DEBATE (1)

AAP appears to be rewriting the Constitution of India, as her recent actions amply suggest. Their Jan Lokpal Bill has already hit a road block.

Now, let us pay attention to the much talked about Mohalla Samiti legislation!

Perhaps we all remember the 74th Amendment to the Constitution, which has been inserted, as PART IXA - Municipalities in the Constitution w.e.f. 1st June, 1993.

Articles 243P to 243ZG are inserted. They make an interesting reading. Delhi has Municipal Administration in accordance with provisions of Article 243Q. The Corporation has been organised into Wards.

Article 243S provides for constitution of Ward Committees consisting of one or more wards. The State Government may make provisions by LAW WITH RESPECT TO constitution and the manner of filling up of seats in the ward committees.

Article 243W empowers the State Government to endow municipalities with various powers and responsibilities in order to enable them to function as institutions of self-government with respect to planning for economic development and social justice in relation to matters listed in the 12th schedule etc.

As per Article 243ZB, provisions of Part IXA apply to Union Territories as well. Finally, the Part also provides, as Article 243ZE, Committee for Metropolitan Planning.

To sum it up, Constitution provides for distinct separation of powers and responsibilities for the State and Local Self Governments. The Concept of Mohalla Samitis may affect the existing constitutional arrangement, therefore creating another constitutional storming the TEA CUP called DELHI!

50 Golden Years of Seeding corruption in India !

What a coincidence? The CVC celebrates this year the Golden Jubilee and I recall it as the golden jubilee of the Kamraj Plan.As any idealistic young, I also bought the dream of a corruption free India, an India of a transparent public service government in the coming years. What we have achieved is a vigorous anti-corruption movement against corruption under the leadership of as ordinary an Indian as Anna Hazare. Jawahar Lal Nehru then had shown the guts to take on the mightiest political leaders in power in his party governments and organization. I still remember the dozens of articles in newspapers about Pratap Singh Kairon, Chief Minister of Punjab. That cleansing operation looked like the last one before the onset of a kind of Ramrajya or Indian Utopia. Anna led movement once again ignited that hope after the unsung demise of several other attempts like the naxal or JP movements. That the AAP was delivered by the movement to hold out some concrete promise has not yet passed the test successfully. The reason is that corruption has beeb seeded in India in every single inch of government dispensation and private sector that nobody, not even the Almighty, can disinfect the country of this infection. Even the noble professions have suffered value erosion irreparably.Proxy school teachers or para-medical staff , group A,B,C,D staff elsewhere, public transport drivers/conductors, fake rail tickets, FICN, fake admissions, fake interviews etc all are practiced openly. Idealism makes the inexperienced fal for illusions like the whistleblower and other laws and get killed like Dubey. We are still being fed on passing of laws- mere laws- like Lokpal and celebrations of the Golden Jubilee of Vigilance. We bemoan celebrating the GJ of seeding corruption exponentially and becoming one of the Top Corrupt Nations of the world. What a tribute that the CVC organized Golden Jubilee is being inaugurated by none other than the Prime Minister Dr. Manmohan Singh Ji!

No IRS with Delhi CM

It is wrong to say that the CM Delhi has not picked up IRS for key assignments. Some of the IAS now hand picked have served in IRS earlier before being elevated to IAS. Also to get IRS into Delhi administration, the CM requires central nod. Perhaps CM himself being an ex-IRS man, another one may not be required. Let there be one IRS per State.

Shari

Comical

It was comical to read the remark about Kejriwal's list not containing any IRS name. IRS is not administrative service of Delhi! IRS has its share of good, bad and the ugly as any other services.

Krishnan

No IRS men though

Strangely in the list of trusted lieutenants of Kejriwal, none of his former service mates from IRS find place.

DATE WITH RTI

Nomination of Sachin Tendulkar to the Rajya Sabha

Information about Rajya Sabha nominations was denied by the Public Information Officer (PIO) on the plea that these did not come under the purview of section 2(f) of the RTI Act. The appellant contended that he only sought to know who had proposed the name of Shri Sachin Tendulkar for membership of the Rajya Sabha; and whether any other names were proposed for the same purpose. The PIO submitted that the appellant has filed various RTI applications and before coming for hearing, they were not sure about the points being raised in the present case. The Central Information Commission (CIC) directed the respondent to provide the information to the appellant as available within 30 days of the order.

Comments

There are many cases where an applicant files a number of applications on a similar issue. The public authority must have a system in place to keep track of the applications on an individual basis so that the decision of the PIO can be defended in a proper manner before the CIC.
