'Kaun banega CBI Director'? (5)
Until now, 1977 batch IPS officer of Odisha cadre Prakash Mishra was
topping the list of powerful contenders. Meanwhile, the Odisha Government
registered a case under Prevention of Corruption Act against him. But
now the Odisha High Court has set aside the hindrance caused to Mishra
for any future posting or promotion. Odisha Govt had lodged a vigilance
case against Mishra, former DGP Odisha, after he had joined the Govt
of India as Special Secretary Internal Secretary, MHA. The 1977 batch
IPS officer has now got a clean road ahead of Odisha cadre. A major
relief granted by the HC to Mishra has cleared his way for any future
posting or promotion. High Court orders comes as a relief to Mishra
as the Centre is set to meet to decide on the appointment of the next
CBI Chief.
Major joinings in PSUs in November
Around eight persons are expected to take over the charge on various
Boards of Public Sector Undertakings (PSUs) in the country on November
1, 2014.

Indian Revenue Service officer of Income Tax cadre, Horam Singh, presently

feel that the increasing number of BJP ruled states may prompt government's
decision in the direction.

It is reliably learnt that the proposal for cadre review of Indian Civil
Accounts Service (ICAS) is expected to reach the ACC in the first week
of November. The review was proposed five years ago.
No CVC meeting for CBI posts after Sept 25
Top level meetings for induction of IPS officers into CBI have not taken
place for over a month. The last meeting took place onSeptember 25 which
was earlier scheduled for September 10. Though CVC is running headless
but yet it makes many IPS officers apprensive over the seriousness for
filling up the posts encadred over IPS officers. Keep guessing the reasons
as BCAS has also been running headless for over a year.

Orders of Sahai for CMD, MRVC yet to come
The orders of Prabhat Sahai for the appointment as Chairman & Managing
Director, Mumbai Rail Vikas Corporation Limited (MRVC) are yet to be
issued by the Government of India as vacancy is arising on December
1, 2014 with the retirement of incumbent Rakesh Saksena on November
30, 2014.
Two persons get CVC clearance for MD, FSNL after 3 years
In what could be termed as a dilly-dallying process, the Ministry of
Steel is taking around three years for filling up the post of Managing
Director, Ferro Scrap Nigam Limited (FSNL) for want of Central Vigilance
Commission (CVC) clearance. Interestingly, K K Jain, GM, SAIL, was first
selected for this post by PESB on December 4, 2012, but his name was
struck off by the Ministry and it proposed second runner up at the PESB
meeting, Rajiv Bhattacharya, GM, FSNL. Due to tug-of-war between Jain
and Bhattacharya, CVC had been withholding clearance and now it has
reportedly given clearance both of them. The Appointments Committee
of Cabinet (ACC) will decide the fate of Jain and Bhattacharya for this
post.
Harihar also in the race of CMD, Air India
Whispers in the corridors of power have it that R Harihar, ED, Southern
Region is also in the race of CMD, Air India. Reportedly, he has charted
on the list of candidates to be interviewed for the post in the month
of November as internal candidate. The incumbent CMD, Rohit Nandan has
recently been given extension till August 2014 or till the new appointment
takes place.

Jt MD Air India Nasir may get extension
Whispers in the corridors of power have it proposal for extension to
Syed Nasir Ali has been moved. His deputation as Jt MD is scheduled
to end in the month of December 2014. If some top sources are to be
believed the proposal will be approved especially to accomplish the
critically important issue of integration of manpower arisen out of
merger of Indian Airlines & Air India. He is an IRS (IT) officer

After CVC clearance, proposal should reach ACC in 10 days
The Ministries have been told to forward the proposals of the candidates
to the Appointments Committee of Cabinet (ACC) within ten days after
CVC gives clearance to the selected candidates for the appointments
on board level in PSUs.

Mohan Kumar inaugurates Su-30 ROH Project
Stores at HAL Nashik (UPDATED)
Secretary Defence Production, G Mohan Kumar inaugurated Su-30 (MKI)
ROH Project Stores Facility at HAL Nashik. This is a big boost to HAL's
activities at Nashik considering that HAL has set up a facility for
ROH of 15 aircraft per annum at the division. HAL is one of the few
organisations in the world to have set-up ROH facilities for Su-30.
"This will provide full maintenance support and enhance the serviceability
of Su-30MKI fleet through-out its life-cycle. We are also making efforts
to indigenize parts required for this aircraft and make the country
self-reliant in this segment", said Dr R K Tyagi, Chairman, HAL
who accompanied the Secretary (DP). S Subrahmanyan, Managing Director
of MiG Complex was also present. Besides visiting the various production
and design facilities of the division, Mohan Kumar also visited HAL
airport at Ozar (about 20 km from Nashik and 200 km from Mumbai). The
airport has a runway to handle international flights with night landing
facility and has an apron for parking of six passenger aircraft. At
present private chartered planes land here. HAL plans Airline Operators'
Conference on November 14, 2014 in Nashik to promote commercial operations.
Earlier in the day, the Secretary DP reviewed the presentation made
by HAL on various on-going and present projects at Nashik. He stressed
on timely delivery, quality, customer satisfaction and cost reduction.

Time limit for CVC clearance
Fixing of time limit for giving Vigilance clearance by CVC is a welcome
step .CVC should also give reasons for denying vigilance clearance.

Hype over recovering black money - a real drama !
All this hype of recovering the black money stashed abroad is turning
out to be a real drama. The government is at a loss, how to go about
it. The Supreme court has virtually taken over the investigation. How
is it their function? That only relieves the Government of its responsibility.
How is SIT going to go about it is also puzzling. The list of 627 account
holders in HSBC in Switzerland came in the hands of Indian Government
through France who in turn got the list stolen by a disgruntled employee
of HSBC. All in the list may not be illegal account holders. Knowledgeable
persons say that the real storehouses of black money is not the established
and well-known banks like HSBC but sundry other private entities who
hold and manage the ill-gotten wealth of several characters around the
world. God knows how much money is stashed in numerous tax havens around
the world by our countrymen. The government has to find out from those
places-not an easy task or motivate people with some incentive to volunteer
this information about their holdings of black money. Again not an easy
task. It seems Government does not have a clue as to how to unearth
those lakhs of crores. In the meantime all of us are being taken for
a ride with the so-called list received from France now more than two
years ago.

Addition and deletion of names in the agreed list
Applicant sought information as to how his name was put on the
agreed list and how was it removed. The First Appellate Authority
(FAA) directed the PIO to furnish relevant documents after duly
suppressing the identity of complaint(s)/official(s). The Public
Information Officer (PIO) filed an appeal against the FAA order.
The Central Information Commission (CIC) observed that the Agreed
List is admittedly a confidential information, rather a critically
confidential information, held by the public authority in its
role as a third party within the provisions of Section 124 of
the Indian Evidence Act. The CIC held that confidentiality of
the Agreed List is critical for the success of the management
decisions about key assignments to its employees, lest for want
of reflection on the background, character and conduct of specific
officers, management hands over sensitive assignments into undeserving
hands whose actions may be injurious both to the public authority
as well as to the public interest. The CIC upheld the denial of
information by the PIO.
Comments
In the case of Sudesh Kumar v. Customs & Central Excise in
Appeal No.CIC/AT/A/2007/00229, the CIC had ruled that "Agreed
List" are not disclosable. After a person's name has been
deleted from the agreed list, there would be little ground to
deny information to the concerned person.
