Alok Kumar is Secretary, Central Vigilance Commission

7 IAS officers transferred in MP

2 proposals being sent to ACC for one post of MD, FSNL (UPDATED)
The Ministry of Steel is reported to be sending two proposals to the Appointments Committee of Cabinet (ACC) for the appointment of Managing Director, Ferro Scrap Nigam Limited (FSNL). Two persons names K K Jain, GM, SAIL and Rajiv Bhattacharya, GM, FSNL, are being sent to the ACC after CVC gave them clearance after almost three years.

Are important instructions being followed ?

An RTI application had recently been sent to the Central Electricity Authority, an autonomous body, under the Ministry of Power inquiring about the status of the case relating to identification of sensitive posts (based on CVC guidelines), which was gathering dust in one of the office. The applicants intentions is only to inquire from various government offices seeking information whether the some the important instructions of the Supreme Court/CVC/ Government like sexual harassment of women at working place, website guidelines, constitution of Board on stability for ensuring of tenure etc.is being followed or not. Look at the courage of one of the official of the CEA trying to go against the spirit of the RTI Act-2005 by finding out the telephone number of the address and then inquiring on telephone whether such & such person is there at the reported address.

There is a need to review the utility of CEA in the present times by the Government of India. Earlier it use to perform regulatory functions also, which is now being done by the CERC. Many officials there have no work at all. The new CPSE recruits have no interest in continuing and are always on the look out of greener pastures. Many of senior officials are simply playing solitaire on their computers. The DOP&T & Ministry of Power, post in CEA, only the most incompetent and handicapped secretarial staff. Moreover, the CEA, these days, tries to resist new plan schemes, which the Ministry of Power tells them to take up. There is a lot of backbiting in the organization. Agreed that CEA is the technical advisory body of the Ministry of Power but the Government has to take a view that either CEA should be made the Ministry and have no Ministry of Power (containing only generalists who are always browbeating the officials of PSUs and attached /subordinate offices). It is said that most of their officials are getting satiated at the cost PSUs. Alternatively, CEA could be converted into a technical wing of the Ministry of Power on the lines which happened when, the erstwhile DGTD, in the Ministry of Industry and, the DGFT, in the Ministry of Commerce were wound up.

DATE WITH RTI

Addition and deletion of names in the agreed list

Applicant sought information as to how his name was put on the agreed list and how was it removed. The First Appellate Authority (FAA) directed the PIO to furnish relevant documents after duly suppressing the identity of complaint(s)/official(s). The Public Information Officer (PIO) filed an appeal against the FAA order. The Central Information Commission (CIC) observed that the Agreed List is admittedly a confidential information, rather a critically confidential information, held by the public authority in its role as a third party within the provisions of Section 124 of the Indian Evidence Act. The CIC held that confidentiality of the Agreed List is critical for the success of the management decisions about key assignments to its employees, lest for want of reflection on the background, character and conduct of specific officers, management hands over sensitive assignments into undeserving hands whose actions may be injurious both to the public authority as well as to the public interest. The CIC upheld the denial of information by the PIO.

Comments


In the case of Sudesh Kumar v. Customs & Central Excise in Appeal No.CIC/AT/A/2007/00229, the CIC had ruled that "Agreed List" are not disclosable. After a person's name has been deleted from the agreed list, there would be little ground to deny information to the concerned person.
