SC dismisses Central Govt's SLP in favour of Rakesh Behari
Supreme Court of India has sparked off rays of hope for Rakesh Behari, a 1977 batch IAS officer of AGMUT cadre, by dismissing the SLP filed by the Central Govt. In its fresh verdict SC refused to interfere with the order of Delhi High Court (dated 23 May 2013) which had directed the Central Government to empanel him as Secretary to Govt. of India with effect from June 2010. Prior to the Delhi HC orders CAT's observations had testified the deliberate suppression of some of his service records at the time of empanelment of IAS officers of 1977 batch in June 2010. Unfortunately, Delhi HC orders had come only a week before his retirement last year. Supreme Court's fresh orders spark off hope for Behari. Theoretically a senior most officer of GoI finally gets justice but yet to be seen as what kind of compensation he would get practically.

BSE upgrades its trading platform to Bolt Plus (UPDATED)
BSE has changed its trading system to the new trading system acquired from Deutsche Boerse from April 7, 2014 on its Equity segment. Earlier, BSE had already implemented this system for currency derivatives on November 28, 2013, Interest Rate Futures on January 28, 2014, and Equity derivatives on February 10, 2014.The New Trading System is currently providing 200 micro seconds response time with a through put capacity of 5,00,000 orders per second. It is faster than any exchange in India by at least 10 times with through put capacity also higher by similar numbers. Despite the increase in speed, BSE doesn't intend to provide preferential treatment to members having co-location servers. This is the largest ever technology transformation in India ever attempted where more than 900 broker members with more than 1 lakh branches have experienced the new trading system of BSE. By extension, several lakh users have been able to experience the new trading system. More than 50 vendors participated in this mammoth exercise over a period of 6 months to ensure a smooth transition for members and users. Internationally, this is one of the smoothest technology transfer that has taken place. Most exchanges in India have not attempted technology change due to the apprehension that it may not work out. BSE had taken a call to implement new technology 2 years back and has successfully implemented this technology transfer. Over the first 2 days of trading, more than 900 members have traded on this system which is close to the peak number of members we get on the BSE platform. Similarly, more than 13.66 crore orders were entered in the new system which works out to more than 6,000 orders per second on average basis through out the day. Peak order entry observed was more than 16,000 orders per second. Such high peak rates on the second day of technology implementation were beyond expectations and suggest an excellent adoption of new technology by all market participants.

DATE WITH RTI

Ground for seeking transfer

A query was raised in the RTI application seeking information relating to transfer application of employees. The Public Information Officer (PIO) denied the information under section 8(1)(j) as third parties had objected to disclosure. The Central Information Commission (CIC) observed that in the absence of any larger public interest, the information is not to be disclosed.

Comments

An order of Transfer or posting is an administrative order and is liable to be disclosed suo-motu by the public authority. An employee may seek transfer on personal or official reasons and as per section 4(1)(d), every public authority shall provide reasons for its administrative or quasi-judicial decisions to affected persons. However, the CIC has held that the specific ground for transfer is personal in nature and is not liable to be disclosed.
