There are two 1976 batch serving IPS officers. While Dilip Mitra of West Bengal cadre would retire on January 1, Assam Meghalaya cadre IPS officer Krishan Kulbir on February 1. Both the officers of 1976 batch are unlikely to figure in the panel following lack of experience in Vigilance. If present CBI Chief Ranjit Sinha is asked to continue till January 31, this batch will automatically eliminate.

As per media report (ET, Oct 28) after arrest of a PSU bank CMD by the CBI , the GoI has cancelled the appointment of 8 CMDs and 14 EDs of PSU banks. Modi's message is loud and clear : Bribery-based appointments have a cascading effect on corruption and the vicious circle has to be broken.


Under former ruling dispensations, appointment of CMDs and functional Directors in industrial units of public sector, were finalised by the political class after receiving kickbacks from the fixers, middlemen, touts, call them what you may. The going rates were different for Maha and Mini Ratnas- Incredibly high for Maharatna PSUs. The practice prevailed both under the erstwhile NDA and UPA regimes. Maha corrupt Congress-led UPA broke all records. As former Secretary, Public Enterprises Selection Board (PESB), I knew how posts were auctioned and how strings were pulled by builders' mafia and big business houses to fix their protégés. Retired bureaucrats manipulated their appointment as non-official part-time Directors by exercising political clout without having hands-on experience of PSUs.They merely enjoyed companies' perks without making contributions.

Interestingly, the Government plan to draw up a panel of professional chartered accountants who could work as part-time Directors in PSUs, was scuttled by the all powerful bureaucracy due to vested interests. This assurance was given by the then GOI after the infamous Sathyam scam. A former Cabinet Secretary and a Corporate Affairs Secretary, served as part-time Directors in the company ,soon after their retirements.

The CEOs of PSUs colluded with UPA ministers in looting the public exchequer. The present political class, I trust, can't be fooled under PM's watchful eyes.

Against this background, Modi sarkar is urged to take following steps on priority :--
(i)Review appointments of CMDs, Functional and non-Functional Directors of all Maharatnas covering UPA regime on lines of banking sector;
(ii) Carry out comprehensive performance audit of all Maharatnas through C&AG covering UPA regime;
(iii)Draw up a panel of professional Chartered Accountants, bankers and MBAs, train them to effectively serve as Non-official part Directors in PSUs
I assure you, Prime Minister Sir, this will not be an exercise in futility. Many skeletons will tumble out of the cupboards.

Addition and deletion of names in the agreed list

Applicant sought information as to how his name was put on the agreed list and how was it removed. The First Appellate Authority (FAA) directed the PIO to furnish relevant documents after duly suppressing the identity of complaint(s)/official(s). The Public Information Officer (PIO) filed an appeal against the FAA order. The Central Information Commission (CIC) observed that the Agreed List is admittedly a confidential information, rather a critically confidential information, held by the public authority in its role as a third party within the provisions of Section 124 of the Indian Evidence Act. The CIC held that confidentiality of the Agreed List is critical for the success of the management decisions about key assignments to its employees, lest for want of reflection on the background, character and conduct of specific officers, management hands over sensitive assignments into undeserving hands whose actions may be injurious both to the public authority as well as to the public interest. The CIC upheld the denial of information by the PIO.

Comments


In the case of Sudesh Kumar v. Customs & Central Excise in Appeal No.CIC/AT/A/2007/00229, the CIC had ruled that "Agreed List" are not disclosable. After a person's name has been deleted from the agreed list, there would be little ground to deny information to the concerned person.
