It has been the unfounded news in the media that Government has been considering to reduce the retirement age from 60 years to 58 years since it took over. DP&T, at one stage, had to come out with the statement that it has no proposal to reduce the retirement age. Now the so called unconfirmed news has surfaced again. It may be mentioned, in this connection, that the earlier BJP Government led by Atal Bihari Vajpayee has increased the retirement age from 58 to 60 years. It will be like reversal of earlier BJP policy and against the interests of Government employees who are fit to serve and contribute in the well being of the nation. Retirement age was increased keeping in view the longevity of the persons. Moreover, when the employees are prepared to mould themselves according to the changed environment in the Government, there seems to be no logic for the Government to reduce the retirement age. This is a debatable issue and it will be better to refer this issue to the Seventh Pay commission who may take a view in consultation with the Staff Unions.

Unreasoned CVC advice


Central Vigilance commission is an important institution. This institution has been created to provide safeguard to the govt. officers from prejudiced penal / vigilance actions by govt. Therefore, it has been made obligatory for the govt., to first obtain advice of CVC, before initiating vigilance proceedings. However, in practice, CVC gives advice in one line that 'it agrees with the proposal of govt. for vigilance action'. Thus this is a non-speaking agreement. Such non-speaking agreement/ views of CVC prejudices the interests of govt. servants. The govt. servants never knows what was put up before CVC and how CVC was satisfied. Such non speaking advices are against the law laid down by PC /SC etc. laying down the rule of law that even administrative orders should be speaking ones.

Will employees union / federation take cognizance of this situation and fight for bringing out change in practice of CVC and getting non-speaking unreasoned advices annulled by filing PIL?

Will Court take suo motto cognizance and annul all such advices which are against the law ?

Will new govt. ensure fairness by initiating action to ensure that employees interests are protected in substance through speaking and reasoned advices and not in form by just showing the govt. servant that formality of obtaining CVC advice has been completed.

Will CVC justify through this website why they do not give reasons for agreeing with the proposal of govt. for initiating vigilance action against the govt. servant.

Railways itself is responsible


Refer Vox Populi comment in Whispers today. The discontent is natural when the gap is getting so widened. But who is responsible? Railways themselves are pushing their officers behind. Recently one officer of the 1990 batch requested for forwarding her name to DoPT for empanellement. She was told no they are still at 1986.The ways of Railway Board are strange. They will refuse posting to an officer in the Railway Board as they want him to do ,cooling off' since me from a posting on Deputation from railways' own PSU. They will on the other hand post another officer at the same level in Railway Board, by even transferring an element from somewhere, who had spent 7 years in one corporation, goes to another deputation in Govt. of India without mandatory cooling off period. Government has changed but things remain as bad in the Railways as hitherto not withstanding the able leadership at the top. Writing on the proposed exercise on restructuring I had in fact detailed what needs to be righted in my article which appeared in the Statesman of 19th and 20th of Nov.

Personal information of a government employee

The appellant asked for the service details of a teacher regarding her date of joining the service, her present residential address and her salary certificates, etc. During hearing before the CIC, the teacher submitted that the information seeker is her husband who is harassing her. She raised objection to the disclosure of information to the appellant, saying that it is her personal information. The CIC held that information about salary and official address of public servant is public in nature and shall be disclosed to any person including spouse. Salary details including deductions contained in Salary slip or certificate and residential address of the public servants is personal information, and also third party information. Only after proof of larger public interest such information also can be given. Filing of 50 RTI applications reflects the personal animosity but not public interest.

Comments

Cases where spouses are seeking information about each other are now increasingly coming to notice. They may be involved in marital disputes and cases both civil and criminal, may be filed mutually against each other. They can also seek information to help them to prove or disprove the charges. However, it must be born in mind that information unconnected with the discharge of public duties should not be provided unless the disclosure establishes a larger public interest.
