Indian Revenue Service officer of Income Tax cadre, Pushpendra Kumar,
DCIT, Ghaziabad, has resigned from the service.
Half a dozen files for board level appointments in Coal PSUs stuck in
ACC
Around half a dozen files related to appointments of functional CMD
and Directors in various Public Sector Undertakings (PSUs) under the
Ministry of Coal are reported to have been lying stuck in the ACC in
anticipation of approval.
Behari empanelled as Secretary from back date
Government of India has empanelled Rakesh Behari as Secretary w.e.f.
2010. Prior to the Delhi HC orders on March 23, 2013 (a week before
his retirement) CAT's observations also had testified the deliberate
suppression of some of his service records at the time of empanelment
of IAS officers of 1977 batch in June 2010. The fresh order, in favour
of Rakesh Behari is in pursuance of Delhi HC's verdict given last year.
Two more slots of ACS in Govt of Chhattisgarh soon
As many as two additional posts of Additional Chief Secretary will be
created in Chhattisgarh soon. Chhattisgarh cabinet has already given
its approval against the proposal. Reportedly, the posts are being created
especially for two senior IAS officers in Chhattisgarh. Keep guessing.
N S Kang all set to move on central deputation
As the grapevine has it, Navreet Singh Kang is all set to move on central
deputation. The 1983 batch IAS officer of Punjab cadre is presently
serving as Financial Commissioner (Revenue). He is empanelled for the
slot of Additional Secretary in Govt of India. His name had been doing
rounds for the coveted slot of Chief Secretary to the Govt of Punjab.
Balwant Singh is CIC, Gujarat
Balwant Singh will soon be sweared -in as new Chief Information Commissioner
of Gujarat Information Commission. The former 1975 batch IAS officer
of Gujarat cadre is presently serving as Information Commission, GIC.
In his new stint Singh would be succeeding D Rajagopalan as CIC.
2894 CRPF personnel resign
As many as 2894 personnel of Central Reserve Police Force (CRPF) have
resigned from the service during the period of 2009 to 2012.

As many 205 IRS (IT) officers belonging to 1992, 1993 & 1994 batches

Impose one week time line for pending files
As the new Government is taking initiative to discipline, let new
Government also put one week time line for the files pending unnecessarily
to harass the efficient officers and take to logical end by end of July
2014 so that justice also is visible.

Amend RTI Act
The RTI Act has been made like the Dowry Act where the onus is on the
accused to prove that he has not done anything malafide. The reason
for the law is the past conduct and behaviour of the bureaucrats. As
per one analysis by the Information Commissioner Shailesh Gandhi, the
incidence of misuse is negligible in the context of overall number of
RTI applications filed in the country. If order passed in this case
is grossly incorrect and suffers from legal infirmity. If there is law
to debar an applicant not to file RTI application repeatedly, why would
a need arise to sent the matter to ministry for making guidelines? It
is a retrograde law and would be quashed in the first hearing by any
High Court.

"Poor Policing"
Police is a State subject. Several police stations, across the country,
boast of ISO-9001 certifications. The claims are out of sync with ground
realities. Consider the national capital. Several police stations under
Delhi police boast of ISO-9001 certifications. There is nothing on records
to substantiate their claims to fame. Reason: The stake holder i.e.
the public is deliberately kept out of loop by rating agencies. This
is a serious flaw in the appraisal system. The lower cadres in the police
apparatus are reluctant to register FIRs despite Hon'ble Supreme court's
directions. The duty officers-in-charge and the investigating officers
(IO), usually hawaldars, encourage mutual settlements between disputing
parties to extort cuts and suppress crime statistics to show a declining
trend. Senior officers are helpless against Head constables.

is not for the privileged few and method of selection should be as broad
based as possible to identify talent and not narrow to filter it.

So much about CGHS beneficiaries specially for Pensioners have been
written in the Whispers but still Dr. Harsh Vardhan is sleeping and
either is not awake or not sensitive to the issue. It is once again
requested to streamline the CGHS direct consultation for pensioners
to ease out the problem and provide medical help. It looks NDA is no
different from UPA in working and will loose its face in coming days.

Destroying UPSC ?
I entirely agree with the views expressed by Aarti Khosla with regard
to the Civil Services Exam. UPSC is one of very few organisations in
the country which has been functioning impartially without any interference
from politicians. The new govt. appears to be bent upon destroying this
institution also.

DATE WITH RTI

Citizen has no right to repeatedly ask for similar information
Through an application filed under the RTI Act, information regarding
the service details and assets of the then CMD, DTC, and also
information on certain retired employees who were granted pension
was sought. During the hearing before the CIC, the respondent
submitted that the appellant has filed around 130 RTI applications,
mostly on the subject of nonpayment of pension to him. The CIC
observed that it is a case of repetitive use of RTI Act, assuming
the proportion of harassment to the Public Authority and abuse
of RTI Act. Holding that repetitive use of RTI amounts to abuse,
the CIC ordered that the same should be a ground for refusal of
application and appeal. The CIC directed the deputy registrar
to send the copy of the order to the Ministry of Personnel and
Training with a recommendation to send it to all the Public Authorities,
First Appellate Authorities and State Information Commissions.
A copy was also sent to the Ministry of Personnel and Training
to commission the framing of guidelines, for the benefit of and
ready reference by Public Information Officers to refuse the repeated
RTI applications, provide a ground for First Appellate Authorities
to refuse second appeals if arise out of such refusals and similarly
to reject the Second Appeals by Information Commissions either
central or state.
Comments
This order would come as a relief to the officials who feel an
atmosphere of fear and worry in the offices and are hesitating
to take action against erring staff members for fear of facing
flood of questions under RTI. However, the RTI Act does not specifically
provide repeated filing of application as a ground of refusing
the information, and the implied interpretation by the CIC is
likely to be challenged in the higher judicial forum.
