2.66 lakh companies shutdown in country
As many as 2.66 lakh companies registered with the Ministry of Corporate
Affairs have reportedly been closed consigning their employees to the
scrapheap in various parts of the country.
BMHRC itself ailing !
Bhopal Memorial Hospital and Research Centre (BMHRC) - a super-specialty
hospital established on the directive of the Supreme Court to provide
advanced tertiary level super-specialty care mainly to the victims of
the Bhopal Gas Tragedy (1984) - is these days itself ailing for almost
two years since its management has been taken over by the Indian Council
of Medical Research (ICMR) of which Dr. V K Katoch is DG and T S Jawar,
IAS, Dy. DG.ICMR's alleged indifference towards maintaining the hospital's
hard earned 'trust and efficiency' has lead to a situation wherein many
senior doctors and speacialists have either resigned or are contemplating
to do so as they are finding it difficult to discharge their duties
honestly for want of medical equipments which have turned obsolete and
no fresh purchase have taken place. There is a big demanded for transferring
the institution to an autonomous society to prevent it from dying a
slow death. Afterall, "Caring is a way of life".

Saleem Ali to be Vigilance Commissioner ?
Outgoing Special Director of the CBI K Saleem Ali is also said to be
a top contender for the post of Vigilance Commissioner in the CVC.He
is 1978 batch retired IPS officer of Manipur-Tripura cadre.
Preferential "extensions" in MEA
Certain IFS officers of 1979 and 1980 batch, due to retire in 2014 and
2015, have reportedly been given preferential "extensions"
beyond the age of 60, to key positions overseas. Some of them have delayed
moving from Delhi, as the extension begins from the date of joining
office. Any justification ?.
Raghavan to be Ambassador to Russia
Additional Secretary in the foreign ministry P.S. Raghavan, a 1979-batch
IFS officer who is due to retire in July 2015, is being sent to Russia
as the new Indian ambassador. He will get a two-year term from the date
he joins.

Who will be President of Income Tax Appellate
Tribunal ?
Finally, the process for selection of President of the Income Tax Appellate
Tribunal has begun. Law Ministry has asked all short listed retired
High Court judges and sitting Vice Presidents of the ITAT to submit
at least five landmark judgments authored by them. Justice Thakur, Supreme
Court judge and head of the Selection Committee, is believed to be in
favour of personal interview of all the candidates as was done in the
case of National Green Tribunal. ITAT President's position is vacant
since June 2009 and only officiating Presidents were holding office
Rajat Bansal appointed Joint Secretary, Revenue in GoI
Indian Revenue Service officer of Income Tax cadre Rajat Bansal has
been appointed Joint Secretary, Revenue in the Government of India.

Anil Dhaka is relieved from Dept of Labour & Employment, GoI. The

1982-88 batch IRS officers to be Principal
CITs by March
IRS officers belonging to 1982 to 1988 batch are soon to be promoted
as Principal CITs with HAG scale. Deficiencies in annual performance
appraisal report of eight IRS officers are, reportedly, being examined
after which the proposal would be sent to UPSC for date of DPC. The
complete process is expected to be completed by March 2014.
PESB to recommend suitable candidate for MD, MRPL on Jan 22
Selection meetings for the post of Managing Director, Mangalore Refineries
& Petrochemicals Ltd would take place on January 22. PESB would
hold interviews and recommend the suitable candidate to ACC for appointment.
P P Upadhyay, MD, MRPL is completing his tenure on 31 July this year.

DoPT comes up with competency dictionary for
civil services
With a view to developing the capacities of civil servants and strengthening
their enabling environment for more effective, efficient, transparent
and accountable public administration at national and state level, the
Department of Personnel and Training (DoPT) has come up with 'implementation
tool-kit and competency dictionary for the civil services'. The DoPT
is implementing a project 'Strengthening human resources management
of civil service' in collaboration with UNDP in this respect.

Mediocrity for merit paralyses governance
The subject debate will go down in the history of governance practices
in India as the supreme example of calamity caused by sacrificing merit
for mediocrity in governance and public service. Just for petty partisan
interests, the national interests can't be traded so mercilessly. The
wisdom of the people can be doubted only by sycophants at their own
costs. The situation in which they have put the Congress Party is very
pathetic: someone who doesn't want their support is being extended outside
support on his own conditions; he challenges the congress party to withdraw
support if they can and the party does nothing. It is for the first
time in the history of this country that such a political situation
has emerged. Whom to credit for this glorious (or infamous?)achievement
but the subject of the WIC debate.It is in centuries that a country
comes to face such stranger than the Ali Baba stories fiction!

CBI is an agency of central government and hence its officers should
be from Central Police Service(CPS), an organisation of police to be
formed for central agencies like CBI,BSF,CISF,CRPF etc.

Congratulations to Garbiyal
Hearty congratulations to Garbiyal for appointment as DGF. Having reached
the pinnacle of Forest Administration, it's time for picking up the
broom and doing cleaning up of forest management in the states. Scientific
Forest Management in the states has long been abandoned and replaced
by a fast food culture, aimed at fooling everyone all the time! I urge
the new DGF to take a review of forest management in the country and
ensure that it strictly follows Supreme Court directives of December
1996 in the Godavarman Case or else, the country's forests face an unprecedented
doom in another couple of decades!

Delay caused without any malafide intention is not liable
for penalty
Information about evasion of Customs duty and of fraudulent obtaining
by NITCO Tiles was denied by the PIO after checking from the deemed
PIO that the ECA II section of DGFT does not hold the information.
The FAA responded that the information sought required sincere
extensive search of the old records and consultation with other
sections which caused delay and hence, the reply could not be
given by the PIO within the stipulated time period of 30 days.
The appellant argued that if the information was not held by ECAII
Section, the PIO could have obtained it from the concerned section
of the DGFT u/s 5(4) of the RTI Act instead of denying the same.
The PIO clarified that he had sought the assistance of the concerned
section i.e. EPC section of the DGFT and that the reply received
from them was communicated to the Appellant. The CIC observed
that the PIO should have made it clear in his reply that the information
(being communicated to the Appellant) has been obtained from the
concerned section of the public authority (DGFT) and that the
same may be treated the information on behalf of the public authority.
The PIO's statement that information is not available with ECAII
Section gives impression that reply is being provided only on
behalf of ECAII section and not on behalf of DGFT. The PIO was
cautioned to be more careful in future in this regard. The CIC
directed the PIO to file an affidavit affirming his statement
that the letters mentioned in the RTI application are not available
with DGFT. Further, holding that the delay has already been explained
by the Appellate Authority in his order, no penalty was imposed
on the PIO.
Comments
If there is any inadvertent delay, the PIO should write to the
applicant informing him of the circumstances and provide the information
free of cost subsequently.
