CM and CS combine made Global Investors Summit a great success in MP
The Global Investors Summit in Indore was
a stupendous success, surpassing all expectations. In fact, one of the
largest events ever organized by MP, it has succeeded in branding MP.
Credit goes to Chief Minister Shivraj Singh. It brought together every
single big name in business and industry without exception, and was
inaugurated by the Prime Minister, who made two telling comments - one,
that MP would be the driving force behind the Indian economy, and two,
that the MP administration was quick to seize on every opportunity with
a creative response; in this connection he gave the example of the state's
Defence Production Policy. He said that the central government ought
to blow MP's trumpet in India and abroad. The closing session was attended
by six Central Ministers. Presentations by Chief Secretary Anthony De
Sa on the opening and closing days were particularly appreciated, in
both content and delivery, even by some of the leading economists of
the country who were present.

Name of Tiwari proposed for Director (Tech), CCL
The Ministry of Coal is reported to have forwarded the name of P K Tiwari,
CGM (NCL), CIL, for the post of Director (Technical), Central Coalfields
Limited (CCL) after the penal of P K Guin, CGM, CCL scrapped. Tiwari
was in second position at PESB selection meeting on October 14, 2013.
The post has been lying vacant since July 19, 2013.

Excellent approach by PM
Excellent approach by PM to give weight age to non-IAS officers of
1985 batch. We Engineers are also victims. I am from 1994 Indian Engg
Services (IES) exam but I have not got JS pay or post while 58 IAS officers
of 1996 batch have got it w.e.f. 21.8.2014. PM should be apprised about
this disparity and Victorian slavery.

Posting of IAS in CBDT and equality in treatment
If it is being considered to post any IAS to handle the post of Member
P&V in CBDT and CBEC on the ground that IRS officers work together
and develop animosity against one another, then IRS officers may also
be posted to different states to handle the vigilance and personnel
branch as IAS officers also develop hatred and animosity against one
another while working in a particular cadre. In fact they work in much
smaller places, mostly in the same building of a state Secretariat,
interact more frequently than any IRS and are hence more prone to this
human weakness of hatred and animosity. The principal of unbiased administration
should not be limited to the CBEC and CBDT alone .

Disclosure of third party information without following the
procedure
Through an application filed under the Right to Information (RTI)
Act, a lady asked about the details regarding her husband's appointment
as a legal advisor in the Ministry of Health & Family Welfare,
his job responsibilities, last salary/remuneration drawn, family
particulars, etc. The Public Information Officer (PIO) requested
the legal advisor (Third Party) to submit his objections, if any,
in writing for disclosure of information within the meaning of
Section 11(1) of the RTI Act who submitted his objections stating
that the information sought should not be provided to the applicant.
In his reply, the PIO refused to provide the information u/s 8(1)(j)
holding it as personal information. On appeal by the applicant,
the First Appellate Authority (FAA) directed to provide the information.
The third party went in appeal against the order of the FAA to
the CIC which cautioned the FAA that the Rights of the third party
are as much important and fundamental as the right of an individual
to seek information. The due process prescribed in revealing third
party information ought to have been strictly followed and while
stepping into the place of the PIO, the FAA should have taken
due note of the process for revealing third party information,
as prescribed under the RTI Act, 2005. As the information was
already provided to the applicant, the CIC was unable to provide
any substantive relief to the appellant. However, the order of
the FAA was quashed and set aside and the CIC observed that this
fact may be taken note of during future litigation, between the
parties, by the concerned Court. Further, the CIC directed the
respondent public authority to provide adequate training to PIOs
& FAAs so that they can discharge their duties with greater
responsibility and do not commit such fatal errors that can change
the course of private litigation in favour of a particular party.
Comments
The FAA ought to provide reasonable time to the third party to
file an appeal before the CIC rather than providing the information
as the third party has too has rights under the RTI Act. Regarding
