Prime Minister by Sanjaya Baru & Crusader or Conspirator ? of PC
Parakh.
The Prime Minister Dr. Manmohan Singh's former Media Adviser Sanjay
Baru while narrating about the events that occurred during the run-up
to his reappointment (which finally did not come) in June 2009 has mentioned,
in his book The Accidental Prime Minister - about whispersinthecorridors
( on Pg. 267) saying - "A few days later whispersinthecorridors.com
reported that I would be returning to the PMO".
Similarly, former Coal Secretary PC Parakh has in his book 'Crusader
or Conspirator ?' , on Pg 142, mentioned about a report which appeared
in the whispersinthecorridors.com on March 2, 2005. The report is related
to repatriation of Parakh to his parent Andhra Pradesh cadre when the
then Coal Secretary, according to him, was not getting full political
support of his ministers and the PM was also finding himself helpless
in coming to the rescue of the 1969 batch IAS officer because he (Dr.
Manmohan Singh) required the support of the said ministers to run his
coalition government.
This speaks about the credibility that whispersinthecorridors has earned
over a period of time and how much authentic its reports are in the
opinion of the 'decision makers' of the country

Case of CBI posting on May 9
Mr Vineet Narain's petition came up for hearing before CJI's bench on
April 28. Though notice to respondents had not been issued, KK Venugopal,
Counsel for Narain pressed for a stay on posting of Archana Ramasundaram
to CBI. The Bench refused to stay and directed to issue notice to respondents
and posted to May9.

New Government to post ME, Railway Board?
The battle for the post of Member Engineering Railway Board has become
stronger. While the stronger contender being the blue eyed boy of Pawan
Bansal wants the appointment to be finalized before Modi government
takes oath, the weaker contender posted in Kolkata wants the appointment
to be fair and transparent and therefore wants the new government to
finalize the same. It would be interesting to wait and watch who wins.

Central Vigilance Commission (CVC) for its clearance over one year.
Meanwhile, his panel was validated for more six months as CVC has neither
denied his appointment nor given clearance. The post has been lying

HAL sets up a faculty chair at IIT Kharagpur
(UPDATED)
In a novel initiative to conduct applied research and tackle multi-disciplinary
problems in the field of aerospace technology and its applications,
HAL has entered into collaboration with IIT Kharagpur to set up a Faculty
Chair here. The Chair will be set up at the department of Aerospace
Engineering. "Our intention is to promote R&D and academic
work in new and emerging technologies in aerospace industry focusing
in the field of radar, electronic warfare, avionics and aerospace systems.
A strong research base already exists at IIT, Kharagpur, in the areas
of direct relevance to the future programmes of HAL and this tie-up
will be mutually beneficial", said Dr R K Tyagi, Chairman, HAL.
The MoU was signed by Dr Pratha Pratim Chakrabarti, Director (IIT, Kharagpur)
and Ms S Thenmozhi, General Manager, HAL. The HAL Chair will be responsible
for carrying out research in various areas related to aerospace technologies,
facilitating technical consultancy, training programs and addressing
other mutually agreed activities relevant to the HAL. IIT-KGP will appoint
a distinguished academician from the relevant branch of engineering
as the Chair Professor for a period of three years. The HAL Chair will
also initiate new academic / training programs; identify and initiate
specific research & development at IIT-KGP in the specific technical
areas, provide technical consultancy to HAL, facilitate development
of training programs and training modules including mentoring/ coaching
of HAL personnel for knowledge updation and capacity building

Downgrading of ACRs without recording reasons - Litigations
Long ago it was settled by Hon'ble Supreme Court in the case of U.P.
Jal Nigam & Others vs Prabhat Chandra Jain & Others(1996 AIR
1661, 1996 SCC (2) 363) that downgrading of ACR can be made only after
recording reasons. Still many reviewing officers are routinely downgrading
ACRs without giving any reasons and many times appellate authorities
are rejecting the petitions of the govt. servants disregarding Article
141 of the Constitution that the law declared by the Hon'ble Supreme
Court is binding on all the courts within the territory of India. This
is resulting in avoidable litigations. Many cases are still pending
for long before various Benches of Hon'ble CAT.
It will be real honour by the government to Supreme Court, if it suo
motto issues a circular expunging all unreasoned downgraded ACRs in
the interest of justice. It will reduce cost of litigation of the govt.
also, besides reducing of redundant pendency of covered matters before
various forums. The Supreme Court should also intervene in this matter
and issue directives to sub-ordinate courts to decide such cases in
one hearing.

