Why unreserved person treated as second rate?
Agreeing with Suresh Kumar, is belonging to un-reserved category render
you unsuitable for promotion on time ? Whereas juniors of reserved category
are given out of turn promotion, persons of unreserved category keep
on waiting to get promotion even after due time. Birth of person in
particular category is not in his hand. Sure reserved category needs
encouragement in securing jobs at initial stages, however giving this
advantage lifelong defies logic and constitutional rights. Why unreserved
person treated as second rate? I hope new government which talks of
merits would surely try to atleast do away this disadvantage in promotions.
The we talk of motivation or lack of it in Government servants. Will
somebody listen please ?

A wiser choice
Anil Swarup (IAS, UP 80) has been selected for the post of Coal Secretary.
A wiser choice could not have been made. Swarup is a brilliant, meticulous,
highly organised officer who can really get things done. As DG in Labour
and Chairman APEDA, he has already rendered yeoman service to the nation.
He will be a worthy successor to the present Coal Secretary, who is
also an outstanding officer.

Misused of Govt. Vehicles
Airport Authority of India is providing Government vehicles to many
organisations. AERA has taken 3 vehicles from AAI .Is any rule available

I agree with the views of a staff car driver. Government vehicles are
misused by Sr. officers for themselves. They use vehicles for own family
work. If they don't get government vehicles, hire private vehicle for
kids to leave and bring from school, tuition, shopping, etc.

Service matter issues
There is no point comparing other services with IAS. Those of you
grumbling against IAS must be clear in your mind that you are there
as you could not make it to IAS.We have not heard anybody making it
to IAS and leaving it join IRS or CUstoms and Excise. Rather many of
them took another chance to compete for IAS and if any of them could
make it , took it. That is the simple reality. Way back to 1972, The
Director of National Police Academy while addressing IPS Probationers
in their passing out parade at Mt. Abu told them that they were there
as they could not reach to IAS. It is only two out of thousand that
they get the job they like. Rest have to like the job they get. So rest
in peace and carry forward your life. If some one is better than IAS
but missed the bus well he can show his mettle where so ever he is.

Chairman of AERA (Autonomous Body of M/o Civil Aviation) retired in
July 2014. Why his entire staff (on Loan Basis from AAI) are retained
in AERA ? Wasn't it duty of Administration of AERA, send them back in
their Parent Cadre Post in AAI.

Disclosure of third party information without following the
procedure
Through an application filed under the Right to Information (RTI)
Act, a lady asked about the details regarding her husband's appointment
as a legal advisor in the Ministry of Health & Family Welfare,
his job responsibilities, last salary/remuneration drawn, family
particulars, etc. The Public Information Officer (PIO) requested
the legal advisor (Third Party) to submit his objections, if any,
in writing for disclosure of information within the meaning of
Section 11(1) of the RTI Act who submitted his objections stating
that the information sought should not be provided to the applicant.
In his reply, the PIO refused to provide the information u/s 8(1)(j)
holding it as personal information. On appeal by the applicant,
the First Appellate Authority (FAA) directed to provide the information.
The third party went in appeal against the order of the FAA to
the CIC which cautioned the FAA that the Rights of the third party
are as much important and fundamental as the right of an individual
to seek information. The due process prescribed in revealing third
party information ought to have been strictly followed and while
stepping into the place of the PIO, the FAA should have taken
due note of the process for revealing third party information,
as prescribed under the RTI Act, 2005. As the information was
already provided to the applicant, the CIC was unable to provide
any substantive relief to the appellant. However, the order of
the FAA was quashed and set aside and the CIC observed that this
fact may be taken note of during future litigation, between the
parties, by the concerned Court. Further, the CIC directed the
respondent public authority to provide adequate training to PIOs
& FAAs so that they can discharge their duties with greater
responsibility and do not commit such fatal errors that can change
the course of private litigation in favour of a particular party.
Comments
The FAA ought to provide reasonable time to the third party to
file an appeal before the CIC rather than providing the information
as the third party has too has rights under the RTI Act. Regarding
