Only a strong opposition can ensure effective governance ?

Some critically important appointments have one again underlined the significance of political principle which advocates that 'only a strong opposition can ensure effectiveness of a strong government'. The appointment of Chief Information Commissioner could not take place due to the absence of Leader of Opposition. Same situation is expected in the appointment of Chief Vigilance Commissioner. In a way, these appointments are constitutional obligation of an elected government. Ironically, the mighty Modi-govt is unable to fulfill the obligation in present scenario. Modi must be realising that a strong opposition and effective institutions like CIC, CVC are pre-conditions of effective governance.

As many as nine IPS officers are retiring in August, 2014. The officers are: Jasti Venkata Ramudu of Andhra Pradesh cadre; Rajinder Singh of Gujarat cadre; Tsering Punchok and Avtar Singh Bali of Jammu & Kashmir cadre; R K Choudhary of Madhya Pradesh cadre; Madhu Sudan Singh and Nisar Ahmed Farooqui of Rajasthan cadre; S Bhaskaran of Tamil Nadu cadre and Chanchal Kumar Dutta of West Bengal cadre.

Ramanujam to head committee
Prime Minister Narendra Modi has set up a Committee to be headed by R Ramanujam to review, identify and recommend amendment in obsolete laws to further smoothen and simplify the governance. The 1979 batch IAS officer of Madhya Pradesh cadre Ramanujam is presently Secretary to the Prime Minister.

Search for new Director, ED yet to take-off
Whispers in the corridors of power have it that search & appointment process for the coveted slot of Director, Enforcement Directorate is yet to take off. ACC cannot initiate the appointment process until the previous selection (of Anjuli Chhib Duggal) is cancelled. Reportedly, ACC is all set to initiate the cancellation of previous appointments. The post has fallen vacant after the appointment of Rajan Katcoh as Secretary, Department of Heavy Industries but he has been mandated to carry the additional charge for next six months or till the new appointment takes place.

Reddy to be DDG NIRD ?
W R Reddy is likely to be appointed DDG, National Institute of Rural Development (NIRD), Hyderabad. He is 1986 batch IAS officer of Kerala cadre.

Will Justice Singh be CJ of Meghalaya HC ?

Administrative Judge in Lucknow Justice Umanath Singh is likely to be elevated as Chief Justice of the Meghalaya High Court.

CIC to remain headless till LoP is recognised

Appointment of new Chief Information Commissioner will remain on hold till the Leader of Opposition is recognised. Rajiv Mathur, the sixth Chief Information Commissioner, demitted office on August 22 but the slot is yet to be filled with a new CIC. There is no provision in the RTI Act about handing over the charge to any Info Commissioner. Presently CIC comprises seven Information Commissioners.

NTPC honors employees (UPDATED)

"As a gesture of recognition of continuous service rendered by its employees, NTPC Corporate Centre organised the Long Service Award ceremony in New Delhi, Dr Arup Roy Choudhury CMD, NTPC and Directors of the company awarded 296 employees for their long and meritorious service. Are the Doctors in Pvt hospitals less competent ?

Why the government feels that unless the doctors in government hospitals refer a pensioner to a particular test/hospital, he should not directly go to CGHS approved hospital. Does the government thinks that the doctors in Pvt hospitals are less competent. It is everybody's experience that the ground situation is otherwise.

After SC verdict, will present CVC resign ?

In view of Supreme Court's judgement holding allocation of coal blocks since 1992 as illegal, it remains to be seen whether present CVC Pradeep Kumar, who in his capacity as Addl/Special Secretary in Ministry of Coal had made coal allocations, during relevant period will tender his resignation or cling to his post unless sacked. I have the details of coal allotments recommended by him obtained under RTI Act .

Raw marks scored by an unsuccessful candidate in Civil Services (Mains)

The appellant asked for scores in some of the papers of Civil Services Exam 2011. The Public Information Officer (PIO) informed appellant that as per rules of Civil Services (Main) Examination 2011, "papers on Essay, General Studies and optional subjects of only such candidates will be taken cognizance of as attained such minimum standards as may be fixed by the Commission at their discretion for the qualifying papers on Indian languages and English and therefore the marks in Essay, General Studies and Optional Subjects will not be disclosed to those candidates who fail to obtain such minimum qualifying standards in Indian language and English paper". As the appellant had failed to attain minimum qualifying marks in Hindi, his papers in Essay, General Studies and Optional Subjects have not been taken cognizance of. The PIO submitted during the hearing before the CIC that the information being sought was denied in terms of the gazette notification issued by the government of India on Feb 23, 2011 for the Civil Services Exam 2011, which clearly stipulates that if a candidate fails to obtain minimum qualifying marks in Indian language paper, marks in respect of other papers will not be disclosed to the candidate. It was further submitted that the information being sought has not attained final shape as the marks are neither tabulated nor moderated. The CIC directed the PIO to provide the information sought by the appellant. The CIC added that the Public authority is free to clarify that these are raw marks and have not been moderated.

Comments

As per Section 22 of the RTI Act, the provisions of RTI Act shall have effect notwithstanding anything inconsistent therewith contained in the Official Secrets Act and any other law for the time being in force. Hence, the sections of the RTI Act alone can be used to deny information.
