a democratic world ,as in a democratic nation ,power must be linked
with responsibility, and obliged to defend and justify itself within
the framework of the general good.
Who finished Congress ?
Few intellectuals have a feeling that in reality the RTI finished the
Congress Party. And the reason attributed by the Congressmen for battering
the party received in the Lok Sabha election, it is the role played
by the Central Information Commission during Satyanand Mishra 's tenure
when RTI activists had a field day forcing a spate of disclosures on
scams which had been merely under wraps in UPA Government .

NBCC to build Rashtrapti Bhawan Museum

projects of diverse nature, all across the country and abroad but, it

and up-gradation of India's Heritage Buildings. To name a few, apart

Prime Minister 's approach towards non IAS engineering services
cadres
It is good that worthy PM has himself taken initiative to promote
non-IAS officers also.
There are many engineering services like Indian Telecom Services where
even 87 batch has not been promoted to SAG in the days in which telecom
and digital India is the talk of the town. Prime minister must make
a system where all Central services must be bring at par with IAS so
that they can deliver more effectively.
There is no doubt that Central services (engineering) or general are
delivering better than these IAS . It can be seen from the services
provided by state governments or by central government departments/PSU's.
Services of Central government departments /PSU's like Railways, BSNL
are far better than IAS run state government departments. However we
cannot compare BSNL or railways with private players as legacy of government
system do not allow them to deliver at that level. But still things
has scope for improvement if services conditions of other services are
also improved and officers are motivated.

Who would bell the cat ?
Installing GPS in all staff cars is a very good suggestion. But who
would bell the cat? It is common knowledge that official vehicles are
grossly misused by all officers right from Secretary to JS. IN some
ministries, regular drivers are made to sit without the staff car allotted
to them. Meanwhile, the staff cars are allotted to drivers who are recruited
on outsource basis. Because it is common knowledge that drivers so recruited
i.e. on outsource basis will not open their mouth. They get more amount
as OTA. Regular drivers would not toe the line of their officers. This
is being done by Financial Advisors in some ministries - who are supposed
to be a role model for such things - whose job it is to ensure that
Government money is not wasted. Is it that they do not know that regular
drivers are idle? Not believable. For all this, the officers claim that
they do not get transportation allowance. Instead, they make use of
the vehicle for more than 60 - 70,000 Rs a month. Use the staff cars
on Saturdays and Sundays and other national holidays also. If the OTA
and depreciation of the vehicle is also taken into account, the amount
is much more. Almost all officers who use staff car vehicles exceed
the stipulation of petrol laid down by Ministry of finance. No punishment
for them. I wish that PM Modi is apprised of this situation and some
stricter norms are laid down for these officers. The amount of excess
petrol (more than what is laid down by Ministry of Finance)should be
charged for from the pay of officers. They should give at least one
day off to the driver.
A Staff car Driver
Don't make service an issue
So let us not make service an issue. Real issue is that merit and
performance should not be ignored and there should be no premium or
incentive for dishonesty, demerit and non-performance...on the other
hand these should be condemned without hesitation.

Disclosure of third party information without following the
procedure
Through an application filed under the Right to Information (RTI)
Act, a lady asked about the details regarding her husband's appointment
as a legal advisor in the Ministry of Health & Family Welfare,
his job responsibilities, last salary/remuneration drawn, family
particulars, etc. The Public Information Officer (PIO) requested
the legal advisor (Third Party) to submit his objections, if any,
in writing for disclosure of information within the meaning of
Section 11(1) of the RTI Act who submitted his objections stating
that the information sought should not be provided to the applicant.
In his reply, the PIO refused to provide the information u/s 8(1)(j)
holding it as personal information. On appeal by the applicant,
the First Appellate Authority (FAA) directed to provide the information.
The third party went in appeal against the order of the FAA to
the CIC which cautioned the FAA that the Rights of the third party
are as much important and fundamental as the right of an individual
to seek information. The due process prescribed in revealing third
party information ought to have been strictly followed and while
stepping into the place of the PIO, the FAA should have taken
due note of the process for revealing third party information,
as prescribed under the RTI Act, 2005. As the information was
already provided to the applicant, the CIC was unable to provide
any substantive relief to the appellant. However, the order of
the FAA was quashed and set aside and the CIC observed that this
fact may be taken note of during future litigation, between the
parties, by the concerned Court. Further, the CIC directed the
respondent public authority to provide adequate training to PIOs
& FAAs so that they can discharge their duties with greater
responsibility and do not commit such fatal errors that can change
the course of private litigation in favour of a particular party.
Comments
The FAA ought to provide reasonable time to the third party to
file an appeal before the CIC rather than providing the information
as the third party has too has rights under the RTI Act. Regarding
