IAF, HAL to work on joint plans (UPDATED)

The Indian Air Force and HAL have decided to work on joint plans on various fronts for better understanding of issues so that both contribute effectively in India's defence preparedness. The entire board of HAL and senior officials flew down from Bangalore to interact with the top commanders of IAF at the conference held at the Air Headquarters (Vayu Bhavan) in New Delhi yesterday. "Hand-holding is important considering the challenges involved in manufacturing and operational fronts", said the Chief of the Air Staff Air Chief Marshal, Arup Raha . On his part, HAL Chairman, Dr R K Tyagi, mooted the idea of putting up single group or team to deal with foreign OEMs on all matters as these OEMs work with Air Force, Army, Navy and other multiple Government agencies. "Normally these OEMs work with two or more agencies. There is greater cohesion, understanding and mutual benefits when these OEMs are dealt from one platform", he said. Senior IAF, MoD and HAL officials took part in the performance review with focus on challenges related to several fleets such as MiG (21, 27, 29), Su-30 MKI, Mirage, Jaguar, Hawk, Kiran, Pilatus, Avro, Dornier, Chetak/Cheetah and Cheetal, ALH, RPA, Lakshya, etc. HAL supports 80% of the IAF inventory. The discussions also focused on indigenisation, quality and delivery timelines that are often demanding due to factors related to supply chain, transfer of technology and shortage of skilled manpower in the aviation/aerospace sector.

Give teeth to CAT judgments


While on CAT ,Yes, there is a need to give teeth to its judgments. As of now the Government Departments flout their orders by filing writ petition in High court where cases are not heard for years and justice given by CAT is denied to employees. A classic case by way of example, is from Railways where maliciously the seniority of several batches of group A services like IRAS,IRTS was changed in total violation of rules. Several officers went to Central Administrative Tribunal. In one case The Division Bench of CAT gave judgement in favour of the Petioners in 1999.Railways filed a Writ Petition in the High Court. In another case the full Bench of CAT also held the action of the Railways in manipulating the Seniority of the officers based on merit list of UPSC after years of their joining service as illegal and ordered restoration of original seniority. Here too Railways filed a writ petition. More than 12 years down the line the cases have been pending in High Court . Departments resort to such tricks in subverting CAT judgments .As a matter of fact Supreme Court foiled the original objective of establishment of Central Administrative Tribunals in restoring the appellate jurisdiction of the High Courts which the original Act had rightly excluded as the purpose of setting up of CAT was to free the overburdened high courts from administrative cases as also to expedite such cases. As of now Government employees have to wait for years for redressal of their legal grievances.CAT has failed to serve the objective for which the same was set up. Why not abolish and save expenditure on its huge set up with branches all over the country.

Implement Court decisions fast

I agree with the views, Court decisions must be implemented fast. Action against Head of Department is necessary. Apart from this most of the people especially Government servants may not be aware that if there is a time frame given by the Honble court, one can approach the court (simple letter with copy of judgement) for contempt of court orders and also claim compensation for harassment too.

Is information about dependency of a government employee personal?

The appellant wanted to know whether a particular government employee has shown her parents to be dependent on her and what benefits she has availed for her parents. He further asked whether the government employee was on leave on a particular date and if so, whether she was on out station leave and the station to which she had gone. The information was denied as being personal information which is exempt from disclosure under section 8(1)(j) of the RTI Act. The Central Information Commission (CIC) held that information about dependency is not personal. The CIC observed that leave information cannot be termed as personal information and directed to provide the same. Further, the CIC held that whether she was on out station leave on the date and the name of the station is personal information and need not be disclosed.

Comments

On the basis of information about dependency, an employee claims certain benefits like LTC, and medical benefits. Therefore, information about dependency which has been made by a government employee to obtain benefits is not a personal information. Whether a government employee is on leave is not personal information, but the name of the station where the employee went on a holiday is personal.