Sonia Gandhi ruled by proxy !
Why Sonia Gandhi refused to become PM, is not at all difficult to understand.
She wanted to run the Government from behind the curtain and succeeded
too. Things happened the way she wanted. It is she who ruled the country
for 10 years. Who did not know this. Perhaps not Sanjay Baru who had
to write a book. Betrayed confidence posed in him. But no apparent ground
or proof to have any doubts about Sonia Gandhi No doubt, leaders in
all parties are promoting their kin. Again credit and thanks should
go to Nehru-Gandhi family for providing the lead. But do not despair.
Future is bright. Belated thanks to Atalji and to Mamata Banerjee, Navin
Patnaik, Mayavati, J Lalita, Narendra Modi, as far as I know. BJP too
is over blowing Vadra matter. They are making so much noise as if Vadra
is the only issue in this country. If you are aspiring to form Government,
be decent. Mind these over reactions do not impress anyone much less
BJP supporters quite many among whom are middle class educated people
These only give ready made fodder to media which is having a field day.
Even media houses should give royalty to politicians of this without
whom they would have been out of business long back.

Why is there a Modi wave in the country, if at all?
Simple. The Congress has floundered in governance. Its score card is
blackened by the scams its partners in the UPA carried out and inflation.
Even today, in this country, while there are misgivings about Mr Modi
in some quarters and affection for the Gandhi family in most, the scams
and inflation have sealed the fate of the party. The party will soon
have to get over its wily strategists also who have played in Mr Modi's
hands by excessive harping on the communal vs secular debate.

Tolerance for corruption?
As per media report, DoPT has issued a circular that a employee facing
probe or penalty over corruption charges will be considered for promotion
in DPC. What will be the role of organizations like UPSC, CVC, CBI after
this circular? Normally for Senior officers, DPC is chaired by the Member
or Chairman of UPSC. Has concurrence been obtained before such circular?
CBI normally investigate charges of corruption under the guidance of
CVC and clearance for deputation to other departments or abroad or for
DPC is required before consideration of names. Similarly for Board level
appointments in PSUs are also done after vigilance clearance from CBI/CVC.
After issue of such circular whether such clearance will be needed for
appearing in the interview? They will take plea this is not required
as it will not debar the employee from appearing in interview or getting
an appointment. After framing charges, the case goes to court which
is long drawn process and outcome may be or may not be in favour of
employee. How things will be handled? Is Govt. not working for zero
tolerance for corruption? It is not clear the purpose of issue of such
circular. DOPT says it has authority to make rules and procedures for
DPC. Nobody questions the authority but the purpose should be clear.
How honesty and integrity will be rewarded in Govt. sector? Will UPSC
analyze the impact of circular in DPC and write back to DOPT for consideration.

"Blatant corruption in CGHS hospital in Delhi."
My visit to Urology deptt of RML hospital, Delhi revealed open misuse
of discretionary powers by doctors. One doctor carries out perfunctory
examination of patients and advises several pathological tests . The
technician of a private diagnostic laboratory , sitting in the same
chamber , collects the sample of blood on the spot along with photocopies
of CGHS card and prescription. The cost of tests is calculated and a
suitable cut earmarked for doctor. Similar malpractices have been going
on in other departments. These hurt senior citizens who are CGHS beneficiaries.

Accessing priced publications under the RTI Act
The appellant filed an application under the RTI Act seeking copy
of all printed publications, published by National Library Kolkata
since its formation, along with a soft copy of all publications
in CD. The Public Information Officer (PIO) informed that it could
be supplied against payment of their cost price along with the
requisite postal charges. The appellant claimed that he is below
poverty line in view of his confinement in jail since 2006 and
demanded that the information should be supplied free of cost.
The Central Information Commission (CIC) ruled that the publications
sought by the Appellant cannot be regarded as information 'held
by' or 'under the control of' the public authority.
Comments
Unless an information is exclusively held and controlled by a
public authority, that information cannot be said to be an information
accessible under the RTI Act. In many orders, the CIC has ruled
that once an information is brought into the public domain by
means of a priced publication sold through book stores, the said
information cannot be said to be 'held by' or 'under the control
of' the PIO and would cease to be an information accessible under
the RTI Act.
