The latest precedence of extension to CMD, BHEL and latest move proposing
extension to CMD, ONGC have together accelerated the speculations over
R S Butola's fate. R S Butola's term as CMD, Indian Oil Corporation
Ltd is coming to an end in May this year. Reportedly, PMO has started
giving thoughts to override the selection of B Ashok (ED, IOCL), a PESB's
pick as the next CMD of IOCL. One can wait and watch only?

Selection meetings for the post of Director (Tech) Eastern Coalfields
Ltd would take place on January 20. PESB would hold the interview and

Ministry dissuaded from overlooking a PESB selection
A Ministry, which was trying to overlook the selection of a person at
CMD level by PESB and considering to open an envelope of second positioned
candidate at the interview, has been dissuaded by the Department of
Personnel and Training (DoPT) guide-lining that a PESB recommended panel
can be scrapped only with the approval of the ACC not by the Ministry
itself.

head Commission of Inquiry pertaining to Gujarat case.

Skandan repatriated to Tamil Nadu
K Skandan has been repatriated to Tamil Nadu after completing seven
years term on central deputation. The 1982 batch Tamil Nadu cadre IAS
officer had joined GoI on central deputation in January 2007 as Joint
Secretary, MHA. The charge of Additional Secretary (Centre & State)
has now been given to Rajiv Sharma.

AAP has started with blot in their face for taking support from Congress.
It was presumed that AAP will stand its own to proof his honesty and
dedication towards common man but failed to do so. There was no need
to take support from Congress in Delhi whether Govt. is formed or not.
This will give an idea, in future AAP will also work in the same way
like other parties and more so inclined towards Congress against which
they started their movement. Public is completely disgusted with such
move and AAP will be affected in long term.

" Seven Sisters' demand for a common Time Zone, is misplaced ?"
Tarun Gogoi 's recent demand for another time zone for Assam and other
North-eastern states of India, is fallacious. Creating more time zones
will rob the country of its psychological sense of identity. Having
another time zone for North and North-east India, will result in chaos.
No wonder, Jammu & Kashmir could also revive its demand for an exclusive
time zone. This could open a pandora's box of demands from other regions.
India's neighbours: Pakistan, Myanmar, Bangla Desh have all got single
time zone. China, much larger geographically than India, follows a uniform
standard time. Srilanka follows the IST as its standard time.
In this nuclear age of supersonic ballistic missiles, having more than
one time zone in India, could adversely impact military operations by
hampering receiving unified commands at same point of time during war.
A standard time for the armed forces across the country, is of the essence
for strategic and efficiency reasons. Against this backdrop, the existing
practice of 'advancing the clock', synchronizing with IST indicated
by the Akashwani and Doordarshan, must continue. One hopes the Central
government takes a holistic view in the matter by keeping the Indian
Armed Forces, MOD, defence strategists , DoNER, DST,MEA in the loop.

be prepared for working to earn livelihood.

Jose, a retired Additional Secretary made a comment that there are 10
countries in the world which have no Income Tax. Can he name one significant
country in it? He need not be worried about what the IRS Officers do
if they lose their jobs. But he should first think about himself. What
he will do if he loses his pension. Without Income Tax, how the government
will pay pension for him?

Delay caused without any malafide intention is not liable
for penalty
Information about evasion of Customs duty and of fraudulent obtaining
by NITCO Tiles was denied by the PIO after checking from the deemed
PIO that the ECA II section of DGFT does not hold the information.
The FAA responded that the information sought required sincere
extensive search of the old records and consultation with other
sections which caused delay and hence, the reply could not be
given by the PIO within the stipulated time period of 30 days.
The appellant argued that if the information was not held by ECAII
Section, the PIO could have obtained it from the concerned section
of the DGFT u/s 5(4) of the RTI Act instead of denying the same.
The PIO clarified that he had sought the assistance of the concerned
section i.e. EPC section of the DGFT and that the reply received
from them was communicated to the Appellant. The CIC observed
that the PIO should have made it clear in his reply that the information
(being communicated to the Appellant) has been obtained from the
concerned section of the public authority (DGFT) and that the
same may be treated the information on behalf of the public authority.
The PIO's statement that information is not available with ECAII
Section gives impression that reply is being provided only on
behalf of ECAII section and not on behalf of DGFT. The PIO was
cautioned to be more careful in future in this regard. The CIC
directed the PIO to file an affidavit affirming his statement
that the letters mentioned in the RTI application are not available
with DGFT. Further, holding that the delay has already been explained
by the Appellate Authority in his order, no penalty was imposed
on the PIO.
Comments
If there is any inadvertent delay, the PIO should write to the
applicant informing him of the circumstances and provide the information
free of cost subsequently.
