DEBATE

DEBATE (1)

The PM of the country should be well conversant with the Constitution of India. This wonderful document has been violated right from the beginning. It established Presidential form of Govt. but unfortunately Nehru chose to be PM, and Dr Rajendra Prasad preferred not to enforce his authority, nor to swap positions. Secondly, he should be a mature and popular politician who is able to enforce rule of law in this lawless society. He should be honest and a man of good character who should have guts to enforce integrity & transparency in the country. He should have vision, knowledge of History (has learnt fm others' mistakes), good luck and should live long enough. Spirituality and not religious bigotry & so called god men should be his guide. He should be comparatively young.

Shivaji Mahan Cairae IPS (retired)

DEBATE (2)

The Prime Minister of India should be a VISIONARY with PATRIOTISM both. Manmohan Singh is lacking with both the qualities.

7th pay commission not important

To constitute a 7th pay commission is not the need of the hour. This is not going to help the common people of the nation. The most important issues which need Government to curb on priority are as under:-

1. To control the population by implementing various methods of family planning.

2. To solve the rising unemployment of youth by filling up all existing vacancies in Government Departments/PSU's/Banks/Statutory bodies etc. Engagement of Consultants/Advisors after 60 years of be banned. Similarly, Members of Tribunals/Commissions should not be engaged after 60 years of age.

3. Social Security System needs to be implemented as we all know about the condition of old aged people who do not have pension to survive, are starving in their huts or streets.

4. Our Judicial system needs very immediate action for some sorts of reforms and speedy disposal of cases. For this, we hope judges will come forward to work 6 days a week and reduce the numbers of holidays or vacations in a year.

5. All political parties need to keep up the National interest on their priority.

Sheer discrimination

Police verification is necessary even for appointment as a class IV Employee in government. While it is possible to be an MP, MLA and even a Minister if criminal cases are decided against.

Retd Army men joining politics is an unhealthy trend

This regarding Retd Maj Gen joins BJP. This is an unhealthy trend in the long run. A soldier is meant to obey the orders of the Government in power. He has no business to be in politics as he can recall in case of Country's Emergency situation. I feel GOI should change the Def. Rec. Rules to this effect. Services have no role in the politics of the country except serving the Nation as a Soldiers.

Value for ladies

All voters in Delhi and in India are eagerly waiting after the December 16 episode about how much weight age the BJP, Congress and other parties will give to them while distributing party tickets. Only this will show the real picture about their thinking about ladies...let's wait and see.

Power of Cabinet Secretary

It is not the question of taking side or using power. In fact, the system is non-responsive and dismissive of any dissent. In spite of so many hue and cries in public and media, even ACC does not respond to Corruption Charges against senior officers and approves their appointment as a routine manner. It will not be nice to take names here, but there are many such examples. Two such cases are still pending with the ACC. One person has been found guilty of financial misappropriation and investigation against the other person is going on. However, they are in the list of promotion. Will CS first set his house right to win the confidence of general public? Have we learnt any lesion from the case of Satyendra Dubey of Whistle Blower fame?

DATE WITH RTI

Can the filing of application under the RTI Act by citizens be termed as an official act?

Responding to the appellant's complain that the PIO had violated the official language policy by giving reply in English to an application filed in Hindi, the Appellate Authority observed that the Official Language Policy prescribes that all letters received in Hindi, irrespective of the region from where received, should invariably be replied to in Hindi. This extends to official letters only and an RTI application cannot be said to be an official letter. The RTI Act also does not prescribe the language in which an RTI application should be disposed of. The CIC held that the Appellate Authority has erred in observing that an RTI application cannot be said to be an official letter. Every action under a statute is an 'official act'. Therefore, filing of RTI application under the RTI Act by citizens too is an official act and cannot be construed as nonofficial act as observed by
the Appellate Authority.

Comments

A PIO should reply to the RTI application as per the provisions of the official language policy. In case the documents being sought are in English while the RTI application has been filed in Hindi, the copies of the documents may be provided as available with the forwarding letter is Hindi.
