Strange ways of AFHQ
Not many esteemed readers of site will be aware of the existence of
an organization in GoI where rules/orders and legal advices are not
to be bothered about and the show is run by a handful of Group 'B' service
officers. The affected individuals range over 12,000 (twelve thousand)
in various grades.
Yes, the organization is Armed Forces Headquarters (AFHQ). The cadre
controlling authority is JS (Trg) & Chief Administrative Officer,
who, to everybody's dismay, is an IAS officer. Though for name-sake
the cadre controlling authority is the JS, the show is run by the Group
'B' service officers known as AFHQ civil service. The real cadre controlling
authority is merely enjoying the position and perks (two full-time staff
cars among them) and doesn't apply his own mind to issues. He is briefed
by the lower level officers and he is ever ready to accept their take
on everything. The further higher-ups in the Ministry of Defence (Addl
Secretary and above) have their own fire-fighting to do and do not care
for these mundane affairs at all. The result is that the career management
of thousands of civilian employees in the three Service HQs and inter-service
organizations is at the mercy of the AFHQ officers. The affected people,
if they complain, are told that if they have a grievance they can go
to court. Thereby, the employees are made to seek legal recourse by
spending their own money (creating extra burden on the already overburdened
courts) whereas the Legal Dept is made to defend court cases which are
silly in nature and unwarranted. The guidelines of the DOPT etc to ensure
speedy justice to the employees in order to avoid such instances are
seldom adhered to.
In addition to various govt letters on the subject, successive pay
commissions have established the parity of these employees with those
in the central secretariat services. They are recruited by UPSC/SSC
through the same exam, in the same manner, and at the time of entry
into service they are equal. But due to various wrong interpretations
and changes made to the recruitment rules etc., they are always at a
disadvantage.
I will cite two cases:
(i) UPSC conducts Limited Departmental Competitive Examination (LDCE)
for promotion to the post of Section Officer/Private Secretary. In the
central secretariat service, those who qualify the exam are offered
promotion/posting on their turn and their approved service is counted
from the year of exam (perhaps 01 July of the year of exam). In the
AFHQ, the approved service is counted from the next year in the case
of Section Officers and after two years in the case of Private Secretaries.
Thus, one who has given the LDCE in 2005 got seniority of Jul 2005 in
Central Secretariat whereas in AFHQ it is July 2006 for SOs and July
2007 for PSs.
The most important point to be noted is that all the above individuals
appeared for the same exam on the same dates. Nowhere is it mentioned
at the time of calling for applications/UPSC notification about this
disparity.
The reason given is that the exam is conducted for the forthcoming vacancies
in the next years. There is no record of any such decision taken by
any authority at any time.
The affected Section officers went to the CAT which has given an order
in their favour. Now, instead of implementing the same, even at this
belated stage, the office is going to the High Court against the CAT
order. They have even told the affected SOs that if need be they will
go even to the Supreme Court. Now ponder over one point. The employees
spent their own money and fight the case. But, these group 'B' service
officers have to do nothing. They utilize the govt legal system to fight
the govt's own employees. The courts do not give any order as to the
costs. Unless the responsibility is fixed on the wrong doers by the
courts and they are made to pay penalty with interest, such miss-governance
will never come to an end.
(ii) Now, the plight of Private Secretaries. PSs from the 1992 batch
onwards are sufferers. As the approved service is counted two years
late, they are given Non-Functional Scale of Grade Pay of Rs.5,400/-
two years late, leading to financial hardships. After various representations
and a number of references to the DOPT, the DOPT gave clarification
in favour of the PSs. The Ministry of Law & Justice (Dept of Legal
Affairs) also strongly advocated their concern against avoidable court
cases and recommended counting of approved service from July 1 of the
year of exam. But, even after two years, nobody is doing anything. The
powers that be are challenging the affected employees to go to court.
It is highly demoralizing for the honest employees when a handful of
vested interests are left to manipulate the career of so many of them.

Ground for seeking transfer
A query was raised in the RTI application seeking information
relating to transfer application of employees. The Public Information
Officer (PIO) denied the information under section 8(1)(j) as
third parties had objected to disclosure. The Central Information
Commission (CIC) observed that in the absence of any larger public
interest, the information is not to be disclosed.
Comments
An order of Transfer or posting is an administrative order and
is liable to be disclosed suo-motu by the public authority. An
employee may seek transfer on personal or official reasons and
as per section 4(1)(d), every public authority shall provide reasons
for its administrative or quasi-judicial decisions to affected
persons. However, the CIC has held that the specific ground for
transfer is personal in nature and is not liable to be disclosed.
