Sizing of Indian Embassies abroad

There is a strong case for correct sizing of Indian Embassies abroad. With the advent of IT and Indians adopting it, where is the need for physical presence of a heavy contingent of ancient age Clerks abroad. This can be done sitting in India, in fact, with more efficiency. Only one and I underline only one person is enough to coordinate with corresponding Administrative Section(s)in MEA in India. Of course, proper strength of professional services like direct IFS, IPS, Defence, Railways, Space, Tourism, Culture etc with minimum supporting staff should be there to pursue Indian interests. The Clerks are not required to put road blocks in professional endeavours and enjoying higher foreign allowances (than professionals working independently outside the purview of Embassy), tax free scotch, cigarettes, petrol etc. and for enjoying that hefty Representational Grant and Servant allowance. The tax payers pay this money by living without electricity and adequate water. About 50% Indians live without toilets in their huts. Why no review ? Just because they are organised ......!

Injustice to Deputy Secretary level officers by govt


Since the level of responsibility, duties and powers for Deputy Secretary and Director level officers in Govt. of India are the same and both these posts are interchangeable depending upon the seniority of the officer concerned, there used to be a total difference of only Rs.2300/- between the Pay Scales of these officers before implementation of the 6th Pay Commission's report - the starting Scale of Pay for DS being Rs.12,000/- and that for Director Rs.14,300/-. It was highly unjustified on the part of GOI when it granted Pay Band and Grade Pay with a SUBSTANTIAL DIFFERENCE to these levels of officers at the time of implementation of the 6th Pay Commission's report. As is known, PB-3 of Rs.15600-39100 with GP of Rs.7600/- is prescribed for DS and PB-4 of Rs.37400-67000 with GP of Rs.8700 for Director level officers. This one of the greatest anomalies in the implementation of the 6th Pay Commission's report. There has been a demand to grant PB-4 with a Grade Pay of say Rs.8000/- to DS level officers. When the Govt. could upgrade and Director level officers to PB-4 - VI Pay Commn. recommended PB-3 to them - there is no logic to deny the same to DS level officers. It is not that only DS level officers are affected. In fact even All India Service and equivalent officers including young Section Officers and Under Secretary level officers will also be affected when they reach the level of DS. The Government should rectify this anomaly soon before the 7th Pay Commission is set up.

Jayanthi Tax

Much is being debated about Jayanti Tax. Evidence is sought by Congress from BJP. In the UPA II in case of 2G and Coalgate Congress had been advocating that there were no actual losses to the exchequer but only presumptive losses. This presumptive loss theory also equally applies in this case. By with holding approval to projects involving thousands of crores of rupees during the period of Jayanthi Natarajan not only the economy had suffered but it has unnecessarily taxed the public due to cost overrun of the projects approved subsequent to her quitting the Government. Why she had been sitting over the files so long which were cleared within short time after her resignation. Moreover, There is no answer for why hundreds of files which were signed and then withheld. A Minister will never withhold the files which have been approved/rejected if the intention is clear. Is all this not a sufficient evidence.

Modi's play on IT - an election stunt

Levy of tax on income is not seen as an harassment to tax payers like Tata, Birla and Ambani group. It is a social commitment of Government. Actually Income tax department is engaged to reduce the difference between have and have not. It is targeted to socialism. If I.T. department is abolished, in what name will government collect more than 5 lakhs crore rupees. Modi`s play on this is only an election stunt. Without any difference all politicians feared this department. I am saying this on the basis of some personal experience.

Why now? Why not earlier?

R.K. Singh former Secretary Home is criticizing Shinde at a stage when he is not in the Government. Why now? Why not earlier? Obviously the answer is that he is paying the price for which he was admitted to the BJP's fold. But one cannot forget the tenure of R.K. Singh as a bureaucrat. He was very arrogant and had feudalistic mentality. While working as Home Secretary and walking in the corridors of the North Block he use to always look at the floor as if it was one of the wonders of the world. He never responded to the wishes of his junior level officers in the corridor. What good can be expected from a person like him.

CBI should be multi member

Granting autonomy to CBI is a welcome step. Single headed CBI will become despotic and person specific rather than institution oriented. Therefore, CBI should be made a multi-member and multi-disciplinary body drawing the members not only from IPS but also from IAAS, IRS, one from Union Finance and Accounts Service. IRS/IAAS/IRS(C&CES) are already represented at middle level. These services bring the requisite domain skills for the benefit of CBI. Existing multi member bodies are CVC, ECI, CBDT, CBEC, TRAI, CAT/SAT are multi member bodies. The crux of the issue is that CBI should be multi member and multi disciplinary body. Please debate.

Delay caused without any malafide intention is not liable for penalty

Information about evasion of Customs duty and of fraudulent obtaining by NITCO Tiles was denied by the PIO after checking from the deemed PIO that the ECA II section of DGFT does not hold the information. The FAA responded that the information sought required sincere extensive search of the old records and consultation with other sections which caused delay and hence, the reply could not be given by the PIO within the stipulated time period of 30 days. The appellant argued that if the information was not held by ECAII Section, the PIO could have obtained it from the concerned section of the DGFT u/s 5(4) of the RTI Act instead of denying the same. The PIO clarified that he had sought the assistance of the concerned section i.e. EPC section of the DGFT and that the reply received from them was communicated to the Appellant. The CIC observed that the PIO should have made it clear in his reply that the information (being communicated to the Appellant) has been obtained from the concerned section of the public authority (DGFT) and that the same may be treated the information on behalf of the public authority. The PIO's statement that information is not available with ECAII Section gives impression that reply is being provided only on behalf of ECAII section and not on behalf of DGFT. The PIO was cautioned to be more careful in future in this regard. The CIC directed the PIO to file an affidavit affirming his statement that the letters mentioned in the RTI application are not available with DGFT. Further, holding that the delay has already been explained by the Appellate Authority in his order, no penalty was imposed on the PIO.

If there is any inadvertent delay, the PIO should write to the applicant informing him of the circumstances and provide the information free of cost subsequently.
