Authority.

Comments

A PIO should reply to the RTI application as per the provisions of the official language policy. In case the documents being sought are in English while the RTI application has been filed in Hindi, the copies of the documents may be provided as available with the forwarding letter is Hindi.
